Villaume, III . 3 Assistant City Attorney DATE: December 18, 1979 . RE: Claim by the City of Saint Paul against the Independent School District No. 625 The City of Saint Paul brought suit against ISD k625 to recover the annual salary paid to Lt. Henry Winterhalter for the years 1975 through 1977. It was the claim of the City of Saint Paul that Lt. Winterhalter, as supervisor of the School Patrol Division, provided assistance in the ma.intenance, supervision and training of the school police force on the elementary level. This service to the School District provided a benefit for which the City was entitled to reimbursement. The claim was for approxima.tely $67 ,000. The City of Saint Paul has resolved this matter without the necessity of litigation for the sum of $42,000. This settlement reflects the claims of the School Board tha.t some portion of Lt. Winterhalter' s salary should be attributed to the private schools. It was further agreed tha.t the question of reimbursing the City for ervices provided the school patrol system would be covered in the ma.ster contract beginning this year. This office approves the settlement. FEV:paw a'l''J
