WHEREAS, the Council of the City of Saint Paul has adopted a
Redevelopment Plan for the Downtown Urban Renewal Area, Minn. R-20,
by its Resolution �•F. No. 218124, on May 15 , 1964 , and a Redevelop-
ment Plan for the Central Core Neighborhood Development Program,
Minn. A-1-5, by its Resolution C.F. No. 261921, on August 21, 1973,
hereafter collectively referred to as the Redevelopment Plans; and
WHEREAS, said Redevelopment Plans set forth certain public
actions , objectives and purposes to be accomplished by expenditure
of public funds through property acquisition, such as Block A, Down-
town Urban Renewal Area, and Block 27, Central Core NDP Area,
clearance of blighted and substandard structures, provision of public
improve�nents, other public prepa�ration for sale of such acquired
property for public and private redevelopment, imposition of land use
and building controls and requirements designed to accomplish the
public purposes and objectives of the redevelopment project under-
takings, and sale of land fo� redevelopment in accordance with said
Plans, controls and requirements; and- -
WHEREAS, the Council of the City of 5aint Paul has adopted a
Development District Program for the Downtown Development District _'
No. 3, by its Resolution C.F. No. 263751, on June 27, 1974, which
Program sta�ed Citywide and Development District objectives to be
accomplished through provision of pu3plic facilities, such as parking,
pedestrian skyway system, people mover system and mall and people
place on Seventh Street in aid of obtaining development of lands
acquired in the redevelopment projects and other public objectives of
said Program; and �

WHEREAS, during the implementation of the aforesaid Redevelop-
ment and Development District Plans, in furtherance of the public
development and redevelopment thereby undertaken, and in response to
provision of the City's Community Development Block Grant Program,
the Council, by its Resolution C.F. No. 267921, on September 30 , 1976,
approved certain public undertakings and improvement activities as
proposed in the Seventh Place Development Concept Plan approved by
Operation 85 on September 16, 1976, including acquisition by the
Housing and Redevelopment Authority of the City of Saint Paul, Minnesota
(HRA) with City funds of Block 27, bounded by Seventh and Eighth Streets
and Cedar and Minnesota Streets, and the undertaking by the City of
plans for establishment of a pedestrian mall on Seventh Place
between St. Peter and Sibley Streets; and
WHEREAS, the Council of the City of Saint Paul, by its
Resolution C.F. No. 268848, on April 5, 1977, approved a Project
Description and Scope of Work for Preliminary Engineering and
Related Activities, St. Paul Downtown People Mover Demonstration,
and pursuant thereto the City has undertaken People Mover studies
and plans and expended public money, and the HRA at direction of
the Council has been placing in its Contract For Sale Of Land For
Private Redevelopment, requirements that the design of such private
development accommodate provision for construction of a Downtown
People Mover System; and
WHEREAS, City Planning Division, Department of Planning and
Economic Development, has updated its Comprehensive Plan For
Downtown Saint Paul in light of the Seventh Place Project and other
public undertakings for downtown development and prepared a report
entitled, "Tomorrow's Framework From Today's Foundation: Planning
For powntown Saint Paul, " adopted by the St. Paul Planning Commission
on April 22, 1977, and adopted by the Council of the City of Saint

Paul, by its Resolution C.F. No. 269426, on July 19, 1977; and
WHEREAS, in accordance with the several plans and public improve-
ment programs undertaken by the City or by the HRA at the direction
and with the approval of the City Counsil, wifiX� City of Saint Paul
urban renewal and development district�bond funds, tax levies, and
other public revenues, herea£ter collect�ly referred to as the
Eeventh Place Project, HRA undertook acquisition of said Block 27 and
programmed and concluded sale of Block 27 and of Block A acquired in
the Downtown Urban Renewal Project for public and p�tate redevelop-
ment in said Blocks and in to be vacated Seventh Street abutting them
in a unified multi-purpose and physically interconnected development
including a public parking facility, public galleria, hotel, retail
commercial and office facilities designed with provision for off-
street loading facilities serving these development designed with
provision for construction of the Downtown People Mover System within
said development; and
WHEREAS, the Council of the City of Saint Paul, by its Resolution
C.F. No. 270586, on February 21, 1978, determined that the public
parking facility to be constructed in Block A of the Seventh Place
Project constituted a public improvement undertaken by the City of
Saint Paul requiring the removal and relocation of utilities located in
the streets adjacent to Block A and ordered Northern States Power
Company and Northwestern Bell Telephone Company to remove and/or
relocate at their expense said utilities as required for the construc-
tion of said public parking facility; and
WHEREAS, under date of April 26, 1978, the Council is in receipt
of a communication from the Mayor of the City of Saint Paul requesting

