THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the Zoning Map of Saint Paul, Sheet No. 15, as incorporated
by reference in Section 60.401 of the Saint Paul Legislative Code,
is hereby amended as follows:
The property on the South side of East Sev�nth
Street between Birmingham and Barclay Streets, more
particularly described as follows:
Lots 3 through 7, Block l, Defranchy' s Division; __
is rezoned from RM-2 to B-l.
Section 2.
This ordinance shall take force and effect in tYiirty (30) days

A. Sufficiency: � The appellant's request for rezoning was filed on a short form
Rezoning Petition, subscribed and sworn to before a Notary Public on April 9,
1976, and received by the City Planning Office on April 20, 1976.
B. Proposed Use: The appellant proposes to construct and operate a 7-11 Store and
gas station complex.
C. Frontage and Area: The proposed site has a 200 foot frontage along East Seventt�
Street, is 120 feet in depth, and is approximately 24,000 square feet in area.
D. Site Conditions: The subject site is currently vacant of any structures or
dwelling units. It is bounded by East Seventh Street to the north, an alley to
the south, a single family dwelling unit to the west, and a vacant lot (adjacent)
to the east. The site is grass covered, even with the street level along East
Seventh Street with a gradual slope to the alley line to the south.
E. Area Conditions: The area is developed primarily with multi-family dwelling units
of the post-war construction period. There are a few single family homes in the
area. Ir_ the immediate area, there are two 69 unit structures, a 51 unit structure,
a 36 unit structure, two 17 unit structures, and an 11 unit structure. There are
also a vast number of vacant lots in the immediate area.
F. Findings: The area in question is currently zoned RM-2 residential, and there are
in excess of 150 vacant lots in the immediate area.
The best potential redevelopment plan should be based upon the residential character
of the area as it already exists.
If commercial development is introduced into an area consisting of so many future
building sites a chain reaction of commercial development could convert the area
from primarily .residential to primarily commercial.
Spot zoning for commercial purposes of said site would mosC likely not be the
most beneficial reuse.

rezoning of said site would indeed violate the primary intent and purpose of �
the Zoning Ordinance, Section 60.200, which is to classify all property in
such manner as to reflect its peculiar suitability for particular uses; to
regulate the location, construction, reconstruction, alteration, and use of
buildings, structures, and land; to conserye property values, to protect all ,
areas of the City from harmful encroachment by incompatible uses, the redevel- �

A. SUFFICIEWCY: The petitioner's request was filed on two short form rezoning �
petition, subscribed and sworn to before a notary public on April 9, 1976 �
and received by City Planning on April 20, 1976.
6. HISTORY: This case was first heard before the Current Planning and Zoning ,
o�mm tee on May 20, 1976. At that time the Committee voted unanimously to '
recommend denial of the rezoning. That recomnendation was supported by the
full Planning Commission at its next meeting. The case then came before
City Council at which time it was laid over six months so that a plan might
be prepared for the area. The plan was not completed before the rescheduled
hearing date and the case was again laid over, this time to August 11 , 1977.
The District 2 Preliminary Plan was completed July 1 , 1977.
C. FRONTAGE AND AREA: The site consists of five 41 ' x 114' lots fronting on
ast Sevent Street. The total frontage is 205 feet; the area is 23,370 square
feet. -
D. PROPOSED USE: A 7-Eleven Store and filling station is proposed for the
eastern ha f of the property. There have been no specific proposals for the
use of the remaining 100' x 114' , though a dental office has been suggested
as one possibility.
E. SITE CONDITIONS: The site is currently vacant, and until several years ago,
was use for and fill . It has since been graded, covered and planted with
grass.
F. AREA CONDITIONS: East Seventh Street, to the east of Johnson Parkway, is
a pre ominantly residential street. The area in the immediate vicinity of this
site is a mixture of newer apartment buildings, older homes, and vacant land

