WHEREAS , Leo A. Scheu applied to the City Council for a
determination of the zoning district boundary for the east 6 feet
of Lot 11, Block 1, Rothschild' s Addition, pursuant to Section
60. 402 (f) of the Zoning Ordinances of the City of Saint Paul; and
WHEREAS, Said Section 60. 402 (f) provides that the Council,
upon written application, may determine the exact boundary location
of any intended zoning use district where, because due to scale,
lack of detail, or illegibility of the zoning map, there is un-
certainty, contradiction, or conflict as to the intended location
of any district boundaries; and
WHEREAS, Leo A. Scheu' s Lot 12 is currently zoned B-1 and
has been used as a parking lot for a supermarket since September
1967, and Mr. Scheu states that the east 6 feet of the adjacent
Lot 11 has also been used as a part of the parking lot; and
WHEREAS, Prior to the adoption of the present zoning classification
both Lots 11 and 12 were zoned for commercial, and the present zoning
classification is RM-l; and
WHEREAS, The Council, having heard from the applicant and
having considered the report of staff, does hereby
RESOLVE, That the Council of the City of Saint Paul, pursuant
to the authority granted it by Section 60. 402 (f) of the Zoning
Ordinances, and based upon the evidence considered, does hereby
find and determine that the boundary line for the B-1 zone is up
to and does include the east 6 feet of Lot 11, Block 1, Rothschild' s
Addition. �

A. PURPOSE: The purpose of this report is to provide a staff recommendation for the
C�ty Countil on the interpretation of a zoning district boundary concerning Leo
Scheu. Mr. Scheu requests interpreting the existing zoning district boundary
line between Lots 11 and 12 to include the east 6 ft. of Lot 11 with Lot 12 in
a B-1 zone.
B. FRONTA�E & AREA:
1 . Lot 11 , Block 1 , Rothschilds Addition, has 37.1 ft. frontage on Randolph and is
111 .8 ft. deep, for a total area of 4,148 sq. ft.
2. An existing house on said Lot 11 (805 Randolph) has as its legal description
"the east 6 ft. of Lot 10 and all of Lot 11 , Block 1 , Rothschilds Addition. "
This house and property, therefore, has 43.� ft. frontage on Randolph and is
111 .8 ft, deep, for a total area of 4,819 sq. ft.
3. Lot 12, Block 1 , Rothschilds Addition, has 38.1 ft. frontage on Randolph and
is 111 .8 ft. deep, for a total area of 4,260 sq. ft.
C. SITE CONDITIONS: An older, well-kept, sin le family home occupies Lot 11 and the
east 6 ft. of Lot 10 Rothschilds Addition �see "B" above). An asphalt parking lot
occupies all of Lot 12 and, according to Mr. Leo Scheu, the east 6 ft. of Lot 11
Rothschilds Addition. A single family house borders the subject properties on
the west and Dannekers Super Market borders on the east.
D. AREA CONDITIONS: The area is characterized by single family homes with some multi-
family and commercial uses along Randolph.
E. ZONiNG DISTRICT BOUNDARY INTERPRETATION:
Section 60.402(f) states: "Where unzoned property may exist, or where, due to the
scale, lack of detail , or illegibility of the Zoning Map, there is any uncertainty,
contradiction, or confliction as to the intended location of any district boundaries
shown thereon, interpretation concerning the exact location of the district boundary
iines shall be determined by the City Council , upon written application, or upon the
Council 's own motion following review and recomnendation by the Board of Zoning Appeals."
In this case Mr. Scheu has made written application to interpret a zoning district
boundar,y.

