WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides Por the granting of variances from
the sound level limitations contained in �293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
cnnstitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, Scanlon Pub, Inc., represented by Tom Scanlon,
President, who has been designated as the responsible person on
the application, has applied for a variance to allow live music
at 2162 University Avenue, on March 16 and 17, 2001; and
WHEREAS, applicant is seeking a variance for the hours of
6:00 p.m. to midnight on March 16, 2001, from 12:00 noon until
midnight on March 17, 2001; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the live music; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to Scanlon Pub, Inc., subject to the following
conditions:
1) The variance shall be for the hours of 6:00
p.m. to midnight on March 16, 2001 and from
12:00 noon to midnight on March 17, 2001.

2) All electronically powered equipment used in
conjunction with the event shall not exceed
95 dBA as measured from the wall located
opposite from the stage.

3) The applicant shall provide personnel and
equipment who shall provide continuous sound
level monitoring between 6:00 p.m. and
midnight on March 16, 2001, and between 12:00
noon and midnight on March 17, 2001 to ensure
compliance with Condition #2.
4) All electronically powered equipment, PA
systems, loudspeakers or similar devices
shall be turned off no later than midnight on
March 16 and 17, 2001.

/ FURTHER RESOLVED, that any violation of the conditions set
forth above on March 16, 2001 may result in revocation of the
grant of a variance for March 17, 2001, in addition to any
criminal citation which might issue.

informed a week in advance of ihe focum that the Community Council was providing and no
commenu were received in the office written or othervvise as to any concems regarding the St.
1'atrick's Day party in the yeaz 2001. On Januazy 30, 7A01 the Execufive Co[nmittee

1 am wriring this leuer to inform you of my objeaiocn to the Dubtiner Pub's request for a sovnd level variance for
�ive music during their St. Panick's Day parry. ! am the owner ofthe Midwest Hotel located next door to the
Aubliner pub. Last year nn St. Pafrick's Day the Dubl"mer did not receive a sound level variance but stiit proceeded
to play music on Thursday, Friday and Saturclay ni,,shts. Aue to the extreme noise disiurbances our hotel was
evacuaxdby a numbcr of oin gues[s, ln addi[ion to constan[ complaints from my guests, our parking lot was
destroyed wiffi fi3th, garbage, beer bottles, vomit, and urination on the cars in the parking {ot All of my guests were
extremeiy upset that their cars were winated on, scratched, and thai they could not sleep all ni�t. The morning after
the first nighz of St Patrick's day, l phoned the state and called environmenta] coutrol fo have a represmtative come
m check on the sound Isvel of the patty that n�qht. A representarive showed up that evenin� and confinned that the
noise level was too loud. He infortned the Dubliner Pub owner and the noise level was quelled, yet as soon as the
representarive lefr, the noise went back to its original volwne. Io addition, the Dubiiner only hired one potice offioer
to stand guard for the three ni�ts of parrying to quelt a crowd of hurtdreds of peopla. T6is paz[y was wo isrge for a
small pub, and guesu kept filtering out and loitering in [he parking lot and our properry. After rhe several days of lost
business, unhappy customers that may ruver re[urn to our hotel, f deaned the en[ire parking lot myself after the
vandatism and filth that occurred the past few nights.l avn wrizing [his lener as a plea ro you that this does not occw
again. l can no[ afford m loose three n'Uahn wor�h of business, nor clean the parlcing lot evety si�le momin„ nor
reimburse my guests for damages to their vehictes. I am requesting that the Dubliner pub not be granted their sound
level variance for live music outdoors, it is an inconvenience to me and my guests.

1 am wriring this leuer to inform you of my objeaiocn to the Dubtiner Pub's request for a sovnd level variance for
�ive music during their St. Panick's Day parry. ! am the owner ofthe Midwest Hotel located next door to the
Aubliner pub. Last year nn St. Pafrick's Day the Dubl"mer did not receive a sound level variance but stiit proceeded
to play music on Thursday, Friday and Saturclay ni,,shts. Aue to the extreme noise disiurbances our hotel was
evacuaxdby a numbcr of oin gues[s, ln addi[ion to constan[ complaints from my guests, our parking lot was
destroyed wiffi fi3th, garbage, beer bottles, vomit, and urination on the cars in the parking {ot All of my guests were
extremeiy upset that their cars were winated on, scratched, and thai they could not sleep all ni�t. The morning after
the first nighz of St Patrick's day, l phoned the state and called environmenta] coutrol fo have a represmtative come
m check on the sound Isvel of the patty that n�qht. A representarive showed up that evenin� and confinned that the
noise level was too loud. He infortned the Dubliner Pub owner and the noise level was quelled, yet as soon as the
representarive lefr, the noise went back to its original volwne. Io addition, the Dubiiner only hired one potice offioer
to stand guard for the three ni�ts of parrying to quelt a crowd of hurtdreds of peopla. T6is paz[y was wo isrge for a
small pub, and guesu kept filtering out and loitering in [he parking lot and our properry. After rhe several days of lost
business, unhappy customers that may ruver re[urn to our hotel, f deaned the en[ire parking lot myself after the
vandatism and filth that occurred the past few nights.l avn wrizing [his lener as a plea ro you that this does not occw
again. l can no[ afford m loose three n'Uahn wor�h of business, nor clean the parlcing lot evety si�le momin„ nor
reimburse my guests for damages to their vehictes. I am requesting that the Dubliner pub not be granted their sound
level variance for live music outdoors, it is an inconvenience to me and my guests.

