VJHEREAS, the Legislative Hearing Officer recommends that the license application (ID # 20010001028) for a
Malt Off Sale License by Ahmad Khatib, President, doing business as Adam's Food,1390 Third Street East, be
approved with the following conditions:
1. No outdoar banners far cigazettes or beer. Other banners are allowed only as pernutted;
2. Installafion of outdoor trash receptacles azound the property;
3. Ongoing operation of video security cameras inside and outside to be installed by January l, 2002;
4. Sufficient outdoor lighting to discourage loitering; and
5. Property is kept free of r2fuse.
THEREFORE, BE IT RESOLVED, that the Council of the City of Saint Paul hereby approves this license
application with the aforementioned conditions.

The meeting was called to order at 3:02 p.m.
STAFF PRESENT: Christiue Rozek, LIEP (License, Inspections, Environmental Protection);
Kristine Schweinler, LIEP
Gerry Strathman stated trus meeting is being held to hear objections to the issuance of licenses to
Adam's Food, 1390 Third Street Bast.
Christine Rozek reported this is an applicafion for a malt off sale license that will be added to a
grocery license at 1390 Third Street East, Adam's Food. The license already has a number of
conditions on it. LIEP is recommending that this license application be appzoved. Fire and
Zoning recommend approval also.
Mr. Stratlunau stated two objections have been received for this license application: 1) Laura
Burback, 476 Etna Street, wrote the license will not bring anything positive to the neighborhood
and they do not need more liquor stores/bars in the area; 2) Kenneth and Josephine Johanson,
438 Etna Street #106, wrote the license is too close to a day care center, there aze low income
apartments around, and there is a liquor store nearby on Maryland and Prosperity.
Ahmad Kha6b, owner, appeazed and stated Maryland is faz from his location. He will be selling
only 3.2 beer.
Mr. Strathman asked is he prepazed to continue to accept the conditions. Mr. Khatib responded it
is a new store now and the construction is done. He is already under those conditions. He will
soon install the camera.
Mr. Strathman stated the first part of Condition 1 reads "No outdoor banners" and the second part
reads 'butdoor cigazette banners or signs." Ms. Rozek responded the intent of the district council
is that there be no outdoor banners. Mr. Khatib responded he does not put up cigarette or beer
banners. He does not agree with the condition about other banners. This is a gas stafion, and
they have to do a little advertising.
Kristine Schweinler stated the letter from Dayton's BlufF District 4 Community Council reads
"No outdoor banners and outdoor cigazette banners or signs." She does not tlunk they haue an
obj ection to advertising in the windows. They do not want the outside cluttered with banners and
signs. Mr. Khatib responded that any gas station puts up banners for pop and the automatic teller
machine. It does not hurt to put up banners for other things. Ms. Schweinler staxed there are also
zoning requirements far outside signs. Temporary banners aze one of the zoning requirements.
Advertising inside the windows is not regulated.
Mr. Khatib stated it is unfair if he cannot put up any banners.

Mr. Strathman stated he would like to unprove the language to reflect the needs of the
neighborhood, the business, and the zoning code. He asked should the condition simply read
"No outdoor banners." Ms. Rozek responded that is the intent of the district council that there
not be any outdoor clutter. Mr. Strathman responded thax seems ea-treme. Ms. Schweinler
concurred and suggested the following language: "No outdoor banners advertising cigazette or
beer sells and no other banners without appropriate pernuts if required."
Mr. Strathman does not find the reason permitted by those objecting in writing to be sufficient
basis for denying the license application.
Mr. Rozek asked could the camera be installed by January 1. Mr. Khatib responded yes.
Gerry Strathman recommends approval of the license application with the recommended
conditions as follows:
I. No outdoor banners for cigarettes or beer. Other banners are allowed only as permitted;
2. Installation of outdoor trash receptacles azound the property;
3. Ongoing operation of video security cameras inside and outside to be installed by January 1,
2002;
4. Sufficient outdoor lighting to discourage loitering; and
5. The properry is kept free of refuse.
The meeting was adjourned at 3:14 p.m.
