The chairman noted the letter from Attorney Straughn in response . Attorney Straughn stated that it would be proper to defer fee �aymen�s until such �ir�e as the building might be sold, provided there �as some record of it on the deed so that a prospective buyer would be aware of the fees payable to the city. Steve Roy asked if he should continue billing the corporation or just accumulate the amounts due at each quarter. Chairman j�Tozniak replied that the fees should be accumulated on the books . Attorney Straughn said there was no provision for deferment af fees �beyond one year under the Vacant Building Ordinance. SUBJECT: Request waiver of St. Paul Legislative Code provision requiring that bathroom be located within walls of �it (Apt. #4 only) ; an d also, request waiver of requirement of second means of egress from third floor apartments , since alternate me ans is available, although not strictly in code compliance, because of financial hardship. APPEARANCE: Clarence A. Lin deke PROCEEDINGS : Mr. Lindeke told the Board that the building inspector had suggested replacemen� of the two third floor bathroom windows with either doors or lower windo��s , and then constructing a stairway leading from these exits to the ground. Mr. Lindeke explained that at present there was a ladder leading from a third floor window down to the second flaor. A similar ladder could be built from a third floor bedroom windaw to the roof of a norch which reached to the second floor. He felt this was a reasonable substitute for the more expensive construction the inspector had described. Alice Bijjani stated that a stairway was required leading to the ground level and it had to be accessible to all third flovr units . If replace- ment windows were installed instead of doors in the 3rd floor bathrooms , they should be a type that swings outward for ease of exit in an emergency. Mr. Lindeke said he would like to have a time extension beyon d the May 10, 1978, deadline listed in the letter from the Housin g Code Division. The carpenter who normally i�orked for him had suffered a heart attack, and Mr. Lindeke wanted to consult him about the project and learn whether he would be well enau�h to do the work or whether Mr. Lindeke would have to find another t�orkman. Ms. Bij j ani explained that if Mr. Lindeke brought in some plans that met code requirements , the Housing Code agency could give him a six month' s extension to complete the work. PROPE RTY APPELLANT 05- 78-B 345 Wab asha Virgil Doerfler ' Doerfler Sc{uare (formerly t the Lowry Hotel) (149 units , plus commercial} SUBJECT: Request waiver of St. Paul Legislative Code requireme�t pertaining to emergency standby electric generation for elevators, because of high cost and because other safety measures make it unnec�ssary. APPEARANCE: Virgil Doerfler, Sylvester �icDonough PROCEEDINGS : City Architect Glenn Erickson explained that the bui.lding was over 75 ft. in height which, if it were new cons�ruction, wc�uld put it in the classification of a high-rise structure . This class of building rec{uires a standby power generator for a fire pump and for the elevator. Street pressures in the water mains are insufficien� to deliver water in required volu�e at the to.p, so there has to be a pump to accomplish this . This is being installed and is very costly, but to add the standby generation, which would also require an on-site fuel supply and other items , would add a great deal more to the e xpense. As for the elevator system, the height of the building req�i res that at le as t one elevator have standby power. He said that Mr. Doerfler had agreed to a long list of fire-safety rec{uirements which the Code Enforcement Division had b rought to his attention and in every respect h ad been most cooperative . However, he hesitated over the s�andhy generation of power for tne elevators reQuired by the code . Assistant Fire �farshal Dan Norrgran related that a �heck had been made with Northern States Power as to the reliability of the power supply. NSP had given it a high rating, as the downtown are�a did not have overhead wires to cause a problem. In regard to st�.dby power for the fire pump, it was desirable to have it, but not absolutely necessary. If the fire pu�p should lose power, the Fire Depart�ent can bypass the pump, using the Fire Department pumper instead to p�ip water into the system. He explained that there are connections an the outside of the building to support that system. Also , the building is not so high that there would be insufficient gressure to pump water to the top floor. . � ; - 7- 3/28/78 - Meeting No. 138 ~ ?�ir. '�orrgran said in this case a standby generator does not have as great significance as it might have in some buildings . iir. Glassman said it ap�eared the main problem was standby power for the elevator. �ir. Erickson agreed with this statement . He said Chanter 88 of the Fire Code states that when there is a change made in an elevator, the type of drive , speed of o�eration, etc. , all other snecificatians must be brought up to a certain level spelled out b� the code. Since i�ir. Doerfler is installing two new high-speed, self-controlled elevators , standby generation is also reauired. �ir. Doerfler stated that the additional cost iaould be about $40,UQQ . bir. Erickson said that , aside from the cost of the generator itself, it has to be installed in a two-hour fire-rated room, it has to be ventilate� there has to be a fuel supply, and there have to be transfer switches to �ake the automatic transfer of power. San Blue note d that Mr. Doerfler, in listi.ng the fire-safety items he had agreed to do, had not included the sprinkler system in the basement. Mr. Doerfler pointed out tW0 other areas which were sprinklered as well, the tobacco shop and the bar and restaurant . He said the building itself is fireproof, even the fire wallswere cement. He reported that the elevators work on a separate power from the rest of the building, so if the power goes out in the building, the elevators continue to work on their own. There was also emergency lighting, supplied by battery pac�, �in case there should be a loss of power affecting the elevators .