WHEREAS, Scanlon Pub, Inc., represented by Tom Scanlon,
President, who has been designated as the responsible person on
the application, has applied for a variance to allow live music
at 2162 University Avenue, on March 16 and 17, 2001; and
WHEREAS, applicant is seeking a variance for the hours of
6:00 p.m. to midnight on March 16, 2001, from 12:00 noon unCil
midnight on March 17, 2001; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the live music; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to Scanlon Pub, Inc., subject to the following
conditions:
1) The variance shall be for the hours of 6:00
p.m. to midnight on March 16, 2001 and from
12:00 noon to midnight on March 17, 2001.
2) All electronically powered equipment used in
conjunction with the event shall not exceed
95 dBA as measured from the wall located
opposite from the stage.

level monitoring between 6:00 p.m. and
midnight on March 16, 2001, and between 12:00

systems, loudspeakers or similar devices
shall be turned off no later than midnight on
March 16 and 17, 2001.
/ FURTHER RESOLVED, that any violation of the conditions set
forth above on March 16, 2001 may result in revocation of the
grant of a variance for March 17, 2001, in addition to any
criminal citation which might issue.

Attached is a sound level variance application from Tom Scanlon, President of Scanlon
Pub, Inc. (Dubliner Pub), 2162 University Avenue W. to allow live music during their St.
Patrick's Day pariy, including drum sets and other musical instruments, in an outside tent
on the Dubliner Pub parking lot. A variance is requested from 8:00 a.m. to 1:00 a.m. on
March 16 and 17, 2001.
Also attached is a copy of the Public Hearing Notice sent to property owners within 200
feet of the area bounded by 2162 University Avenue W..

2001 to give a short gresentation of lris plans for the Irish CelebraGoa The Midwest �iotel was
informed a week in advance of ihe focum that the Community Council was providing and no
commenu were received in the office written or othervvise as to any concems regarding the St.
1'atrick's Day party in the yeaz 2001. On Januazy 30, 7A01 the Execufive Co[nmittee

1 am wriring this leuer to inform you of my objeaiocn to the Dubtiner Pub's request for a sovnd level variance for
�ive music during their St. Panick's Day parry. ! am the owner ofthe Midwest Hotel located next door to the
Aubliner pub. Last year nn St. Pafrick's Day the Dubl"mer did not receive a sound level variance but stiit proceeded
to play music on Thursday, Friday and Saturclay ni,,shts. Aue to the extreme noise disiurbances our hotel was
evacuaxdby a numbcr of oin gues[s, ln addi[ion to constan[ complaints from my guests, our parking lot was
destroyed wiffi fi3th, garbage, beer bottles, vomit, and urination on the cars in the parking {ot All of my guests were
extremeiy upset that their cars were winated on, scratched, and thai they could not sleep all ni�t. The morning after
the first nighz of St Patrick's day, l phoned the state and called environmenta] coutrol fo have a represmtative come
m check on the sound Isvel of the patty that n�qht. A representarive showed up that evenin� and confinned that the
noise level was too loud. He infortned the Dubliner Pub owner and the noise level was quelled, yet as soon as the
representarive lefr, the noise went back to its original volwne. Io addition, the Dubiiner only hired one potice offioer
to stand guard for the three ni�ts of parrying to quelt a crowd of hurtdreds of peopla. T6is paz[y was wo isrge for a
small pub, and guesu kept filtering out and loitering in [he parking lot and our properry. After rhe several days of lost
business, unhappy customers that may ruver re[urn to our hotel, f deaned the en[ire parking lot myself after the
vandatism and filth that occurred the past few nights.l avn wrizing [his lener as a plea ro you that this does not occw
again. l can no[ afford m loose three n'Uahn wor�h of business, nor clean the parlcing lot evety si�le momin„ nor
reimburse my guests for damages to their vehictes. I am requesting that the Dubliner pub not be granted their sound
level variance for live music outdoors, it is an inconvenience to me and my guests.

WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and

WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, Scanlon Pub, Inc., represented by Tom Scanlon,
President, who has been designated as the responsible person on
the application, has applied for a variance to allow live music
at 2162 University Avenue, on March 16 and 17, 2001; and
WHEREAS, applicant is seeking a variance for the hours of
6:00 p.m. to midnight on March 16, 2001, from 12:00 noon unCil
midnight on March 17, 2001; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the live music; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to Scanlon Pub, Inc., subject to the following
conditions:
1) The variance shall be for the hours of 6:00
p.m. to midnight on March 16, 2001 and from
12:00 noon to midnight on March 17, 2001.
2) All electronically powered equipment used in
conjunction with the event shall not exceed
95 dBA as measured from the wall located
opposite from the stage.

3) The applicant shall provide personnel and
equipment who shall provide continuous sound
level monitoring between 6:00 p.m. and
midnight on March 16, 2001, and between 12:00
noon and midnight on March 17, 2001 to ensure
compliance with Condition #2.
4) All electronically powered equipment, PA
systems, loudspeakers or similar devices
shall be turned off no later than midnight on
March 16 and 17, 2001.
/ FURTHER RESOLVED, that any violation of the conditions set
forth above on March 16, 2001 may result in revocation of the
grant of a variance for March 17, 2001, in addition to any
criminal citation which might issue.
