BLUE - MAVOR � " uncil Resolution �.... , Presented By ; � Referred To Committee: Date Out of Committee By Date WHEREAS, Minnesota Statute 473.813 authorizes political subdivisions to contract for the processing of solid waste without competitive bidding, providing such contracts are approved by the governing body of the political subdivision, and WHEREAS, The City desires to determine the most effective method of operating the Pig's Eye Wood Recycling Center; now, therefore, be it RESOLVED, That the proper City officials are hereby authorized and directed to enter into an agreement with Ratzlaff Logging and Lumber, Inc. , for the trial operation of the equipment at the Wood Recycling Center for a period of forty (40) working days. ' - /���� AGREEMENT THIS AGREEMENT, Made and entered into this day of ,1978, by and between Ratzlaff Logging and Lumber, Inc. , 508 First Street, Princeton, Minnesota, 55371 , hereinafter referred to as "Ratzlaff," and the City of Saint Paul , Minnesota, hereinafter referred to as "City," WHEREAS, Minnesota S±atutes 473+813 autF�orizes and permits a municipality to negotiate, without competitive bidding, contracts for the processing of solid waste; and WHEREAS, The City desires to determine the most efficient method of operating the Pig's Eye Wood Recycling Center; now, therefore, IT IS MUTUALLY At�tEED BY AND BETWEEN RATZLAFF AND THE CITY AS FOLLOWS: 1 . That in consideration of the benefit to be_ derived by the City from the processing of diseased elm logs stored at the City's Pig's Eye Wood Recycling Center, the City does hereby grant and give the right to Ratzlaff � to operate the stationary roto-drum chipper to process elm wood on a trial basis. 2. That the trial operation of the facility shall commence no later than January 2, 1979, and shall run for a total of 40 working days or March 1 , 1979, whichever comes first. 3. That Ratzlaff agrees to pay for all repairs and damages other than normal wear and tear to the equipment and pay all operating expenses including fuel , electricity and personnel costs in accordance with St. Paul Civil Service wage contracts. 4. That Ratzlaff agrees to name the City as co-insured on such insurance policies it maintains . covering public, automotive liability and Worker's Compensation benefits, and shall maintain said insurance in force and effect during the period of this agreement. -1- < •- 5. That Ratzlaff has the option of leasing the Nicholson Chipper at a rate of $ per for the term of the agreement upon the approval of the Director of the Department of Community Services. . 6. That this trial operation of the facility shall not obligate either party to enter into any further agreements for the operatirn of the plant.