F. FINDINGS:
1 . The north side of Randolph between Fulton and View was zoned "Commercial"
under the 1922 zoning ordinance.
2. The 1975 zoning ordinance attempted to recognize existing uses in
determining zoning districts.
3. Since the block was divided by residential and corronercial uses
existing at the time of the 1975 zoning ordinance, the block was divided
into RM-1 and B-1 zones.
4. The City approved construction of a parking lot for Danneckers in
September 1967 (Zoning File #6577), showing bituminous surfacing on the
east 2'-6" of Lot 11 .
5. There is no basis to interpret the zoning district boundary to include
the east 6 ft. of Lot 11 .
G. STAFF RECOMMENDATION:
Staff's recommendation, based on Findings 2-5 above, is that the zoning
district boundary line in question be interpreted as follows:
That the east 2'-6" of Lot 11 , Block 1 , Rothschilds Addition be
included in the existing B-1 zone on the north side of Randolph
between Fulton and View.
H. OTHER ��J�dSIDERATIONS:
? . The proposed sale of the east 6 ft. of Lot 10 and all of Lot 11 except
±nR easterly 6 ft. (805 Randolph) would be contrary to Section 5' .102(c)(1 )
�hich requires that a lot or parcel "shall not be d��vided or sub�+iv�c�ed
and pa�^t of a lot or parcel shall not be conveyed unless and urt�� a�?
lots or parcels created by division, by subdivision, or by conveyance
�f nart of a lot or parcel shall meet the requirements of Sect�on
&1 .101 to 61 .104, Schedule of Regulations." The applicant's proposed
subdivision of this lot would not meet the requirements of this ;P�±��n
5ecause it would create a lot with less than the minimum requireG
�� ft. frontage. Sale of the east 6 ft. of Lot 10 and all of Lot 1 �.
���cept the east 2' -6" would leave a 40'-7" wide lot and therefore wo¢.�ld
not violate Section 61 .102(c)(1 ).
2. T�e portion of the parking lot covering the easterly 2' -6" of Lot ?�
�s a lega� nonconforming use and can continue as a parking lot as long
as any owner of that piece of land so desires if the Council interprets
the zon�ng distr�ct boundary as falling on the lot line separating Lots
11 and 12.

The Council of the City of St. Paul will hold a public hearing in the
Council Chambers of the City Hall and Court House (third floor) at
10:00 a.m. on August 31, 1978 on the:
REQUEST of Leo Scheu for a Zoning District Boundary Interpretation
affecting property on the north side of Randolph between Fulton
and View and described as Lots 11 and 12, Slock 1, Rothschilds

Gentlemen:
Tne undersigned is hereby respectfully requesting an interpretation
as to the location of the North-South boundary line dividing the RM-1
district from the B-1 district between Randolph Avenue to the North
line running in a Northerly direction to the alley dividing the block
between Fulton Street and View Street.
Your attention is called to the confusion which nas resulted from the
location of this line for the following reasons:
The undersigned is the owner in fee simple of Lot 12, Block 1,
Rothscnild�s Subdivision of Part of Block 3�. of Stinson, Brown and
Ramsey�s Addition to St. Paul� Minnesota. This lot may be found on
the zoning map as being on Ra.ndolph Avenue between Fulton and View
Streets approximately in the middle of the block.
E�ca.mination of the zoning ma.p indicates that the lot is located in
a B-1 use district for business purposes. The lot has been used as
a parking lot for part of the facilities for Danneckers Super Market.
The lot nas been used in this ma.nner for approximately nine years.
Prior to the adoption of the existing zoning law on August 28, 1975,
the lot was previously zoned for use in a commercial use district.
For approxi.mately the same period of time the owner of Lot 11, Block 1,
Rotnscnild�s Subdivision of Part of Block 3Lt, Stinson, Brown and Ramsey�s
Addition to St. t'aul, which adjoins Lot 12 on the Westerly side, ha.s
permitted the undersigned to utilize the easterly 6 feet of said I�ot 11
also as a part of the parking lot facility. During all of said times,
all of the parking lot t'acility was zoned t'or commercial use. The
present owner of Lot 11 also is the owner of the easterly 6 feet of
Lot 10 of Block 1, Rothschild�s Subdivision of Yart of Block 34 of
Stinson, Brown and :�amsey�s Addition to ,St. Yaul and it is contemplated
that the present owner Danneckers Super Market, Inc. of said �,ot 11
would convey to the undersigned said easterly 6 feet of said I,ot 11
in order to retain that portion as part of the paxking lot facility.
It appears that the South Ha1f of the block between Vi�w and Fulton
on Randolph has been divided so that the part lying West of the line
th.at runs through I�ot 11 is now rezoned from commercial to an RM-1
use district. Lot 11 and #,�e ea�°b:�'se��� yot 10 as presently
constituted does not conform with the RM zoning for the reason that
it does not contain 5,000 squa.re feet permitted for a single fami7.y
dwelling nouse and does not conta.in 10,000 square feet permitted
in connection with the RM classification. The line is so drawn as
to be entirely on Lot 11.

The undersigned believes that when this line was drawn, the fact that
the easterly b feet of Lot 11 was used for commercial purposes was
unknown to any of the parties involved in redrafting the zoning laws.
We also believe that a eommon sense construction would place that
line at least 6 feet West of the easterly boundary line of Lot 11
so that the parking lot facility would not be confronted with
ha.ving a 6 foot strip belonging to a different use district.
Because of this uncer�ainty, the undersigned respectfully requests
an interpreta.tion concerning the exa.et location of existing
boundary lines pursuant to Section 60.402 of the zoning code
of St. Paul, such interpretation to esta,blish the boundary line
of said Lot 11. That no other property will be aft'ected by such interpretation.
