1 WI3EREAS, Sami Ibrahim dfbfa Sami Food Market holds a grocery license for the

4 WHEREAS, the Office of LIEP was notified by the United States Department of
5 Agriculture on August 17, 2001 that the Sami Food Market had been permanentiy disqualified
6 from participating in the Food Stamp Program because it violated program regulations by
7 exchanging food stamp benefits for cash; and
9 WHEREAS, a Notice of Violation was sent to the licensee on October 8, 2001 advising
10 him that adverse action was going to be taken against his grocery license based upon this
11 disqualification pursuant to Saint Paul Legislative Code §310.06(b)(6)a., and advised licensee of
12 his right to contest the adverse action and of its recommendation of a fine of $500.00; and

14 WHEREAS, no response was received from the licensee requesting a hearing on either
15 the allegations or the penalty; now, therefore, be it

17 RE50LVED, that a fine of $500.00 is imposed upon the grocery license held by Sami
18 Ibrahim d/b/a Sami Food Market for the premises located at 65 West George Street in Saint Paul
19 (License ID #: 7&035), said fine to be paid to the Office of LIEP within thirty days from its

Dear Mr. Ibrahim:
The Office of License, Inspections and Environmental Protection (LIEP) has
recommended adverse action against the Z'irocery (C) license held by you, d/b/a Sami Food
Market, for the premises located at 85 �Vest George Street in Saint Paul. The basis for the
recommendation is as follows: -
On August 17, 2001, the Office of LIEP was notified by the
United States Department of Agriculture that you har�e been
disquaii�ed permanently from the Food Stamp Program
because you exchanged food stamp benefits for cash in
violation of the program regulations. Saint Paul Legislative
Code §310.06(b)(6)a. permits adverse action against a license
where "the licensee ... has violated, or performed any act which
is a violation of, any of the provisions of these chapters or of
_ any statute, ordinance or regutation reasonably related to the
licensed activity, regardless of whether criminal charges have
or have not been brought in connection therewith."
If you do not dispute the above facts, but wish to have a public hearing before the SainY
Paul City Council, you �vill need to send me a letter �vith a statement admitting the violation and
requestin� a hearin� by Thursday, October 18, 2001. The matter �vill then be scheduled before
the City Council for a ptiblic hearin� to determine what penalty, if any, to impose. You will have
an opportunity to appear before the Council and make a statement on your o�vn behalF as to the
penalty to be imposed. The recommendation from the licensing office ��ill be for a 5�00.00 fine.

If you do dispute the above facts, a hearing �vill be scheduled before an Administrative
La�v 7ud�e. At that hearing both you and the City will be able to appear and present «�itnesses,
evidence, and cross-examine the other's �vitnesses. The St. Paul City Council �vill ultimately
decide the case. Please let me kno�v in writing no later than Thursday, Qctober 18, 2001, how
you wish to proceed.
If you have not contacted me by Thursday, October 18, 2001, I�vill assume that you
are not contesting the facts and �vill scbedule this matter for the St. Paui City Council and
have it placed on the Consent Agenda during which no public discussion is allo�ved and the
recommended penalty wili be imposed.

under civil or criminal statutes.
