Whereas, William H. Ecker was employed as a truck driver by the
Department of Public Works, and
Whereas, Mr. Ecker was engaged in hauling sand for winte� street
maintenance for the Departme�t of Public Works, City of St. Paul , in
September, 1974, and was issued a traffic tag by the Police Department
of the City of St. Paul for an overweight load, and
Whereas, Mr. Ecker was fined $75.00 by a St. Paul Municipal Court,
and
Whereas, a copy of the cancelled check indicating payment by Mr.
Ecker is attached, and
Whereas, it was difficult to determine whether the trucks were
loaded overweight and therefore more of a City problem rather than
an individual willful violation by Mr. Ec�cer, now therefore be it
Resoived, that the Council finds that the reimbursement to Mr.
Ecker is fitting and proper.

reimbursing a Public,hTorks employee the eum of $75.00 for a

the weight of the truck he was driving exceeded the leqal weight
limits.

I am returninq the resolution without approvinq it ae to form 1 �
_ becauae I. question the leqality of the proposed reimbursement. '

The employee was charged with a violation of a law whil� driving �
� a vehicle in the performance of his duties. No specific legis-
lative authority exista qranting power to the City Council to �
reimburse an employee for expenses incurred in defendinq himself �
, for traffic violations. Minneeota-Statubes, Section 466.07,
� aut�o�izes muiii�ipali�ia� to elect to c�fead anu inu�ify' i�.s �
employees for their tortious acts arising out of an alleged act � �
or omiasion occurring in the performance of �their dut�_ How- `�,
ev�er, this law does not apply to the case at hand because the �.
employee's traffic offense is not tortious conduct. . �

, • There beiaq no specific authorization to reimburse employees
for such activities, it is necessary to rely upon the general
po�wer� ot the City Council granted it by the City Charter.
Section 1.Q3 of the Charter provides that the'City shal2 have
all po�rere ahich it may now or hereafter be possible for a
� municipal corporation in this State in hanaony with the Consti-
tution of the State of Minnesota and'of the IInited State�d'.
The general limitation impo'sed upon the City .by the Constitution
ia that public funds be expended only for public purposes only.

whether he was acting pursuant to�dir.ections �
