01-1239ORIGI�IAL CITY OF Presented By Referred To Committee: Date 2 RESOLUTION AUTHORIZING RAMSEY COUNTY TO UNDERTAKE A MULTI-FAMILY 3 RENTAL HOUSING DEVELOPMENT IN THE CITY OF SAlNT PAUL, 4 5 (EMERAI,D PARK PROJECT) 6 7 WHEREAS, 9 (a) Minnesota Statutes, Chapter 462C (the "Act") 10 authorizes cities, or housing and redevelopment authorities or port 11 authorities authorized by ordinance to exercise on behalf of a city 12 the powers conferred by the Act, or a county housing and 13 redevelopment authority created by special law or authorized by its 14 county to exercise its powers pursuant to Minnesota Statutes, 15 Section 469.004, the power to issue revenue bonds to finance a 16 program for the purpose of planning, administering, making or 17 purchasing loans with respect to one or more multi-family housing 18 developments within its boundaries of the city; 19 20 (b) The Housing and Redevelopment Authority of the 21 City of Saint Paul, Minnesota (the "St. Paul HRA") has been 22 designated, by ordinance, to exercise, on behalf of the City of Saint 23 Paul, Minnesota (the "City") the powers confened by Minnesota 24 Statutes, Section 462C.01 to 462C.08; 25 26 27 28 29 30 31 32 33 34 35 36 37 Council File # � � , a ` RESOLUTION PAUL, MINNESOTA �a (c) The Ramsey County Housing & Redevelopment Authority (the "County HRA") has scheduled for consideration on December 11, 2001, a resolution authorizing an application to the Minnesota Depariment of Finance for an allocation of volume lunit to issue private activity bonds "bonding authority"; (d) The City and the County HRA have received from Saint Paul Leased Housing Associates I, LP (the "Developer") a proposal that the City and County HRA undertake a program to finance the Project hereinafter described, through the issuance of revenue bonds or other obligations (which may be issued in one or more series) (the "Bonds") pursuant to the Act; Green Sheet # u t a`� K:SFIARED�PED\Nordquis\cowry res 1 2 (e) The City and County HRA desire to: facilitate the 3 development of rental housing within the community; encourage 4 the development of afFordable housing oppomwities for residents 5 of the City and the County; encourage the development of housing 6 facilities designed for occupancy by persons of low or moderate 7 income; and prevent the emergence of blighted or underutilized 8 land and shuctures within the boundaries of the City and the 9 County; and the Project will assist the City and County I312A in 10 achieving these objectives; 11 12 (fl The proposal is for the St. Paul IIRA and the 13 Ramsey County HRA to jointly issue bonds for the Project, 14 utilizing seventeen million dollars ($17,000,000) of the City 15 entitlement bonding authority and seven million dollazs 16 ($7,000,000) of bonding authority provided by Ramsey County 17 IIRA from the housing pool established pursuant to Minnesota 18 Statutes, Chapter 474A; 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 (g) The Developer is currently engaged in the business of real estate development. The project to be financed by the Bonds wili consist of the acquisition, renovation and equipping of a residential rental project for low and moderate income tenants located at the northwest corner of Franklin Avenue and Curfew Street, in Saint Paul (the "Project"). (h) The City and the County HRA haue been advised by representatives of the Developer that conventional, commercial financing to pay the capital costs of the Project is available only on a limited basis and at such high costs of bonowing that the economic feasibility or operating the Project would be significantly reduced, but the Developer has also advised the City and the County that with the aid of municipal financing, and resulting low borrowing costs, the Project is economically more feasible; and 37 (i) No public official of the City or the County has 38 either a direct ar indirect financial interest in the Project nor will 39 any public official either directly or indirectly benefit financially 40 from the Project: 41 42 43 44 45 46 47 48 49 NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Saint Paul, Minnesota, that pursuant to Minn. Stat., Section 469.004, subd. 1 a, the City hereby authorizes Ramsey County, acting through the Ramsey County HRA, to undertake the Project and financing therefor, jointly with the St. Paul HRA, subject to the following limitations: o �-�a�� a. this authorization relates only to the Project and the O , ��,� 3 financing program for the Project; and b. nothiug in this resolution or in the fmancing program, or in any agreement, indenture, contract ar inshument relating to the Project or the Bonds shall authorize or pernut the Ramsey County HRA to levy a tax on any tasable property within the city lunits of the City of Saint Paul, and c. nothing in this resolution obligates the City to give its approval to the Project and the program of financing therefor, and d. nothing in this resolution authorizes the expenditure of any City funds on the Project.
