RESOLVED, That the taking and condemnation of the lands described in the annexed assessment roll, identified
by the signature of the Director of Technology and made a part hereof, and the awards of damages to the owners of
such lands for said taking and condemnation as set forth in said assessment roll, be and the same is hereby in all
respects ratified and confirmed.

Attached is a substitute resolution for CF 01-1207 (Item #32) that the Real Es[ate
Division requests that you sign and bring to the December 5, 2001 City Council Public
Hearing.
The resolution reflects minor technical changes in a legal description for a permanent
easement on Burlington Northern Santa Fe Railroad property as part of the Como
Pedestrian/Bike Trail project. The change is based on recent project design and
engineering revisions.

Commencing at the intersection of the East Line of the NE 1/4 o ection 27 and the North Line of the S%2
of the NE 1/4 of Section 27; thence South 19Q feet; thence We along the south raikoad right of way line
135.00 feet to the point of beginning; thence East 55.00 feet; ence South 67.00 feet thence Northwesterly

For your information, Peter White will be asking for a lay-over of Item #88 on today's 11/7 council
Public Hearing agenda. This item is a ratification resolution to approve the awazd of damages for the
easements taken to construct a pedestrian/bike trail near Lexington and Jessamine, south of McMurtay
Field. The Real Estate Division will be asking for a lay over until the Public Hearing on
December 5, 2001 in order far this properiy and an adjacent properiy to the south to be considered at
the same time.