Council consideration of necessity to remove and relocate certain
utility facilities in part of Eighth Street abutting Block 27 of
the Seventh Place Project by reason of the use of said part of
Eighth Street by the City and the public for access to the off-street
loading facilities being constructed in Block 27 to serve the Seventh
Place goject development, which request was referred to the Council
Public Works Committee for hearing upon notice to said Companies;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
SAINT PAUL, having received the report and recommendation of the
Public Works Committee:
1. That the provision of off-street loading facilities in Block
27 of the Seventh Place Project is required by the Redevelopment Plans
and Contract For Sale of Land For Private Redevelopment (Contract)
dated Aug�st 26, 1977, between the City of Saint Paul, the HRA and
Oxford Properties U.S. Ltd. (Oxford) , that the public access to these
off street loading facil.ities will be in a ramp in the South 25 feet
of Eighth Street between Cedar and Minnesota Streets; �that the
construction of this ramp will require the removal of gas, electric
and telephone facilities located in said South 25 feet of Eighth Street;
that under the Contract, Oxford was required to design its improvements
to accommodate the location and provision of public improvements
undertaken by the City of Saint Paul, and the Eighth Street access
and ramp construction for the off street loading facilities is the
only feasible method of adequately meeting the further Plan and
Contract requirement for off street loading facilities; and that
this means of access and ramp construction is the result of the
routing plan for the Downtown People Mover System in Block 27 and
the location of the public galleria and public parking facility,

2. That Northern States Power Company and Northwestern Bell
Telephone Company have agreed to remove and relocate their respective
utility facilities from the South 25 feet of Eighth Street between
Cedar and Minnesota Streets as required for the construction of the
Seventh Place Project.
3. That Northern States Power Company and Northwestern Bell
Telephone Company are hereby advised and directed to remove their
respective facilities in accordance with the Schedule Of Required
Utility Relocations attached to the April 26, 1978 communication
from the Mayor as the same may be revised by administrative directi��
from the Mayor f � of the City of Saint Paul, with expense of said
removal and relocation to be borne in accordance with the letter
agreements dated May 11, 1978, with respect to Northern States Power
Company, and dated May 12 , 1978, with respect to Northwestern Bell--
Telephone Company.

Re: Relocation of Utility Facilities in Eighth Street
Seventh Place Project
Provision of the public improvements in the Seventh Place Project
being undertaken by the City of Saint Paul with local and federal
funding, in cooperation with the Port Authority and Housing and
Redevelopment Authority, St. Paul Joint Venture and Oxford Properties
U.S. Ltd. , will require the relocation of existing gas , electric
and telephone facilities from the South 25 feet of Eighth Street
between the East right-of-way line of Cedar Street and the West
right-of-way line of Minnesota Street.
Pursuant to Sections 59. 03, 503. 03 and 504. 03 of the Saint Paul
Legislative Code, Northwestern Bell Telephone Company and Northern
States Power Company are required to remove and relocate their
utilities without cost to the City of Saint Paul when advised by
the Council to so remove and relocate as necessary to use of the
said Street by the City and necessary by reason of the undertaking
of any public improvement by the City.
The Council is requested after due consideration of this matter to
direct the removal and relocation of these utility facilities in
accordance with the attached Schedule as necessary to the use by
the City and public of the said South 25 feet of Eighth Street for
vehicular access to the off-street loading facilities in the abutting
Seventh Place Project property and as necessary to the Downtown
People Mover public improvement undertaken by the City within the
Seventh Place Project Area.

The following schedule has been prepared by the Department of
