AGREEMENT THIS AGREEMENT, Made and entered into this day of , 1978, by and between R.ATZLAFF LOGGING AND LUMBER, INC. , 508 First Street, Princeton, Minnesota, 55371, hereinafter referred to as "Ratzlaff" , and the CITY OF SAINT PAUL, Minnesota, hereinafter referred to as "City", WHEREAS, Minnesota Statutes 473.813 authorizes and permits a municipality to negotiate, without competitive bidding, contracts for the processing of solid waste; and Wi�,REAS, The City desires to cl.ear its facility known as the Pig' s Eye Lake Wood Recycling Center of stored Dutch Elm diseased logs; now, therefore, IT IS MUTUALLY AGREED BY AND BETWEEN RATZLPFF AND THE CITY AS r'OLLUWS: l. That in consideration of the benefit to be derived by the City from the removal of Dutch Elm diseased logs stored at the City' s Pig' s Eye Lake Wood Recycling Center, the City does hereby grant and give the right to Ratzlaff to remove all Dutch Elm dis- eased wood material upon the condition that Ratzlaff undertakes the immediate removal of said wood material commencing the date first written above and ending sixty (60) days therefrom. That the City agrees, during the period of this agreement, it shall be entitled to deliver other Dutch Elm diseased wood material to said center, but said material shall be stored sep- arately and apart from wood material presently at the site of said � center and which is the subject of this agreement. 3. That Ratzlaff agrees to name the City as a co-insured on such insurance policies it maintains covering public liability, automotive liability and Workers ' Compensation benefits, and shall maint�in said in�uranc� in ferce anc3 ef.fect dur.ing the period of. this agrPement. 4. That Ratzlaff agrees to obtain, at its own expense, such permits or other consents that may be imposed by the operation of law in transporting Dutch Elm diseased wood material.
