THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That Ordinance 16006, adopted May 18, 1976, as amended, be and the same is hereby further amended so as to add the following new subsection to section 3 thereof, to read as follows: � (D) Loca1 Advisory Committees. That at such time as the Heritage Preservation Commission shall create Advisory Committees for historic districts they shall be selected and governed by the following regulations : (1) Powers and Duties. In order to provide a sense of community identity and to preserve elements of the cultural, social, economic, religious, political, architectural and aesthetic heritage of the District, the Advisory Committee shall have the following powers and duties : (a) To make recommendations to the Heritage Preser- vation Commission concerning the boundaries of the proposed historic district. (c) Draw up and help to administer a preser- vation program for the district as a whole. This preservation program might include a set of standards for compatibility of new construction, recommendations for a volun- tary design review board which would offer advice to residents who wish to restore their buildings, and any other recommendations which they feel would increase public aware- ness and preserve the historic character of the district. (2) Membershi Selection. The Advisory Committee shall consist of seven 7 members appointed by the Mayor and approved by the City Council. The members of the Advisory Committee shall be residents , property owners or duly appointed institutional representa- tives of the respective historic district. The Heritage Preservation Commission shall solicit nominations for membership from neighborhood associ- ations, community groups, planning boards, and other organizations whose purposes include the goals of this Advisory Committee or whose expertise may assist the Advisory Committee. The Heritage Preservation Commission shall especially consider persons knowledgeable in the fields of history, architecture, architectural history, design, law, urban planning, and real estate valu- ations. The geographical distribution, within the District, of potential appointees will also be con- sidered. The appointees must show an interest and ability to understand, appreciate, and promote the purposes of the Advisory Committee. 2. - �'��'���� (3) Terms of Office. The members of the Advisory Committee shall be appointed for three year terms, except that the initial Advisory Com- mittee shall consist of three members appointed for a one (1) year term, two members appointed for two (2) year terms, two members appointed for three (3) y�ar terms. Upon the expiration of the terms of the initial one and two year members, successors filling their positions shall be appointed to serve three year terms. Members of the Advisory Committee shall thus be appointed for staggered terms. Members shall hold office until their successors have been appointed and qualified. No member shall be appointed to serve more than two (2) con- secutive terms. (4) Attendance at Meetings; Removal. Members shall attend meetings regu arly. In the event that any member fails to attend either three (3) consecutive meetings or twenty (20) percent of the meetings held in any calendar year, such member may be removed by a majority vote of the Heritage Preservation Commission. (5) Vacancy. The Chairperson of the Advisory Com- mittee shall promptly notify the Heritage Preser- vation Commission in writing of any vacancy caused by removal, resignation, death or other- wise. Vacancies shall be filled by appointment by the Mayor and approval of the City Council for the unexpired term of the member whose position was vacated. (6) Service Without Compensation. Copies of all minutes shall be distributed to the members of the Heritage Preservation Commission. Section 2 . This resolution is essentially an adoption from the proposed Historic Hill District Board Ordinance of 1977. The guidelines of the resolution are appropriate excepting the following considerations: 1 ) The Advisory Committee's duties fall into two phases: l . Preparation of proposed boundaries and preservation program before nomination. 2. Advising on and helping to administer a preservation program after designation. Since membership on the Advisory Committee itself is determined by residence within the district it will be necessary for the Commission to establish initial tentative boundaries for the purpose of determinin� Advisory Committee membership. Once the final designated boundaries are drawn up, permanent membership would be defined by the final boundaries. 2) In section three of Powers and Duties (A) , the second sentence should make mention of a voluntary design adviso�rr board rather than a review board so that the board s charge won't be confused with the Commission's ordained permit review powers. 3) I would suggest that an eighth member of an Advisory - Committee should be an ex officio and non-voting mem- ber of the Heritage Preservation Commission. This would ensure clear communication between the two bodies. � 4) The resolution guidelines state (F) that "The City of Saint Paul shall provide the Advisory Committee with adequate staff to perform its duties." Given the de- fined duties in the resolution I do not think that city staff time would be neces'sary. Further, due to current . � budget�constraints, it is difficult enough to provide .��5� � . . - �'���'f�� - -2- the Commission with adequate staff, much less staffing an unforseen number of Advisory Committees.
