Grunau (three units) SUBJECT: Request that condemnation order of June 25 , 1979 , be rescYnded, and that a reasonable extension of time be granted to make required repairs , because of severe fin an cial hardship ; also, request return of filing fee. APFEARANCE : Mildred R. Grunau " Bill Williams , Public Worlcs Sewer Design Division Dennis Strand, Tenant Greg Parranto, Rea1 Estate Manager PROCEEDINGS: . Alice Bijjani explained that Ms . Grunau had contended that �he city had in 1927 connected the plumbing pipes which drained the adjacent property to the sewer of her property, and that this was a direct cause of water backing up into the basement . �The housing code office had therefore re- quested that records of the city' s sewer installations in this case be presented. Bill Williams , of Public Works , produced records which showed that the sewer lines of the properties in question had each been installed properly by connecting each directly to the main sewer in the street. He said the only way the records could be refuted would be to dig up the ground, and it would be at the owner' s expense . Dennis Strand, occup ant of one unit at 450 Stryker, said he felt the water in the basement was caused by a heavy rainstorm, and that it had subsided. He told the Board that he and the occupants of the other apartment at 450 Stryker had discussed the various problems in that half of the building, and had arrived at an agreement on making the repairs requi�ed by the city. Ms . Grunau had agreed to hire an electrician and a plumber to complete that part of the work, while the tenants would be responsible for the remaining items . Ms . Grunau had a reed to pay for the materials and the tenants would pay monthly rent of �45 for each apartment , instead of the full amount of $90 , until all work was completed. Ms . Grunau stated that the property had been owned by her family since the 1880' s . She said she had cared for the building for 50 years , but two years ago had become ill and turned it over to Pa�ranto Bros . , a real estate firm, to manage . She said the tenants at 448 Stryker, who occupied both the first and second floors , were very destructive and had not paid rent for several months . When the city posted the condemnation notice , they were to vacate by July 2 , but because of difficulty finding new quarters the city had extended the date to July 15. Chairman tiVozniak asked if an unlawful �detainer action had been taken. Greg Parranto said he had been managing the building and had started such action , but the sheriff' s office had not been able to serve the warran�. The court date had come and gone meanwhile . When the city con demne d the building, his firm felt a new action iaould not be necessary, since the tenants were ardered to vacate anyw ay. -6- 7/10/79 - Meeting No. I51 . � Chairman Wozniak asked how anyone could be sure the tenants at 448 would be out by July 15. Ms . Bijjani explained that the city could tag the occupants , but would nat evict them. That was the owner' s responsibility. She brought up the matter of the item concerning improper sink venting of all bathroom drains , emphasiz�ng that the sinks siphon and that this would have to be corrected. Mr. Reiter asked what services Parranto Bros . were providing in managing the property. It appeared to him that the building had reached an advanced state of deterioration while under management. Mr. Parranto said they collecte d the rents and trie d to take care of rep airs as needed, but the tenants at 448 would not allow him to enter when he asked to see that half of the b uilding. In answer to questions conce rning the rental agreement between the tenants and Ms . Grunau, Mr. Strand said the rent figure of $45 per month for each unit at 450 Stryker would be in effect until a Certificate of Occupancy was issued by the city. Ms . Bijjani asked whether he mean until the certificate was issue d or until the placard was lifted, as there was a difference. She said the city could lift the placard from 450 and give Ms . Grunau additional time to get the whole building certified, but the city would not certify the build.ing with one unit condemned. 448 could� remain under placard, which would requi.re the tenants to vacate , while 450 could still be occupied and the placard lifted. BOARD ACTION: - Chairman Wozniak moved that the order to vacate , issued� by the city in conjunction with condemnation proceedings , be extenc�ed to September 1 , 1979 , for the tenants at 450 Stryker, provided all items designated as violations of the life and health s�afety code in the city' s . letter of 6/25/79 are corrected by September 1 , 1979 , and a11 remaining violations by December 1 , 1979 . Regarding the other half of the property, 448 Stryker, the order to vacate shall remain at July 15 , 1979. Mr� Tiesa secanded. MOTION CARRIED AND SO ORDERED.
