WHEREAS, pursuant to resolution, C.F. 271962# approved October
24� 1978, a public hearing was duly held on November 9, 1978 be-
fore the Council of the City of Saint Pstul, said hearing pertain-
ing to the structure (garage only) at 916 York, Saint Faul,
MinnesotaT and
WHEREAS, upon the facts presented at the said hearing consist-
ing of photographs�, inspection reports and the recominendation of
the Building Department�, it is found nnci determined by the City
Council thnt according to the records and files in the offi� of
the Register of Deeds the fee owners are Gregory Smith and Colleen
Smith, 9�i6 York, St. Paul, MN 55106j and Minnesota Housing and
Finance Agency is mortgagee in the amount of $22,700.00j and that
it is further determined that the above described building con-
stitntes a hazardous building wit hin the deiinition of Minnesota
Statutes 4�3.15 far the following reasonss

RESOLVID, That in accordance with Minnesota Statutes Sections
463.15 through 463.25, and based upon the foregoing findings of
the City aouncilf the Council of the City of Saint Paul does hereby

ORDER
1. The owners of the above described building shall make the
same safe and not detrimental to the public peace, hera.lth,� safety
nnd welfare by having the said building razed nnd the tnaterials
therefrom removed from the pr�mises within thirty (30) days from
the date of the service of this Order=
2. Unless such corrective action is taken to comply with
this Order or an answer served upon the City of Saint Paul and
filed in the office of the Clerk of the District Gburt of Raimse

Order ta raze and remove the said building will be made to the
Ramsey County District Court�
3. In the event that the building is to be razed by the
City of Snint Paul pursuant to judgment of the District Court�
all personal property or fixtures af any kind which my unreason-
ably interfere with the �nzing a�nd removal of this building shall
be removed within ten (10) days from the entry of judgmentj and
if not so removed, the City of Saint Paul shall remove and dispose
of such parsonal property and fixtures as provided by law;
4. If the City of Sa�int Paul is compelled to take any corrective
action herein, all necessary costs expended by the City will be

Honorable Council :
The Division of Housing and Building Code Enforcement is hereby sub-
mitting its report on the condition of the structure at the location
referred to above.
The owners of record are Gregory E. & Colleen M. Smith, 916 York Avenue,
St. Paul, Minnesota 55106 .
The legal description of the property is Lots 6 and 7 , Block 6, Charles
Weides Re Blk 6, Nelsons Additiibn.
The building is a detached garage of flagstone construction with a wood
frame roof.
This building because of age, dEterioration, lack of proper maintenance
and excessive rotting of structural members is deemed ha2ardous and
beyond feasible rehabilitation and should be razed as soon as possible.
Inasmuch as the conditions outlined above constitute a public hazard
and the owner has made no attempt to satisfactorily repair the damage
despite our warnings, and the continued vacant condition contributes a
blighting influence on the neighborhood, it is the recommendation of
this Division that this matter be referred to the City Attorney' s Office
for razing and removal through District Court proceedings.
