1978, a nublic h�aring was duly held on November 9, 1978 before the
Council of the City of 8aint Paul, said hearing pertaining to the
structure (garage only) at 701 Marshall Avenue, Saint Paul, Minnesotas
and +-
WHEREAS, upon the facts prasented at tha said hearing consisting
of photographs, inspection reports and the recommendation of the Bui,lB-
ing Department, it is found and determined by the City Council that
according to the records and files in the office of the Regist�r of
Deeds the fee owner is Patrick J. Brennan, 701 Marshall Ave., St. Paul,
Minnesota 55104t the Board of Water Commissioners has liens against
the property in the amount of $105.63, dated September 6, i977 and in
the amount of $150.48, dated September 23, 1977t azd American Acceptance
Co. h�s a personal judgment in the amount of $186.27 entered January 19,
1976; and that it is further determined that the above described build-
ing constitutes a hazardous building within the definition of Minnesota
Stntutes 463.15 for the fallowing reasons:

RESOLVED, That in accordance with Minnesata St�tutes S�etions
463.15 through 463.25� and based upon the foregoing findings of the City
Council, the Council of the Ci�y flf Saint Paul does hereby make the
following ORDER:
ORDER
1, The owner of the above described building shall make the same
safe and not detrimental to the public peace, health, safety and wel-
fare by having the said building razed and the materials there from re-
moved from the premises within thirty (30) days from the date of the
service of this Orders
2. Unless such corrective action is taken to comply with this
Order or an answer s� ved upon the City of Saint Paul and filed in the
Office of the Clerk of the District urt of aznse ount inn sota

within twenty (20) days from the date of the service of this Order� a
Motion for Summary Enforcement of this Order to raze and remove the
saia building will be made to the Ramsey County District Courtt
3. In the event that the building is to be razed by the City of
Saint Paul pursuant to �udgment of the District Court, all personal
property or fixtures of any kind which may unreason,ably intar�3ere with
the ra�ing and removal of this building shall be remaved within ten
(10) days from the entry of �udgmentt and if not so removed, the City
of Saint Paul shall retmve and dispose of such personal �r�p�rty�nd
f ixtures as provided by lnwT
4. If the City of Saint Paul is compelled to take any corrective
action herein, all necessary costs expended by the City will be assessed
against the above described real estate and collected as other taxes;

FURTHER RE80LVED� that a certif ied copy of this resolution and
incorporated Order herein be served upon the last record owner of the
above described property in the manner provided by law.

Honorable Council :
The Division of Hou��ng and Building Code Enforcement is hereby sub-
mitting its repo.rt on the condition of the structure at the location
referred to above.
The owner of record is Patrick J. Brennan, 701 Marshall Avenue, St.
Paul, Minnesota 55104 .
The legal description of the property is W. 1/4 of Lot 14 and E. 1/2 of
Lot 13, Block 3 , Portland Addition.
The building is a detached wood frame garage.
The subject property has been unsecured since June 14 , 1978 .
This building because of age, deterioration and lack of proper
maintenance is deemed beyond feasible rehabilitation and should be
razed as soon as possible.
Inasmuch as the conditions outlined above constitute a publie hazard
and the owner has made no attempt to satisfactorily repair the damage
despite our warnings, and the continued vacant and boarded up condition
contributes a blighting influence on the neighborhood, it is the recom-
mendation of this Division that this matter be referred to the City
Attorney' s office for razing and removal through District Court proceedings.
