15881, approved August 29, 1975, entitled
"An Ordinance adopting a new Zoning Ordi-
nance for the City of Saint Paul, repeal-
ing Chapters 60, 61, 62, 63 and 64 0� the
Saint Paul Legislative Code and the Zoning
Map of the City of Saint Paul.
WHEREAS, the Planning Commission has found that:
1. An area of not less than forty acres, being the area
� generally bounded by Da.le Street, I-94, North Avon,
and Selby has been surveyed by the Planning Commission
within which the proposed area to be rezoned is
located;
2. That the number of real estate descriptions being
affected by such change, owing to the contiguous
property provisions of Minnesota Statutes 462.357
Subdivision 5, total 377 parcels. Under the pro-
visions of Minnesota Sta�utes, signatures for 2/3
or 253 parcels would be required and thus it is
impractical to obtain written consent for the re-

3. That the Planning Commission finds the proposed

WHEREAS, the Council, having held a public hearing upon 10 days'
prior notice as required by Minnesota Statutes 462.357, Subd. 3,
hereby concurs in the above findings of the Planning Commission; now,
therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the Zoning Map of the City of Saint Paul, Sheets Nos. 19 and
20, as incorporated by reference in Section 60.401 of the Saint Paul
Legislative Code, is hereby amended as follows:
That property owned by Gopher Elks Lodge located
on the north side of Selby Avenue between Grotto
and St. Albans, more particularly described as

Section 2.

WHEREAS, the Planning Comnission of the City of Saint Paul has caused legal notice
of a public hearing to be published on November 17, November 24 and December 1 ,
1978 pursuant to Minnesota Statutes 462.357 Subdivision 5, for the purpose of
amending the zoning boundary on certain property in the vicinity of Selby Avenue
and Grotto Street, and
WHEREAS, the Planning Commission has found that:
1. An area of not less than forty acres, being the area generally bounded
by Dale Street, I-94, North Avon, and Selby has been surveyed by the
Planning Corr�nnission within which the proposed area to be rezoned is
located;
2. That the number of real estate descriptions being affected by such
change, owing to the continguous property provisions of Minnesota

Dear h1adam:
This letter is written in response to the October 12, 1978 request of Gary Stout,
Director, Department of Planning & Economic Development, to conduct a 40 Acre Study
in the vicinity of Selby and Grotto for the purpose of allowing the construction of
the Gopher Elks Lodge on B-2 zoned land. The Planning Commission initiated the 40
Acre Study by resolution and caused notice of a hearing to be published in the St.
Paul Dispatch on November 17, November 24 and December 1 , 1978, in accordance with
Minnesota Statutes. PJotice of the hearing was also sent to the District 8 Planning
Council .
This matter was heard before the Current Planning & Zoning Committee on December 7,
1978. There was no opposition present at the hearing . Staff recommended approval of
rezoning Lots 16 thru 25, Block 3, Holcombe's Addition from RM-2 to B-2. Tom Sanchez
of the Renewal Division of the Department of Planning & Economic Development had
previously informed the Committee of the urgency of this 40 Acre Study which is taking
place within the existing District 8 40 Acre Study. He explained that the National
Elks Lodge had obtained certain financial commitments and other commitments from the
Renewal Division which were being held up because of the subject �roperty not being
adequately zoned.
The Committee had expressed concern over the establishment of this 40 Acre Study at
their November 2, 1978 meeting; however, they were assured by the Assistant City Attorney
that the Planning Commission had authority to do this , The Committee recommended
approval of the rezoning on a 5 to 0 roll call vote.
On December 8, 1978 the Planning Commission approved the rezoning on a vote of 17
to 0.
The City Council has scheduled a public hearing on this matter for January ll , 1979,

I. MINUTES APPROVAL
Mr. Hyduke made a motion to approve the minutes ot the meeting of November 17, 1978.
Mr. Levy seconded the motion. The motion to approve th� minutes passed
unanimously by a voice vote.
II. ANNOUNCEMENTS �
The next meeting of the Planning Cap�nlssion w111 be on January 12, 1979.
The meeting will be held on the 15th floor of the City Nall Annex.
The St. Paul Mlssisslppl River Corrldor Plan has been adopted by the City