G. FINDINGS:

G. FINDINGS:
2. The District 2 Preliminary Plan indicates that residents are satisfied
with the predominantly residential character of their neighborhoods
and puts a strong emphasis on the need for the compatible development
of vacant parcels.
• 3. The intent of the B-2 zone is to "serve the needs of a consumer .
population larger than that served by the 'Local Business Bistrict' ,
and is generally characterized by a cluster of establishments generating
large volumes of vehicular and pedestrian traffic." (60.491)
Residents present at a meeting concerning the rezoning were generally
favorable to the idea of a convenience store in the neighborhood but �
indicated concern over sane of the other uses permitted in the B-2 zone--
bars, clubs, gas stations and game rooms. They also expressed a
concern that commercial development now may make the area less
desirable for residential develop�nt in the future. The meeting was
conducted by the Zoning Committee of the Greater East Side Comnwnity
Council on Tuesday, September 20, 1977.
4. The Executive Board of the Greater East Side Community Council has,
in the past, taken a position opposing this rezoning. The Zoning
Comrnittee voted to reaffirm the Board's osition after conducting
a public meeting on the subject (9/20/77�.
H. STAFF RECOMMENDATION: Based on the above findings, staff recommends that
t e petit�oner s request for B-2 zoning be denied. Council may want to
consider rezoning to a B-1 classification, which would provide� for retail and
service "�eeds of the loca] population and yet be more compatible with the
existing residential use.

On April 15, 1976, the City Council referred to the Planning Commission
for recommendation one short form rezoning petition by John J. Kavanagh.

The Current Planning and Zoning Committee heard this petition on May 20,
1976. A recommendation for denial of this rezoning carried unanimously

A meeting of the Planning Corrrnission of the City of Saint Paul was held
May 28, 1976, at 9:00 a.m. in the Metropolitan Council Conference Room
at 300 Metro Square Building, St. Paul , Minnesota.
Present: MMes. Cochrane, Mayne, and Norton; Messrs. Brown, Bryan,
Feder, Hanggi , Humner, McDonell , Pangal , Rupp, Sherwood, �
Stegemoeller, Van Hoef, Wilkening, and Willits.
Absent: Mnes. Piccolo, Showalter, and Slawik; Messrs. Prifrel
and Tobler.
Also Present: Kris Narley, ConUnunity Services; K. Ford, J. Shelton, M.

The Planning Co�runission took the following action at the May 28, 1976, meeting:
APPROVED the Minutes of the May 14, 1976, Planning Comnission meeting by
voice vote.
APPROVEp a petition by Northwestern Bell Telephone Company to rezone
property on the North side of Shields Street between Fairview and Beacon.
Mr. Rupp made a motion to approve the recommendation of the Current Planning
Coinnittee. Mr. Hanggi seconded the motion and it passed unanimously.
APPROUED a petition by John J. Kavanagh to rezone property on the South side
of East Seventh Str•eet between Birmingham and Barclay. Mr. Rupp made a
motion to approve the Comnittee reconmendation for denial . Mr. Hummer
seconded the motion arid it passed unanimously.
APPROUED a petition by Robert and Juliana Janssen to rezone pr•operty on the
Southeast corner of Dale and Cook. Mr. Rupp made a motion to approve the

BY RESOLUTION, endorsed the Downtown People Mover (DPM) proposal . Motyon
, made by Ms: Norton, seconded by Mr. Rupp, and passed unanimously.
BY RESOLUTION, approved the Comprehensive Policy for Ponding of Storm Water.
Mr. Humner requested an amendment to the Resolution which was presented to
the Commisslon, by adding, "This Comnission also rec a�mends that speedy
identification and acquisition of vacant ponding areas be undertaken. °°

Closure Processes for ldentified Treatment Areas. Motion made by Mr. Hanggi ,
seconded by Mr. Rupp, and passed unanimously by a rollcall vote.
Informal presentation regarding the 1976 legislation affecting the Capitol
Area of St. Paul was made by Gary Grefenb�rg. Executive Secretary, Capitol
Area Architectural and Planning Board.
Mr. Wilkening made a motion that the Commission participate in the review
process of St. Paul 's Comnunity Health Services Plan by scheduling for
committee meeting and a public hearing. The motion was seconded by
Mrs. Mayne and carried unanimously.

