On June 28,1999, the plainriff, Joseph Palermo, Jr., was shot in the abdomen by Officer Robert Edwards following a foot chase initiated to apprehend the plaintiff, whom police had reason to believe was armed. Paleimo subsequenfly brought suit for the injury he suffered, as well as lost wages, damages for the impaument of lus future eazving capacity, and pain and suffering. During the discovery phase of the lirigarion, St. Paul police officer Robert Edwards testified that he made a split-second decision manner. In contrast, the plaintiff testified that when he came upon the officer, he was shot after he had stopped and raised his arms to sLUrender. There was no dispute that the plain6ff was unarmed �t the time he was shot. There was no dispute that the plainriff incurred approximately $15,000.00 in medical expenses as a result of the incident.
