An Ordinance amending Ordinance No. 11490 which
provides for certain ru].es and regulations authorizi.ng
and providing severance pay for certain City employees.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That Ordinance No. 11490, approved June 12, 1959,
as amended, be and the same is hereby further amended in Section 6 (c)
thereof, so that said Section 6 (c) shall read:
"(c) that no employee or his estate shall be paid severance pay
for more than two hundred days' accumulated and unused
sick leave credits at the rate of one-half day's pay for each
full day's cred.it, nor more than $4, 000. However, if the
total severance pay for such two hundred days is less than
$4, 000 and the employee has additional accumulated and
unused sick leave credits i.n excess of two hundred days, he
or his estate sha.11 be paid for such additionaJ, days credit at
the rate of one-half day's pay for each full dayi s credits,
but such total severance pay shall not exceed $4, 000. That
no more than a single cl.aim for severance pay hereunder
shall be payable �o any such employee or his estate. That
if any such employee or his estate sha11 have once received
severance pay hereunder, neither said employee nor his
astate thereafter shal.l become entitled to claim against or
receive from said City hereunder, any additional severance
pay, provided that this restrictive provision shall not pre-
judice any claim of any such employee or that of his estate
for the payrr�:ent of deferred and unpaid insta].lments of any
`�' valid sole severance pay allowance. That despite any

" contrary provision hereof, hereinabove or hereinafter set
forth, neither any such employee nor his estate, except in
case of separation from employment by death, shall be
eligible therefor or be entitled to claim any severance pay
he reunde r unle s s such employee at the time of hi s separation
from said City's employment, shall have served therein
for an aggregate period of not less than 20 years in case of
separation from employment by such employee's voluntary
action or for an aggregate period of not less than 10 ye�ars:
in case of separation from employment occasioned by ^r, � ¢� ,
expiration of fixed te rm of employment, or retiremen . �,��'
age 65 or over, or discharge therefrom by action of sa d ''
City or other cause beyond such employees' reasonable
control; and provided further that no such employee nor
his estat� shall_be enta.tled to cla.ixn ar receive payment of ,.,.,;�,�,
any severance pay hereunder, in any case where the employee's
separation from employment shall result from his discharge
therefrom, by action of said City, upon grounds of misc�nduct
of such employee involving moral turpitude, nevertheless: ix�;
any case where upon presentation of the case to it by the ��ad
of the department or other City officials concerned charges
of such type of. misconduct which might otherwise be made
against any such employee, in lieu of preferment of the same
and discharge on such grounds, said Council by resolution may
determine that such employee shall be granted leave to resign
from such employment when said Council shall find that per-
tinent facts and circumstances mitigate the misconduct to such
a degree that its action, in the premises, is in the furtherance
of justice. That for the purposes of this ordinance the continuity
of any such employee's services in the employment of said City
shall not be deemed i.nterrupted by his transfer or change of
position therein, provided that he shall receive no service or
sick leave credit on account of any period during which he sha11
occupy an elective office; "

� The Finance Corrmittee, at their meeting of December 18, 1978, -recommended
� approval of the following: .
` 1 . Resolution concerning severance. pay to enable city employees to be �
{ eligible for severance pay if they retire at age 65 or older after
! the new retirement age of 70 becomes effective.

i 2. Resolution approving the securities pledged by the designated bank�to
� protect funds of the City of St. Paul while held in said bank as
required by MSA 118.
3. Resolution refunding per diem payments from the Mpls.-St. Paul Metropolitan
Airports Corr�nission received by Councilmen Hozza. and Tedesco which were
turned over to the city. "
4. Resolution to transfer $4,50Q to employ consultant, Topp Robertson, for
,data processing assis.tance for the City Council .

The Finance Comnittee at their meeting of December 4, 1978 recomnended

approva of the Resolution by inserting in Section 6 under �the-heading
Subprofessional Group. the title Housing Technician III in Grade 38 and
by inserting the specifications for the title in Section 49 of the Civil
Service Rules. Resolution has been returned to the City Clerk's Office.
