Section l.
That Chagter 60 of the Saint Paul Legislative Code is hereby
amended by adding a new Section 60.326a to read as follows:
60.326a Dwelling, Three-Family: A building designed
exclusively for or occupied exclusively by no more than
three (3) families living independently of each other.
Section 2.
That Chapter 60 af the Saint Paul Legislative Code is hereby
amended by adding a new Section 60.326b to read as followss

other.

That Section 60.431 of the Sai�nt Paul Legislative Code is here-
by amended to read as followss
60.431 INTENTs
The RT-2 Tawrihouse Residential District is designed to
provide sites for two-, three�-, and four-family and town-
house structures to satisfy the needs of people seeking
this nature of facility and to serve as zones of transi-
tion between one- and two-family residential districts and
multiple�-family residential districts and business dis-
tricts. This district also recoqnizes the existence of
older residential areas of the Citv where larger houses
have been or can be convert�d from sinqle-family to two-,
three-, or four-familv residences in order to extend the
economic lif� of these structures and allow the awners to
�ustify the expenditures for repairs and modernization.
The RT-2 District further provides for housing that has
many of the amenities of single-family dwellings arranged
in a low-density, multiple-family pattern.

That Note " (f) " to Section 61,101 of the Saint Paul Legisla-
tive Code is hereby amended to read as followss
(f) In an RT-2 Townhouse District, the total number of
rooms (ncat including kitchen, dining, and sanitary
facilities) shall not be more than the area of the
parcel, in square feet, divided by one thousand
one hundred (1,100) .
In an RM-1 Multiple-Family District the total number
or rooms (not including k3tchen, dining, and san-
itary facilit�es) shall not be more than the area
of the parcel, in square feet, divided by nine
hundred (900) .
In an RM--2 Multiple-Family District the total nutaber
of rooms (not including kitchen, dining, and sanitary
facilities) shall not be more than the area of the
parcel, in square feet, divided by six hundred (600) .
In an RM-3 Multiple-Family District the total nuwber
of rooms (nat including kitchen, dining, and sanitary
facilities) shall not be more than the area of the
parcel, i.n square feet, divided by three hundred (300) .

That Subsection "d" of Section 62.102 of the Saint Paul Legis-
lative Code is h�r�by amended to read as followss
d. Idonconforming Structur�s with Conforming Use
Where a lasnrful structure +exists at th� effective
date of adoption Qr amendment of th�.s Ordinance
that could not be built under the terms of this
Ordinance by reason of restrictions on area, lot
coverage, height, yards, or other characteristics
of the structure or location on the lat, such struc-
ture may be continued so long as it remains other-
wise lawful, subject to the following provisions:
(1) �ie-s�te� Such structure may be enlarged or
altered �n-a-�e�-�#e� so long as such �n�
larqement or alteration does not increases
its nonconformity, Accessorv buildinqs may
be added so lonq as thev conform in all r�-
spects to the reguirements of Sectian 61.100
"SCHEDULE OF REGULATIONS".
(2) Should such structure be destroyed by any means
to an extent of more than sixty (60) percent of
its replacement cost, exclusive gf the founda-
tion at the time of destruction it shall not be
reconstructed except in conformity with the
provisions of this Ordinance.
(3) Should such structure be moved f4r any reason
for any distance whatever, it shall thereafter
conf�rm to the regulations for the district in
which it is located after it is moved.

Section 15.
That Subsection "e" of Section 62.102 of 'the Saint Paul Legis-
lative Code is hereby amended to read as follows:
e. Nonconforming Uses of Structures ar�d Land
If a lawful use of a structure, or of structure and
land in combination, exists at the effsctive date
of adoption or amendment of this Ordinance, that
would not be allowed in the district under the terms
of this Ordinance, the lawful use may be continued
so long as it remains otherwise lawful, subject to
the following provisions:
(1) No existing structure devoted to a use not
permitted by this Ordinanc� in the district
in which it is located shall be enlarged, ex-
tended, reconstructed, moved, or structurally
altered except in changing the use of the
structure to a use permitted in the district
in which it is locatedf
(2) Any nonconforming use may be extended through--
out any parts of a building which were mani-
festly arranged or designed for such use, and
which existed at the time of adoption or
amendment of this Ordinance, but no such use
shall be extended to occupy any land outside
such buildingj
(3) If no structural alterations are made, any
nonconforming use of a structure, or structure
and premises, may be changed to another noncon-
forming use of the same or a rnore restricted
classification provided th�t the Planning Com-
mission, either by general rule or by making
findings in a specific �as�, shall find that
the progosed use is equally appropriate or more
appropriate to the district than the existing

nonconforming use. In permitting such change,
the Planning Cammission may require appro-
priats conditions and safeguards in accord
with the purpose and intent of this Ordinance.
Where a nonconforming use of a structure,
land, or structure and land in combination
is hereafter changed to a more restrictive
classi�ication, it shall not thereaft�r be
changed by the Planning Commission to a less
restrictive classification under this clause.
Decisions �f the Planning Commission under
this section shall be final, subject to appeal
to the Board of Zoning Appeals in accordance
with 3ection 64.203�
(4) Any structure, or structures and land in com-
bination, in or on which a nonconforming use
is superseded by a permitted use, shall there-
after conform to the regulation for the district
in which such structure is located, and the non-
conforming use may not thereafter be resumedf
(5) When a nonconforming use of a structure, or
structure and premises in combination, is dis-
continued or ceases to exist for 365 days e�-�e�
548-e�a��e-e��#�sg-a��-���ee-�ea�-per�ee�, the
structure, or structure and premises in combin-
ation, shall thereafter be used in conformance
with the regulations of the district in which
it is locatedt unless the PlanninQ Commission,
pursuant to a public hearinq, finds that the
structure, or structure and premises in combin-
ation cannot reasonably or economically be used

