WHEREAS, the 3aint Paul City Council did adopt a Floodplain Zoning Ordinance
for the City of Saint Paul in December of 1976 with the knowledge that Amend-
ment of the Floodplain Zoaing boundaries might be rsquired to confarm to
State of Minaesota Department of N�tural Resourcea Regulations; and, ,

WHEREAS, the Department of Planning and Ec�nomic Development has subjected
the Floodplain Zoning Ordinance to further study in conjunction with the
Minnesota Department of Natural Resources aad determined a Floodplain alinement
acceptable to that body; and,
WHEREAS, the alterations to the Zoning Ordinaace to reflect the agreed to
floodway aliAement cover a land area aubstantially ia excess of 40 acres; aad,
WHEREA3, it can be reasonably determined that the obtaining of express written
cons�nts to alter this zoning consiatent �iith the Minnesota 3tatutes 462.357
Sub-division 5 would be burdensome and/or excessive; and,
WHEREAS, it can be determined that the proposed new zoning boundariea for the
floodway and flood fringe diatrict are consiatent with the current and/or
future land use plaas for the Mississippi River Corridor:
` , NOiW THEREFOR BE IT RESOLVED, that the City Council hereby initiates a 40
Acre Study for the purposes of amendiag the Floodplain Zoning Ordinance, also
known as City Ordinance �16127, Council File #k268425, by incorporating therein
aa a part of the Ordinance, the revised Floodplain Zoning Maps and the
tabulation of Floodway encroachment limits as parts of that Ordinance. The
Council, as part of this resolution, directs the Departmeat of Plaaning and
Economic Development to prepare the necessary documentation for the 40 Acre
Study, schedule a date of public hearing, submit the final revisions to the
State of Minnesota Department of Natural Resources for approval aad otherwise
assiat the Council as rnay be necessary through the process of adoption of this
Ordinance Amendment.