A. SUFFICIENCY: The petitioner's request was filed on two short form rezoning
petition, subscribed and sworn to before a notary public on April 9, 1976
and received by City Planning on April 20, 1976.
B. HISTORY: This case was first heard before the Current Planning and Zoning
om�m ttee on May 20, 1976. At that time the Comnittee voted unanimously to
recommend denial of the rezoning. That recomnendation was supported by the
full Planning Commission at its next meeting. The case then came before

Street, is 120 feet in depth, and is approximately 24,000 square feet in area.
D. Site Conditions: The subject site is currently vacant of any structures or
dwelling units. It is bounded by East Seventh Street to the north, an alley to
the south, a single family dwelling unit to the west, and a vacant lot (adjacent)
to the east. The site is grass covered, even with the street level along East
Seventh Street with a gradual slope to the alley line to the south.
E. Area Conditions: The area is developed primarily with multi-family dwelling units
of the post-war construction period. There are a few single family homes in the
area. In the immediate area, there are two 69 unit structures, a 51 unit structure,
a 36 unit structure, two 17 unit structures, and an 11 unit structure. There are
also a vast number of vacant lots in the immediate area.
F. Findings: The area in question is currently zoned RM-2 residential, and there are
in excess of 150 vacant lots in the iirnnediate area.
The best potential redevelopment plan should be based upon the reaidential char�cter
of the area as it already exists.
If commercial development is introduced into an area consisting of so many future
building sites a chain reaction of commercial development could convert the area
from primarily residential to primarily commercial.
Spot zoning for commercial purposes of said site would most likely not be the
most beneficial reuse.

G. Staff Recommends that the appellant's request for rezoning be denied. Spot
rezoning of said site would indeed violate the primary intent and purpose ot �
the Zoning Ordinance, Section 60.200, which is to classify all property in
such manner as to reflect its peculiar suitability for particular uses; to
regulate the location, construction, reconstruction, alteration, and use of
buildings, structures, and land; to conserve property values, to protect all
areas of the City from harmful encroachment by incompatible uses, the redevel-
opment of the area should be consistent with the present zoning classification,

We, the undersigned petitioners, understand that there will
be a meeting on July 22 ta-�onsider changing the zone from residental
to commercial for the property directly across from Eastview Manor,
1467 E. 7th Street, St. Paul, Minnesota 55106 in order that a contemplated
7-11 Store be built.
We wish to make it known that we feel such a store would
be of great help to everyone in our building, as well as the tenants
in the other five apartment buildings in the immediate vicinity. Many
of these people are mature individuals, some of them do not have cars.
The bus stops at that point and it would be very convenient to be able
to shop so close to home, even for those who do have transportation, as
many of us could go directly to the store as we come home from work.
Therefore, we respectfully request you consider making the

Honor�ble Mayor and City Council Members:
Rezoning that vacant lot at 1'�60 Ea,st 7th Street, for the purpose of building a
7-Eleven Store, is in my opinion a godsend. For people who do not drive(such as myself),
the closest store is the Tom Thumb Superette about 4 or � blocks away (up and down hills
in the winter time� whether young or c,l.d, it's a long and slippery walk). From My
apartment buildin� at 1439 East 7th St. to Phalen Center and Red Owl, the next closest 5t�ore,
is a long walk even in the best of weather. Johnson Park«ay, after a point, ceases to be
paved, and walking that stretch in the winter or early spring is not to be believed.
Try toting a ba; of groceries while watching your f ooting, while watching the mud.. .. .... .
There are man;r elderly people in my buildin�; alone. In fact, I am one of four
persons under the a�e of 30 in this 17 unit bui:lding. Fortunately, many of these people
including m_,� rr,other and myself, have either fariily or friends who take us shopping
for the major items we need, but you do run out of bread and mi.lk and many other
incid entals, ,�,'ust what a 7-Eleven could provide.
I've heard. people say this store would draw kids and cause it to become a hang-out,
that there would be all sorts of noises; cars, motorcycles, etc. Well, believe me,
it couldn't be much noisier around here. If the management at once puts his foot
down and states that his store WZLL NOT be the local han� out, all problems of that
nature will solved before the,y �et a chance to take root.
I've talked. to many people around here and we believe that it would be a beneficial
addition to our neighberhood. Tho good points outweigh the bad.
Let's see a 7-Eleven Store at 1460 East 7th St.

East Seventh Street
Dear Mr.. Kavanaugh:
We have reviewed your soil test boring report of
• November ll, 1977 done by "Geotechnical Engineering
Corporation" on the above property.
This re:port indicates that this property has areas of
24 feet depth of rubble fill, of all variety of materials.
Due to the nature of these materials, it appears
impractical to drive timber piles which in some cases can
be justified for single family dwellings. It is also
econom:ically impractical to excavate and replace these
� ' materials with an engineered fill for small structures
such as single or double family dwellings.
Based on the above, it is our opinion that this site is _
not suitable for residential construction.

valuable addition to the neighborhood and recommend the granting of
