BE IT RESOLVED, That the Council of the City of Saint Paul hereby
certifies and approves the action of the City of Saint Paul Board of
Appeals and Review pertaining to the following listed property and as
shown by the Sxcerpted Minutes of said Board of Appeals and Review,
� dated July 10, 1979, and marked EXHIBIT A, and attached hereto and
tnade a part hereof by reference:

BOARD ACTION: Granted waiver of St . Paul Legislative Code, Section
54.11, pertaining to requirement of private bathroom
facilities in each dwelling unit, to permit occupancy '
of four units sharing two bathrooms, on the following
conditions : �
(a) That no more than a total of six persor�occupy the
building,
(b) That all remaining code violations, as designated
in city's inspection letter of 6/4/79, be corrected
within 90 days.
(c) That the above stipulations apply only so long as
the building is operated as a four-unit structure, and
(d) That these conditions be recorded on the abstract.

because of practical difficulty and expense.

PRUCEEDINGS:
Mr. Barthold�'related that he had owned the property for about 11 years .
He understood it had originally been a single family house , built in the
1890s , and converted to apartments in later years , but long before he
bought it . There were two apartments up and two down , with one bathroom
on each floor that was shared by the occupants . He said it taas not
possible to find space for additional b�athrooms , and in any case would
be too expensive . The units were small and there were never �ore than
two persons per unit.

Alice Bijjani stated 'the building had been inspected for a Certificate
of Occupancy for the first time in May, 1979 . Some fairly minor defic-
iencies were found, an d the mostserious violation was the lack af private
bathrooms for all units .
There followed a discussion on the merits of granting a waiver in this tyne
of situation for the period of present ownership only or whether the waiver
should be permanent for the life of the structure. Mr. Reiter felt one
should be restricted to the period of ownership so that a new owner �would
be required to bring the building into code compliance .
Mr. Barthold said such a restriction would make it much more diffiCult to
sell.
BOARD ACTION:
Chairman Wozniak moved that a waiver be granted on Section 54. 11 of the
St . Paul Legislative Code requiring a private b athroom for each dwelling
unit , to permit issuance of a Certificate of Occupancy, on condition that:
(a) No more than a total of six persons occupy the property,
(b) All remaining code violations designated in the city�s letter
of June 4, 1979 , be corrected within 90 days ,
(c) That the above stipulations apply only so long as the build�ing
is operated as a four-unit structure , and
(d) That these conditions be re•corded on -the abstract.
Mr. Glassman se.conded.
Mr. Reiter moved to amend the motion to include the restriction _that the
� waiver be granted only for the period of Mr. Barthold' s ownership. For
lack of a second, the amen dment did not become a part of Chairman Wozniak' s
motion.
MOTION CARRIED AND SO ORDERED.
