272143 WFIITE -'C�TV CLERK � � � PINK - FINANCE GITY OF SAINT PAUL Council CANARV - DEPAR7MENT File NO• �� BLU�E - MAVOR Co ncil R solution Presented By � � �" Referred To Committee: Date Out of Committee By Date WHEREAS, the Director of the Department of Hvman Rights has been investigating complaints under Cha.pter 74 of the Saint P�.ul Legislative Code on the complaints of Jessie Rosillo vs. St. Paul Police Department and Ma.nuel Rosillo vs. St. Paul Police Department; and WHEREAS, the Director had determined tha.t it is necessary to obtain subpoenas from the District Court pursua.nt to Section 74. 10(D) of the Saint Pau1 Legislative Code, for the purpose of assisting in said investigation; and WHEREAS, the City Attrrney cannot, by reason of the divergence of their interests , represent both the Director and the St. Paul Police Department in legal representation; and WHEREAS, Section 5.02 of the CitY Charter permits the appointment of special counsel where 'by reason of interest" the City Attorney is unable to act in beha.lf of the city or any of its departments ; and WHEREAS, it appears that this is an appropriate case for the appointment of special counsel, and the City `Attorney ha.s so requested; now, therefore, be it RESOLVED, tha.t R, Scott Davies, Attorney at Law, is hereby appointed to represent the Director of the Department of Human Rights for the purpose of handling alllegal ma.tters in the processing of the claims of Jessie Rosillo vs . Flinsch C�j� Arr(j}�j�fEY City Attorney 647 City Hall BUILDING Dear Ms. Flinsch: At its regular meeting on Tuesday, October 17, 1978, the St. Paul Human Rights Commission unanimously approved a motion that the attached Council Resolutions be returned to your office with a reques t that they be redrafted in accordance with the original request for they do not provide adequate legal counsel sought by the Departrnent of Human Ri gh ts. It is felt that inadequate responses to Department requests for legal representation, as in the ins tant cases, do not fulfill the City Attorney's legal obligation to "represent the City in all causes in which the City is interested" or, to provide sub- stitute counsel where there is a conflict of interest. The Commission s trongly believes that in conflict of interest cases the City Attorney's Office should provide the Human Rights Department with legal counsel as requested to assure both ethical propriety and effective enforcement of the Human Rights Ordinance. It is our hope you will expedite the handling of these matters.
