WHEREAS, the City Council approved and ratified the assessment for
Improving Vandalia Street from Ellis Avenue to Eapp Road, Council File 270381,
approved January 19, 1978, and
WHEREAS, the proportionate :�hare of the costs assessed against Capp
Industries, Inc. amounted to $44;.62fi,.30, and '

WHEREAS, the Capp Industries,�,.Inc. filed a notice of appeal against said
assessment due to certain aspects of the�� construction being for 5idewalk reconstruction
still under warranty, as constructed by �ity Per�3t �1831,in the amount of $5,776.80, and
WHEREAS, said appeal has been ��nsiderEd as being justified, and recommended for
reduction by the Valuation Engineer and C�ty Attorney,
NOW THEREFORE, BE IT RESOLVED, t���' t�ie ass�ssment �f benefits as shown
on the attached, be revised as indicated a�d in' t�e amounts shown, and that upon
adoption by the City Council, a dismissal ef the appeal �aould be filed on behalf
of Capp Industries, Inc. by Mr. Samuel Saliterman, Attorney at La�.

� Departtaent of Finance and Mattagement Services. Within twenty days after the order
' a3cpting the assessment, or making a reassessment, a new assessment, or supplemental
assessc�eret, any person may appeal to the District Court by filing a notice of appeal ',,
with the City Clerk stating the grounds upon which the appeal is taken. Such netice

The assessment of benefits, cost and expenses for and in connection with the above improvement having been
submitted to the Council,and the Council having considered same and found the said assessment satisfactory,therefore,be it
RESOLVED, That the said assessment be and the same is hereby in all respects approved.
RESOLVED FURTHER, That a public hearing be had on said assessment on the Thirtieth day of
May, 1978 , at the hour of ten o'clock A.M., in the Council Chamber of the
Court House and City Hall Building, in the City of St. Paul; that the Director of Finance give notice of said meetings,as
required by the Charter, stating in said notice the time and place of hearing, the nature of the improvement, and the
amount assessed against the lot or lots of the particular owner to whom the notice is directed.
