St. Paul Legislative Code pertaining to
� zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, $ 462. 357 and
�S 64. 210 of the Legislative Code, Paul L. Gonia duly petitioned
to rezone the north 50 feet of Lots 12 through 15, inclusive,
Block 2, Birmingham' s Park, located on the south side of Sims
Avenue between White Bear Avenue and Flandrau Street from R-4
(One-Family Residential) to RT-1 (Two-Family Residential) for the
purpose of converting a single family dwelling into a duplex, the
petition having been certified by the Department of Finance and
Management Services on October 25, 1978 as having been consented
to by at least 67� of the owners of the area of the property to
be rezoned, and further, having been consented to by at least
two-thirds of the owners of the property situated within 100 feet
of the total contiguous descriptions of real estate held by the
same owner or any party purchasing any such contiguous property
within one year preceding the date of the petition; and
WHEREAS, The current planning committee on November 16, 1978
conducted a public hearing for the purpose of considering the re-
zoning petition, and, pursuant to Section 20. 03 of the Administra-
tive Code, submitted its recommendation to the Planning Commission
that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on November 17, 1978 and recommended
that the City Council approve the petition; and

WHEREAS , Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official
newspaper of the City on December 9, 1978 and notices were duly
mailed to each owner of affected property and property situated
wholly or partly within 350 feet of the property sought to be re-
zoned; and
WHEREAS, A public hearing before the City Council, having
been conducted on December 21, 1978 where all interested persons
were heard, and the Council having considered all the facts and
recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 15 ,
as incorporated by reference in Section 60. 401 of the Saint Paul
Legislative Code, as amended, is hereby further amended as
follows:
That property located on the south side of Sims
Avenue between White Bear Avenue and Flandrau
Street, being more particularly described as
the north 50 feet of Lots 12 through 15, inclusive,
Block 2 , Birmingham' s Park, be and is hereby re-
zoned from R-4 (One-Family Residential) to RT-1
(Two-Family Residential) .

Dear Madam:
This letter is written in response to the petition of Paul L. Gonia to rezone
property located on the south side of Simms between White Bear and Flandrau
from R-4 (Single Family) to RT-1 (Two-Family) , in order to convert a single
family dwelling into a duplex located at 726 Sims.
This matter was heard before the Current Planning & Zoning Committee on
November 16, 1978. There was no opposition. Staff recomnended approval of
the rezoning request and the Current Planning & Zoning Comnittee also recommended
approval on a vote. of 7 to 0 based on the findings that the property was
formerly zoned A Residence; the Comprehensive Land Use Plan identifies the
site as appropriate for two-family use; the site adjoins no other zoning district;
the subject lot exceeds the RT-1 square footage requirements and maximizing the
use of the structure is in keeping with energy conservation.
On November 17, 1978 the Planning Comnission unanimously confirmed the determin-
ation of the Current Planning & Zoning Committee to approve the rezoning.
The City Council has scheduled a public hearing on this matter for December 21 ,
1978.

Mr. Gonia said he was satisfied with the staff report and had nothing to add.
There being no further testimony, Mr. Bryan then closed the public hearing.
Jean McGinley moved to recommend approval of the rezoning request based on Findings
1 through 6 of the staff report. Her moti.on was seconded by Joseph Pangal and
passed on a 7 to 0 roll call vote.

A. SUFFICIENCY: The application was filed on a consent form petition subscribed and sworn
to be o�re a notary public on Oct. 23, 1978, and received in the Planning Office
November 1 , 1978.
6. PURPOSE: The applicant requests a rezoning of his property from R-4 to RT-1 in order
to m fy his single family dwelling into a duplex by raising the southeast pqrtion of
his roof to construct a small upper floor apartment.
C. FRONTAGE & AREA: This corner site has 160 ft. frontage on Sims and 50 ft. side
rontage on andrau, for a total area of 8,000 sq. ft.
D. SITE CONDITIONS: This corner lot contains a 1� story single family dwelling with a
detac e -car garage. Duplexes abut the site on the south and east.
E. AREA CONDITIONS: The surrounding land to the east, south and west consists primarily
o s ng e am y homes and duplexes . Seven 12 unit apartment buildings occupy the
block to the north. White Bear Avenue, a comnercial strip, lies 1 block to the east.
FINDINGS:
1 . The property was forrr�rly zoned an "A" residential district permitting both single
family and duplex residential dwellings .
2. The 1963 Comprehensive Land Use Plan identifies the site as one appropriate for one
and two family residences.
3. The site directly adjoins no other zoning district; however, much of the north side of
Sims between Flandrau and White Bear is zoned RM-2. There is a large RT-1 zone one
block north of the applicant's parcel along the north side of Case Avenue (see map) .
4. The applicant's lot area of 8,000 sq. ft. exceeds the RT-1 requirement of 6,000 sq. ft.
5. Duplexes presently adjoin applicant's property on the south and east (these are non-
conforming uses.)
6. Maximizing the use of an existing structure is in keeping with energy conservation.
STAFF RECOMMENDATION:
Based on the findings above, staff recommends approval of this rezoning request.