III. CURRENT PLANNING AND ZONING COMMNITTEE

� The first item on the agenda was the public hearing on a 40 Acre Study
for reioning property in the viclnity of Selby and Grotto (t11e 8380).
Tom Sanchez of the Renewal Divlslon was present and stated hia dlvlsion
was in favor of the rezoning. No one else appeared to testity on the matter.
Mr. Levy made a motio� to close the public hearing. Mrs. Su�mers seconded
the motion and the motion passed wlth a unanimous volce vote.
Mr. Bryan made a motlon to approve the 40- Acre Study. Mr. Hanggi seconded
the motion. The motlon to approv� the 40 Acre Study passed with a roll
ca11 vote of 17 to 0.
The next item on the agenda wa� the Request for a Floodplaiq Co�dition
Use Permlt by the Metro Waste Control Caa�lsaion (fite 8388). Mr. Bryan
made a motton to approve the request for a fioodplain Conditlon Use Permit
and Mr. Grais seconded the motlo�. The awtion for approval w�s passed
with a roll ca11 vote of 17 to 0.

In the absence of the regular chairman, Mr. Bryan, the meeting was chaired by Joseph
Pangal , the Vice-Chairman.
ELKS LODGE 40 ACRE STUDY: A letter from the director of P.E.D. requesting the Planning
Comnission to �nit�ate a 40 Acre Study. A draft Planning Comnission resolution which
establishes a 40 Acre Study.
The Committee discussed a letter from Gary Stout, Director of P.E.D. , requesting the
Planning Comnission to initiate a 40 Acre Study in the vicinity of Selby and Grotto.
The Comnittee also discussed a draft resolution prepared by staff for Planning
Comnission initiation of this 40 Acre Study.
Tom Sanchez and Mary Paschl from the Renewal Division discussed the need for this separate
40 Acre Study within 'the existing District 8 40 Acre �tudy. They stated that the National
Elks Lodge had obtained certain financial comnitments and commitments from the Renewal
Division which now are being held up because the property is not adequately zoned.
They also produced a map of the subject site on Selby and the contiguous city-owned
,�``" property which involves a total of over 8�0 parcels of land, necessitating signatures
for these 400 parcels of land.
The Comnittee expressed concern over the establishment of a 40 Acre Study within a 40
Acre Study, but were assured by Jerome Segal , Assistant City Attorney, that the Planning
Commission had the authority to do this. Mr. Segal advised the Comnittee that a �0 Acre
Study required actual study of an area of land not less than 40 acres and documentation
that showed obtaining the necessary consent petition signatures was impractical .
Ed Warn from the Zoning Staff said that the original reason for initiating the District 8
40 Acre Study was to correct zoning along Oayton Avenue which now exists as a scattering
of residential and business zoning between Dale and Kent.
Mr. Fitzgibbon moved to recommend that the Planning Commission approve the initiation of
the 40 Acre Study. His motion was seconded by Ms. Sumners and passed on a 3 to 0 roll
call vote.

There being no public testimony, the public portion of the hearing was then closed
by Mr. Bryan.
Mr. Fitzgibbon moved approval of the Planning Comnission Resolution as prepared by
Staff.
The motion was seconded by Ms. Sumners, and passed on a 5 to 0 roll call vote, with

A proposal has been submitted to us for construction of a Gopher Elks Lodge
to be built oc� Lots 16 thru 25, Block 3 of Holcombe's Addition. To permit
the construction of this Lodge, which will operate a publfc bar, the present

we are requesting that a 40-acre study be conducted. We have concluded that
at teast 840 parcels of '�and would be involved in the aoning change. The
HRA and Control Data Corporation would account for the awnership of approu-
imately 400 of the parcels. On the remaining 400 parcels we aould have to
determine awnership and obtain two-thirds of their signatures. A map
showing the degree of contiguous ownership involved is available for
review in the Project Management Office, Sixth Floor, 55 B. Fifth Street.
In our opinion, obtaining the number of signatures required on a rezoning
petition would ba burdensome and would justify our requeat for a 40-acre

