1 WI�REAS, residents of the City of Saint Paul have atready suffered through one summer of discomforting odors
2 from Gopher State Ethanol, due to the commencement of ethanol production in the spring of 2000; and
3 VJHEREAS, the City of Saint Paul has a stated interest in eliminating the odors and has in due course ini6ated an
4 investigation to determine if Gopher State Ethanol constitutes a public nuisance; and
5 WFiEREAS, parties including Gopher State Ethanol (GSE), the Minnesota Pollution Control Agency (MPCA), the
6 Minnesota Center for Environmental Advocacy (MCEA), Fort Road Federation, Ciry of Saint Paul Department of
7 Planning and Economic Development, and the Gopher State Ethanol Working Group have been meeting regularly
8 to assess oprions designed to eliminate the odor; and
9 WHEREAS, general agreement eatists that, short of shutting down ethanoi production, GSE's proposed thermal
10 oxidizer represents our best option for mitigating the ethanol odor from neighborhoods surrounding GSE; and
11 WHEREAS, due to required notice and public comment periods, as well as routine workload constraints, the
12 MPCA's license for the thermal oxidizer is not e�cpected to be approved until July of 2001, preventing the
13 equipmenYs operation until such time, and substantiaily impinging on another enjoyable summer for Saint Paul's
14 residents; and
I S WI�REAS, two remedies exist to ad dress the proposed 7uly delay for the thermal oacidizer, one being a complete
16 shut-down of Gopher State Ethanol's production pursuant to the City's public nuisance action until the thermal
17 oxidizer is operational, the other being an e�edited license applicarionprocess, allowing immediate implementation
18 of GSE's plans for installing and operating the thermal oxidizer; and
19 VJHEREAS, it is the goal of the City of Saint Paul to retain the Brewery-Ethanol facility and the jobs it sustains,
20 but to do so in the conte�rt of resolving the odor issue; and
21 WHEItEAS, the spirit of the public nofice and comment periods have been realized through the e�austive media
22 attenrion, public participation, and public heazings tha# have been held regazding GSE; and
23 WHEREAS, it is in ihe interest of the City of Saint Paul and its residents that the effectiveness of the proposed
24 theimal o�dizer is known earlier, rather than later, and that the risk of job loss, however remote, be avoided; and
25 WHEREAS, GSB has offered to pay the MPCA for any overtime costs associated with its request for an eapedited
26 timeline on its application for a thermal o�dizer; and
27 WHEREAS, the City of Saint Paul's cooperarion with GSE has been and will continue to be, predicated on honest
28 communication with, and evidence of good faith effort by, GSE: and

1 THEREFORE, BE IT RESOLVED, that the City of Saint Paul urges the Minnesota Pollution Control Agency to
2 expedite Gopher State Ethanol's license application for a thermai oxidizer, and that any such permits, licenses, or

4 before Mazch 15, 2001; and
5 BE TT FINALLY RE50LVED, that the City of Saint Paul urges the Minnesota Legislature and the Saint Paul
6 Delegation to enact wbatever measures may be necessary to ensure tbat a thorough, but expedited, approval process
7 for the thermal oxidizer be followed.
