Baber ' -9- 12/I2/78 - 1�Ieeting No. 146 � PROCEEDINGS : � Steve Roy related that this case was similar to one previously discussed, in tnat i�1r. Baber had bought the boarded-up building with the intention of making repairs and bringing it up to code . When he applied for a building permit , he �vas refused because there were past due registration fees of $�75 on the property . Mr. Baber felt he should not have ta pay these ber.ause they had been incurred by the previous owner, Dan Parker . rir. Baber told the Board he had taken all reasonable precautions prior to purchase to ascertain any liabilities against the property. He felt it was unfair to exnect him to pay the registration fees due , since it was a debt incurred by the previous owner and was not recorded in a way that would be obvious when the title search was made . Mr. Roy agreed that some buyers �aere hurt by the city' s policy of denying a permit until all registration fees were paid, regardless of who o�aned the property when the fees were incurred. However, he said the policy was useful in catching up with those owners who, through devious methods , tried to circumvent the ordinance and avoid paying the fees . , BOARD ACTION: , Mr. Glassman moved to grant a waiver of past-due registration fees , so that a building permit could be issued to allow the appellant to begin rehabilitation . If a permit is not taken out and work begun by January I5, 1979, the appellant must begin payin g vacant buildin g registration fees. Mr. Heider secon ded. MOTION .CARRIED AND SO ORDERED. THE VOTE: Ayes - 6 ?Vayes - 0 Abstentions - 0 Chairman Wozniak directed Steve Roy to send a letter to the City Attor- ney requesting that office to send a letter to the Real Property Sectzon of the St . Paul Bar Association, with copies to those title insurance companies listed in the telephone directory, explaining the prob lems of new owners who purchase property after the abstract has been examined, . but where no search has been made for vacant building registration fees . Mr. Glassman suggested that a similar Ietter be directed to the St. Paul Board of Realtors , to make them aware of a possible problem when they are selling a boarded-up building. BOARD ACTION: .
