Council �Resolution Presented By Referred o Committee: Date Out of Committee By Date WHEREAS, Saint Paul City License Inspector, Joseph Carchedi, has commenced a lawsuit against Mayor Gearge Latimer, Police Chief Richard Rowan, and Saint Paul Police Officers, John Voita, Dave Weida, and James Fecky, as well as Minnesota Bureau of Criminal Apprehension employee, Raymond Perron; and WHEREAS, in said lawsuit allegations are made that the various defendants committed tortious acts against the plaintiff while acting in the scope of their emgloyment with the City of Saint Paul; and WHEREAS, there are also allegations made in said lawsuit that these same defendants acted illegally in committing various acts against the plaintiff; and WHEREAS, the exact nature of said allegations is as yet un- determined; and WHEREAS, defendant Mayor George Latimer has asked the City Attorney to represent him in the defense of said lawsuit; and WHEREAS, the City Attorney cannot by reason of the special and unusual circumstances represent other defendants while repre- senting the Mayor; and WHEREAS, Section 5. 02 of the City Charter permits the appoint- ment of special counsel where "special or unusual circumstances" exist; and WHEREAS, it appears that this is an appropriate case for the appointment of special counsel and the City Attorney has so re- quested; now, therefore, be it COUNCILMEN Requested by Department of: Yeas Nays Butler [n Favor � Hozza Hunt Levine __ Against BY Maddox Showalter TedesCO Form App d y City rne � Adopted by Council: Date �. Collins, attorney at law, is hereby appointed to represent Saint Paul Police Chief Richard Rowan in the defense of the lawsuit commenced by Joseph Carchedi; and, be it FURTHER RESOLVED, that Ronald Patrick Smith, attorney at law, is hereby appointed to represent defendant Saint Paul Police Officer, Dave Weida, in said lawsuit; and, be it . FURTHER RESOLVED, that Robert T. White, attorney at law, is hereby appointed to represent Saint Paul Police Officer, James Fecky, in said lawsuit; and, be it FURTHER RESOLVED, that Patrick H.
