TnIHEREAS, the Council having directed that the following
described property owned in fee by the City of Saint Paul be
_ sold by sealed bids pursuant to the procedures set forth in
Section 87A.01(3) of the Saint Paul Legislative Code:
Lots 19, 20, and 21, Block 7, Edmund Rice' s
Second Addition to the City of Saint Paul;
and �
WHEREAS, the bids received by the City pursuant to said
bid adve�tisement were deEmed unsatisfactory by the Purchasing
Agent, and the Valuation� and Assessment Engineer; now, there-
fore, be it
RESOLVED, that the City Council of the City of Saint Paul
does hereby authorize and direct the proper City officials as
provided in Section 87A.01(4) of the Saint Paul Legislative Code,
to enter into private negotiations for the sale by quit claim
deed of said property, in a manner deemed advisable by them;
provided, however, tha� the negotiated purchase price shall not
be less than the highe�t bid received when the property was pre-
viously advertised as heretofore mentia�ed.

Second Addition - The Old Acker Playground
T he purpose of this report is to review tne history of the procedures to
date relative to the sale of the Old Acker Playground by tne City and to
recammend a coLSSe of action.
The site was declared surplus and the public use vacated pursuant to C. F.
269069, approved May 19, 1977, which resolui;ion also directed tha.t the tract
be sold in accordance w i;h Cnapter 87A.01 of the Saint Paul Legislative Code.
The appraised value recommended by the undersigned prior to the sale was
$10,500.00 for the erltire tract.
Bids were called for on July 6, 1977 and two bids were received, one for $300
and the other froqn Mx. Peter Gonzalez in the amount of $9,003.58. Since the
opening of bids, the matter has been apparently in limbo for a number of
reasons such as: The call for bids recited the wrong zoning (RT-2 instead
of RT-1). The matter was also referred to the Department of Planning and
Economic Development for recommendation and possible sa.le for optimum develop-
me nt.
Mr. Gonzalez just recently submitted the entire amount of his bid ho�ping to
obtain the property and in his letter of July 12� 1978, directed to the City
Council requested the Council to awa.rd him the subject property for the
amount of his bid.
I recammend, because of the technical problems associated with the previous
bid, that all bids be deemed unsatisfactory. T further recommend that the
proper City Officials be directed to eni�er into private negotiations for the
sale of the Old Acker Playground Si�e pursuant to Section 87A.01(�+) of the
Saint Paul Legislative Code, provided the negotiated purchase price is not
less than the highest bid received at the previous sale.

I�m hastily writing this letter hoping to get on the agenda oP

the St. Paul City Council to be held neat Tuesday, July 18, 1978. I
have a problem with the city of St. Paul, ead hope thet you may resolve
it. Briefly it goes liKe this :
On July 20, 197?, the city oP S�t. Paul Purchasing Dept. oPfered
to the highest bidder, 3 lots, #19, 20, ead �1, - oP block 7, the
Edmund Rice Addition, f ormerly the old Ac ker Playground. I sub-
mitted a total bid of �9,003.56 - and only one other bidder sub-
mitted his bid, which was ��00.00. I wes sent a tabulation, dated
July 21, 1977, indicating I was the highest bidder. (copy enclosed)
I heard nothing more Prom the Purchasing Dept., although I placed
5 separate calls in the neat 12 months. Finally, during the first
pert oP P+Iey 1978, contact was made and I was told that the
"lots Transaction" was somewhere in limbo, and had been during the
whole year, because sales of lots, etc . , were to be discontinued
thru the Purchasing Dept. I requested Purther investigstion so I
could find out where I stood. A Pew days later, Mr. Keith Smith, of
the Purchasing Dept., called my wife and indicated that our bid was
accepted. A letter dated May 23, 1978 f ollawed, (enclosed) indicating
ecceptance of the bid and the payment schedule. I quickly secured
two loans, from separate banks, and a third loaa from my son, to
secure payment for these lots. On Monday July 10, 1978, a�out

.,onths later, I called Keith Smith hoping to eapedite the deed and
abstract. That is when I Iearned that Mr. Walter A. Bowser, Asst. City
Attorney, rePused to accept the treasaction. A letter Prom Mr. Bowser
followed indicating that indeed he hed refused my bid. (copy enclosed )
I called Mr. Bowser end he indicated that the bid I placed was
less than the apprsised minimum bid set by the city. This was the
Pirst time in this whole transaction "minimums" were mentioned. I
mentioned to Mr. Bowser that I had to secure a loan to purchase this
property, and that all moves on my part were based upon calls and
letters sent by responsible employees working Por the city. He seemed
less than interested and indicated the lots belonged to the city and
he was going to put them up for bid a�ain. I was Plabbergasted, I
could see �700 or �800 in interest Por nothing, flyin� away.
Later I called the Purchasing Dept. apd tne party a Mr. Peter, •
said that they knew the bid was less than the appraised miaimum,
and that the Department recommend acceptance of the bid, to get this
property on the tea rolls. All in all, the transaction has been
- handled less then eapeditiously and certainly has tested my patience.

fair and equitable settlemeat.
