RESOLUTION AU'PAORIZING APPLICATION
FOR A CONTANIINATION CLEANUP GRANT FROM DTED
FOR THE WEST SIDE FLATS PROJECT
WHEREAS, the City Council of Saint Paul, Minnesota (the "City") has adopted a Comprehensive Plan
which has identified goals, among others, ofproviding a mix of housing types and prices, increasing the tas base
and job opporhxnities, and remediating and redeveloping polluted and unerutilized industrial land, particularly
on the riverfront; and
WfIEREAS, the City desires to develop the site known as the "West Side Flats" into a mixed use project
that includes rental and ownership housing and commercial uses, in conformance with the City's adopted
Comprehensive Plan; and
WIIEREAS, on July 11, 2001, the Housing and Redevelopment Authority of the City of Saint Paul, by
Resolution 01-7/11-4, approved a Master Development Agreement between the HRA and JLT West Side LLC;
and
WHEREAS, environmental invesrigation has revealed that the West Side Flats site is contaminated with
a variety of pollutants which make the JLTWest Side LLC proposal infeasible without additional financial
assistance; and
WHEREAS, the City has identified several projects including the West Side Flats site and the Dale Street
Shops as eligible for the Department of Trade and Economic Development's Contaminarion Cleanup Grant
Program; and
WIIEREAS, the City has identified the Dale Street Shops as the highest priority of the City for
contaminated soils clean-up;
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Saint Paul, Minnesota that
the City act as the legal sponsor for the West Side Flats project contained in the Contamination Cleanup Grant
Program to be submitted on November 1, 2001 and that the Mayor ofthe City of Saint Paul is hereby authorized
to apply to the Department of Trade and Economic Development for funding of this proj ect on behalf of the City.
BE IT FURTHER RESOLVED, that the City has the legal authority to apply for fmancial assistance, and
the institutional managerial, and fmancial capability to ensure adequate project administration.
BE IT FURTHER RESOLVED, that the sources and amounts of the local match identified in the
application aze committed to the project identified.

39 BE IT FUR'TFIER RESOLVED, that the City has not violated any Federal, State or local laws pertaining
40 to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice.

42 BE IT FURTHER RESOLVED, that upon approval of its application by the state, the City may enter into
43 an agreement with the State of Minnesota for the above-referenced proj ect, and that the City certifies that it will
44 comply with ali applicable laws aad regulafions as stated in all contracY agreements.

46 BE IT FURTHER RESOLVED, that the Mayor and City Clerk of the City of Saint Paul are hereby
47 authorized to execute such agreements as are necessary to implement the project on behalf of the applicant.
