RESOLUTION APPROVING SETTLEMENT OF EMINENT DOMAIN
LITIGATION ARISING FROM WIDENING OF BURNS AVENUE
WHEREAS, on May 27, 1975, the Council of the City of Saint Paul
adopted a Final Order In Condemnation, Council File No. 265502, which
Order authorized the acquisition of the following described property
located within the City of Saint Paul:
The northerly 20 feet of Lots 1 thru 8, inclusive, Blk. 21,
Battle Creek Heights Plat 3, Also, those parts of Lots 1
thru 9, inclusive and Lot 14, Blk. 20, Battle Creek Heights
Plat 3, lying northerly of a line 50 feet southerly of and
parallel to the north line of Section 2, Township 28 north,
Range 22 west. Also acquire temporary easements in the land
necessary for slopes, cuts and fills including right of
removal of lateral support from subject lands or remainder
thereof occasioned by excavations thereof or construction of
slopes in the grading and paving of BURNS AVE. from Ruth St.
to McKnight Rd. ;
and
WHEREAS, on June 5, 1978, the City of Saint Paul initiated
eminent domain proceedings in Ramsey County District Court to condemn
said property for the purpose of widening Burns Avenue between Ruth
Street and McKnight Road, the case being ��entitled City of Saint Paul
v. Knutson Development Company, et al. , Court File No. 428072; and
WHEREAS, on September 28, 1978, the Court appointed Commissioners
filed their Award for the taking of said parcel in the sum of $28,000.00 ,
whereupon Respondent filed an Appeal of said Award, and in response,
the City filed its Cross-Appeal; and

WHEREAS, City, according to Minnesota law, has paid to Respon- I
dent three-quarters of the Award, or $21,000.00 by Court deposit; and
WHEREAS, Respondent has contacted the City seeking settlement �
of said matter, and Respondent has , after negotiations, offered to
settle the matter and dismiss its appeal for the Commissioners ' Award �
of $28,000.00 plus interest, plus $1,500.00; and i
WHEREAS, the Office of the City Attorney has reviewed the offer, '�
the file and the evidence in detail in preparation for jury trial, '
and now recommends that this settlement offer be accepted.
NOW THEREFORE, BE IT RESOLVED that the Council of the City of
Saint Paul hereby approves settlement of the pending eminent domain �
litigation entitled City of Saint Paul v. Knutson Development Company,
et al. , Court File No. 428072, with Respondent for $1,500. 00 in excess
of the Award of the Court appointed Commissioners of $28,000. 00 , plus
interest due to date not to exceed $500.00, and that as a result thereof,
Respondent dismiss its appeal of said Award. It is provided that this
settlement, together with any unpaid balance due on the Commissioners '
Award, plus interest due thereon, be paid from Fund No. pIR Fund
6000a 7�.-000 (L-777$), to be reimburs ed from I�fi3A Fund.
