This is written in response to the petition of Joseph Schaefer to rezone property located at the northwest corner of Jefferson and Fulton (349 Fulton) from B-1 � Local Business to B-2 Community Business. The rezoning will allow the addition of a kitchen to the existing bar/restaurant. This matter was heard before the Current Planning & Zoning Committee on September 7, 1978. One neighbor in opposition presented a petition with 29 signatures; there were. also three letters in opposition. Major concerns were possible increased traffic and noise. Staff recommended approval and the Current Planning & Zoning Committee also recommended approval on a vote of 6 to 0, based on staff findings . that the existing bar is a nonconforming use in a B-1 ; bars are a permitted use in a B-2; other permitted uses in a 6-2 would not be significantly detrimental to the adjacent neighborhood; the rezoning is consistent with the B-2 zone to the west of the site; and parking would not be displaced. On September 8, 1978 the Planning Commission unanimously confirmed the Current Planning & Zoning Committee's recommendation to approve the rezoning. The applicant was present. Ms. McNeally of Planning staff showed slides and read the staff report indicating staff's reconunendation for approval of the rezoning request. Joseph Schaefer of 349 Fulton stated that he is not adding any additional seating space, only a kitchen and storage area. He feels that by adding a kitchen, he would be promoting better business in the neighborhood. Joan Kuechenmeister of 369 View was present with a petition signed by 29 persons voicing their opposition. Three letters were also received in opposition. 7he main concerns expressed were the increased noise and traffic in the area. Mr. Pangal made a motion for the approval of the rezoning based on the nine findings in the staff's recommendation: 1 . The site was previously zoned canmercial . 2. Restaurants and bars are permitted uses in a B-2 zone. 3. The existing bar is a legal nonconforming use in a B-1 zone. As a non- conforming use, it may not be expanded. 4. The site has limited room for expansion due to the Pleasant Avenue corridor to the north and west. 5. Property to the west (north side of Jefferson between Victoria and Milton) was rezoned from R-4 to B-2 in December of 1977. 6. With the B-2 zone adjacent to the wes�, staff would not consider this proposed rezoning spot zoning. 7. Other permitted uses in a B-2 would not appear to be substantially more detrimental than permitted uses in a B-1 . 8. The expansion will not displace parking. 9. The rezoning will allow the addition of akitchen to the existing bar/restaurant. This matter was heard before the Current Planning & Zoning Comnittee on September 7, 1978. One neighbor in opposition presented a petition with 29 signatures; there were also three letters in opposition. Major concerns were possible increased traffic and noise. Staff recoriunended approval and the Current Planning & Zoning Committee also recommended approval on a vote of 6 to 0, based on staff findings that the existing bar is a nonconforming use in a B-1 ; bars are a permitted use in a B-2; other permitted uses in a B-2 would not be significantly detrimental to the adjacent neighborhood; the rezoning is consistent with the B-2 zone to the west of the site; and parking would not be displaced. On September 8, 1978 the Planning Commission unanimously confirmed the Current Planning & Zoning Committee's recommendation to approve the rezoning.