for a conforminq purpose, that the proposed
use is equally appropriate or more appropri-
ate to the district than the previous noncon-
forming use, and that the proposed use is
consistent with the health, safety, morals,
and qeneral welfare of the community and is
consistent with the reasonable use and eniov-
ment of ad�acent propertys 8tr�te�e��es-eee�t-
p�ee�--19�-��aes�a�-t�ees-e�a��]9e-e�eegte�--��ex�
����-��e��s�e�:
(6) Where nonconforming use status appl�.es to a
structure and premises in combination, remov-
al or destruction of the structure shall
eliminate the nonconforming status of the land�L
(7) In any OS-1, B-1, B-2, B-3 District existing
residential uses shall not be nonconforming
as to use of structure and land and may be
structurally enlaxged, extended, reconstructed,
c�r altered provided no additional dwelling units
are added on the lot, and provided that the
minimum requirements of the R-4 District are met.
Section 16.
That Subsection "1" of Section 62.103 of the Saint Paul Legis-
lative Code is hereby amended to read as follaws:
l, Where 25 or more automobile parking spaces are pro-
vided, at least one space per 50 spaces, or fraction
thereof, shall be provided for the use of the handi-
capp�d. Each space reserved for th� exclusive use
of the handicapped shall be designated by an interna-
`ational wheelchair symbol.

Legislative Code is hereby amended to read as follows:
c. Accessory buildings in any residential area, except
in the RM-2 or RM-3 Multiple-Family Residential
Districts, shall not exceed one (1) story or four-
teen (14) feet in heightt provided, however, that

WHEREAS, the City of St. Paul Planning Comnission initiated a 40 Acre �
Study to amend chapters 60 and 64 of the St. Paul Legislative Code at
their regular. meeting on January 13, 1978; and
WHEREAS, the Current Planning Committee of the Planning Comnission reviewed
the suggested ordinance amendments and has recomnended them to the Planning
Comnission for approval ; and
WHEREAS, pursuant to Minnesota Statutes #462.257(5) the Planning Commission
did hold a public hearing on the proposed amendments at its regular meeting
on February 10, 1978 and on February 24, 1978; and
WHEREAS, the Planning Comnission has determined:
I'� l. That the number of real estate descriptions affected by the ordinance
renders the obtaining of written consents impractical ,
2. That a survey of an area in excess of 40 acres has been made,
3. That a determination has been made that the amendments to this ordinance
proposed are related to the overall needs of the cortununity, to existing
land use and to a plan for future land use, and �
4. That pursuant to State Statutes proper notice of the hearing has been
given in the Pioneer Press and Dispatch on January 20, January 27, and
February 3, 1978:
NOW, THEREFORE, BE IT RESOLVED, that the Planning Comnission recommends
approval of the zoning code text amendments attached hereto as proposed in
the 40 Acre Study and directs the Planning Coordinator to forward the study
and this resolution to the Mayor and City Council for their review and action.

That Section 20.02 of the Saint Paul Administrative Code, as
amended by Ordinance No. 16400, is hereby further amended ta read
as follows:
20.02 - PUWERS AND DUTIES
The Commission shall se�rve as an advisory body to the
Ma.yor and the City Council on municipal planning matters
as required by the Municip�l Planning and Development
� Act, Minnesota Statutes 46�-.�51. It shall review and
comment upon comprehensive 'plan recommendations, studies �
and amendments submitted by the Office of the Mayor
through the Division of Planning and shall recommend to
the Mayor initiation of such planning studies as it deems
necessary for the proper preparation of a comprehensive .
plan or any portion thereof. All such studies trans--
mitted to the Council thsough the Mayor's Office shall
contain the recommendations of both the Division of
� Planning and the Planning Commis�ion, The Commission
shall be kept informed by the Division of Planning of the
planning activities ot a11 city departments and agencies,
including the capital improvements committee, as saell as
tho�e of adjacent units of government and all other

Before the comprehensive plan, any amendment thereto or
any proposaZ for effecting said plan shall be certified
by the Commission, it shall hold at least one public
hearing thereon. Notice of the time, place and purpose
of the hearing shall be published once in the official
newspaper of the city at least ten days before the day
of the hearing. An outline of. the proposal shall be
transmitted to the Mayor and the City Council at the time
the request is made for a notice of the public hearing.
At such time as hearings are concluded, and within thirty
days thereafter, the Commission shall certify to the
Mayor and City Council its recommendations on the com-
prehensive plan, any amendment thereto, or any proposal
for effectuating said plan. Until adopted by the City
Council, the plan, any amendment thereto or any proposal
for effecting said plan shall constitute only the rec-
ommendation of the Planning Commission.
To discharge its duties and responsibilities, the Com-
mission shall have the power to elect its own officers
and make its own rules for the conduct of its business,
Such rules may provide for the deleqation of Commission
duties, responsibilities and powers to the head of the
Division of Planninct of the Department of Planninq and
Economic Development or such emplovees under his direc-
tion as he mav desiqnate, in accordance with and subiect
to law. Such rules and amendments thereto are not effec-
tive until filed with the citv clerk. The Commission
shall use the servic�s of the staff of the Division of
Planning as required for the conduct of Commission
