THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section l. The Saint Paul Legislative Code is hereby amended by adding thereto a new chapter to read as follows: License Applications .O1 No person, partnership, firm or corporation ma.y apply for any license under the Saint Paul Legislative Code wit�h�n one year of the denial or revocation of the same or similar license by the City Council if such deni�l or revocation was based solely or partially upon misconduct or unfitness of the applicant, ev�.- dence a� vialatiQ�.s of law invalving licensed premises, evidence that the- applicant h.ad been invol�� in the operation of a nuisance, or fraud or deception in the license application. Denial of a license, as used herein, shall include a refusal of permission to transfer a license to the applicant. The term "interest" includes any pecuniary interest in the ownership, operation, management, or profits Qf an establishment, but does not include: bona fide loansf bona fide rental agre�ments� bona fide open accounts or other obligations held with or without security arising out of the ordinaxy and regular course of business of selling or leasing merchan- _ .dis�, fi�rtures or supplies to such establishmenty an inter�at' in a corgt�catf.�n�vWrring or operating a hotel but having at least 150 or more rental units holding a license ia con�unetion therewithf or 10 percent ar less interest in any other corporation holding a license. .03 The License CQ�runittee of the City Council may, at its discretion, conduct a hearing regaxding rev�- cation or denial of a l�.cense n4twithstanding that the applicant or licensee has attempted or pur- ported to withdraw or surrender said license or application if the attempted withdravval or surrender took place after the applicant or licensee had b�en notified of the revocation or denial hearing by the License Inspector. If the Lic�nse Committee chooses to conduct such a hearing, the C4uncil of the City of Saint Paul shall act upon the recommendation of the License Committee as if there had not been an attempted surrender or withdrav�al. Section 2. This ordinance shall be deemed a part of the Saint Paul Legislative Code and shall be incorporated therein and giv�n an appropriate chapter number at the time of the next revision of said Legislative Code. section 3,. This ordinance shall take effect and be in force thirty (30) days from and a�ter its pas�age, approval and publication.