Mr. Gary Stout, Director of Planning and Economic Development, has requested
that a 40 Acre Study amendment procedure be initiated to rezo�e property in
the vicinity of Selby Avenue and Grotto Street from RM-2 to B-2 to permit
the construction of a Gopher Elks Lodge with a public bar.
The Planning Comnission has initiated the 40 Acre Study and caused notice of
a hearing on same to be published in the Saint Pau1 Dispat�h 'on Nove�+er 17,
1978, November 24, 1978 and December 1 , 1978 in accordance with Minnesota
Statutes 5462.357 Subdivision 5. The public hearing has been scheduled far
December 8, 1978..
Subsequent to the pubiic hearing,' th.e Plarrning Comaission will n�ed to eiake
severai findings if the rezoning is to be recomnended for approval. These -
findings are:
1 . 7'hat the number of real estate descriptions affected by the
� ordinance renders the obtaining of written consents impractical ,
and
2. That a survey of an area in excess of 40 acres has been made,
3. That a determination has been made that the asiendments to this
ord�nance proposed are related to the overall needs of the
comnunity, to existing land use and to a plan for future land

4, That proper notice and hearing have been given pursuant to the
state statutes.
To assist the Comnittee and the Commission in making these findings, the
staff has researched the request and has determined the following: �

proposed rezoning, owing to the 1973 Contiguous Property Law�
is 377 parcels. This would require the petitioners to obtain

Dear Madam:
This letter is written in response to the October 12, 1978 request of Gary Stout,
Director, Department of Planning & Economic Development, to conduct a 40 Acre Study
in the vicinity of Selby and Grotto for the purpose of allowing the construction of
the Gopher Elks Lodge on B-2 zoned land. The Planning Commission initiated the 40
Acre Study by resolution and caused notice of a hearing to be pub1ished in the St.
Paul Dispatch on November 17, November 24 and December 1 , 1978, in accordance with
Minnesota Statutes. P�otice of the hearing was also sent to the District 8 Planning .
Council .
This matter was heard before the Current Planning & Zoning Comnittee on December 7,
1978. There was no opposition present at the hearing. Staff recomnended approval of
rezoning Lots 16 thru 25, Block 3, Holcombe's Addition from RM-2 to B-2. Tom Sanchez
of the Renewal Division of the Department of Planning & Economic Development had
previously informed the Committee of the urgency of this 40 Acre Study which is taking
place within the existing District 8 40 Acre Study. He explained that the National
Elks Lodge had obtained certain financial commitments and other commitments from the
Renewal Division which were being held up because of the subject property not being
adequately zoned.
The Comnittee had expressed concern over the establishment of this 40 Acre Study at
their November 2, 1978 meeting; however, they were assured by the Assistant City Attorney
that the Planning Commission had authority to do this. The Conanittee recomnended
approval of the rezoning on a 5 to 0 roll call vote.
On December 8, 1978 the Planning Commission approved the r�ZOning on a vpt� af 17
to 0.
The City Council has scheduled a public hearing on this matter for January ll � 1g79.

The Committee discussed a letter from Gary Stout, Director of P.E.D. , requesting the
Planning Comnission to initiate a 40 Acre Study in the vicinity of Selby and Grotto.
The Committee also discussed a draft resolution prepared by staff for Planning
Comnission initiation of this 40 Acre Study.
Tom Sanchez and Mary Paschl from the Renewal Division discussed the need for this separate
40 Acre Study within "the existing District 8 40 Acre Study. They stated that the National
Elks Lodge had obtained certain financial commitments and commitments from the Renewal
Division which now are being held up because the property is not adequately zoned.
They also produced a map of the subject site on Selby and the contiguous city-owned
�M'"� property which involves a total of over 800 parcels of land, necessitating signatures
for these 400 parcels of land.
The Comnittee expressed concern over the establishment of a 40 Acre Study within a 40
Acre Study, but were assured by Jerome Segal , Assistant City Attorney, that the Planning
Comnission had the authority to do this. Mr. Segal advised the Comnittee that a 40 Acre
Study required actual study of an area of land not less than 40 acres and documentation
that showed obtaining the necessary consent petition signatures was impractical .
Ed Warn from the Zoning Staff said that the original reason for initiating the District 8
40 Acre Study was to correct zoning along Dayton Avenue which now exists as a scattering
of residential and business zoning between Dale and Kent.
Mr. Fitzgibbon moved to recomnend that the Planning Commission approve the initiation of
the 40 Acre Study. His motion was seconded by Ms. Summers and passed on a 3 to 0 rall
call vote.

Council Chambers of the City Hall and Court House (third floor) at
10:00 a.m. on January 11, 1979 on the:
ACTION of the City of St. Paul to REZONE from RM-2 to B-2
property owned by Gopher �lks Lodge located on the north
side of Selby Avenue between Grotto and St. Albans Streets.
The property is described as Lots 18 through 27, Block 3
Holcombe's Addition.
