An ordinance amending Chapter 60 of the
St. Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, s� 462. 357 and
s� 64.210 of the Legislative Code, Roger Jeska duly petitioned
to rezone Lots 35, 36 and 37, Block 1, Cooper's Addition, located
on the North side of Jenks between Westminster and Arkwright,
from RT-1 Two Family Residential District to RT-2 Townhouse
Residential District, for the purpose of constructing a 4-plex,
the petition having been certified by the Department of Finance
and Management Services on March 23, 1979 as having been con-
sented to by at least 67g of the owners of the area of the
� property to be rezoned, and further having been consented to by
at least two-thirds of the owners of the property situated within
. 100 feet of the total contiguous descriptions of real estate held
by the same owner or any party purchasing any such contiguous
property within one year preceding the date of the petition; and
WHEREAS , The current planning committee on May 3, 1979 con-
ducted a public hearing for the purpose of considering the rezon-
ing petition, and, pursuant to Section 20.03 of the Administrative
Code, submitted its recommendation to the Planning Commission that
the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on May 11, 1979 and recommended that
the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

partly within 350 feet of the property sought to be rezoned; and
WHEREAS, A public hearing before the City Council, having been
conducted on July 24, 1979 where all interested persons were heard,
and the Council having considered all the facts and recommendations
concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section i.
That the zoning map of the City of Saint Paul, Map No. 13,
as incorporated by reference in Section 60. 401 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the North side of Jenks
between Westminster and Arkwright, being more
particularly described as Lots 35, 36 and 37,
Block l, Cooper's Addition, be and is hereby
rezoned from RT-1 Two Family Residential District
to RT-2 Townhouse Residential District.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Madam:
This is written in response to the petition of Roger Jeska to rezone property
located on the north side of Jenks between Westminster & Arkwright from R-1
(Two-Family Residential ) to RT-2_ (Townhouse Residential), in order to construct
a four-unit dwelling.
This matter was heard before the Current Planning & Zoning Committee at a public
• hearing on May 3, 1979. The applicant was present. A letter and a petition with
11 signatures were received in Qpposition. Major:concerns were increased density
and traffic congestion. No letter or input was received from District 5 on this
matter. It was noted during the course of the hearing that the building plan
� submitted could not be constructed without variance, since it exceeded the number
of allowable rooms relative to site size. Staff recorrnnended approval of the
rezoning request and the Current Planning & Zoning Commit�ee, on a 5 to 0 vote,
concurred with the staff recommendation based on the fact that the proposed
developme�it is not inconsistent with the Comprehensive Plan and the �ending
District 5 Plan, and that rezoning the site would likely help in revitalizing
the neighborhood.
On May 11 . 1979 the Planning Corr�nission unanimously confirmed the recorr�nendation of
the Current Planning & Zoning Corr�nittee on a 17 to 0 vote. .
The City Council has scheduled a public hearing on this matter. for July '24, 1979.

ROGER JESKA (#8429) : An application to rezone from RT-1 (1 & 2 Family) to RT-2 (Townhouse)
in order to construct a 4-plex on the north side of Jenks between l�Jestminster & Arkwright.
The applicant was present. There was no opposition present at the hearing.
. �4r. Jung showed slides of the site and reviewed his staff report with a recommendation of
approval for the rezoning request.
Mr. Levy asked if any information had been received by the district council on this matter
and P•1r. Jung said the district had been notified and he had telephoned to see if they had .
an official position on the rezoning, but had been told "most likely not";
� Mr. Jung explained that the house would be 50 ft. wide and the lot 75 ft. wide, so there
would be room to take care of the 3 to 4 ft. slope of the site. He presented a site plan
to the Committee and noted a letter in opposition received from Mrs. Hilda C. Strand
of 398 Jenks St. He also noted receipt of a petition against the proposal with 11
signatures.
Mr. Straughn advised that three single faciily houses could be built on three individual
lots or one duplex, because they are lots of r•ecord, if they meet conditians of the
Zoning Ordinance. He said two duplexes could not be built on this site.
�•1r. Pangal raised the question of spot zoning and asked P1r. Jung's opinion. htr. Jung said
there is no definition of spot zoning in th� ordinance and that in this case it would be
a matter of interpretation.
Mr. Straughn said the term spot zoning is usually used in cases when the court wants to
overturn something, and the court generally looks to 1 ) conformance with the Comprehensive
Plan (district plan), 2) �vhether it is a small or large parcel , and 3) whether the �
zoning was done for the benefit of the community as a whole rather than for the benefit of
the individual developer.
Roger Jeska, the applicant, 1329 E. Co. Rd. C, said the letter of opposition from 398
Jenks Street was from an individual with a day care center.
There being no further public testimony, P1r. Bryan closed the public hearing.
� In response to a question from P1s. Karns as to whether District 5 has a district plan, Mr.
� Pangal informed her that they did not.
P�r. Pangal then moved to recommend approval of the rezoning request based on the fact that
the deveJ�opr��ent of these lots would benefit the neighborhood, because no one is going to
come in and build three single famiay homes on those lots. He said the rezoning would help
revitalize the neighborhood to some extent and also the district. He said his motion
took into effect the fact that District 5 had been notified and had not responded.

P1r. Fitzgibbon said that he wondered how much harm was done in defining the decline or
revitalization of neighborhoods, with the present transitional character of neighborhoods_
P4r. Levy said that compared with the word "blighted" , P1r. Fitzgibbons' comment was soft.
He did not think this could be called spot zoning and the fact that the neighborhood is
transitional does not mean anything.
Mr. Straughn said the developer has a few problems: The parcels are less than 10,000 sq.
ft. and this should be brought to the Board of Zoning Appeals. The number of rooms should
be 8 instead of 10.
P1r. Pangal 's motion to recommend approval was seconded by h1r. Levy and passed on a 5 to Q
roll call vote. •

Dear Madam:
This is written in response to the petition of Roger Jeska to rezone property
located on the north side of Jenks between Westminster & Arkwright from R-1
(Two-Family Residential ) to RT-2 (Townhouse Residential) , in order to construct
a four-unit dwelling.
This matter was heard before the Current Planning & Zoning Committee at a public
hearing on May 3, 1979. The applicant was present. A letter and a petition with
11 signatures were received in opposition. Major concerns were increased density
and traffic congestion. No letter or input was received from District 5 on this
matter. It was noted during the course of the hearing that the building plan
submitted could not be constructed without variance, since it exceeded the number
of allowable rooms relative to site size. Staff recommended approval af the
rezoning request and the Current Planning & Zoning Committee, on a 5 to 0 vote,
concurred with the staff recommendation based on the fact that the proposed
development is not inconsistent with the Comprehensive Plan ,and the pending
District 5 Plan, and that rezoning the site would likely help in revitalizing
the neighborhood.
On May 11 , 1979 the Planning Commission unanimously confirmed the recommendation of
the Current Planning & Zoning Committee on a 17 to 0 vote.
The City Council has scheduled a public hearing on this matter for July '24, 1979.

ROGER JESKA (#8429): An application to rezone from RT-1 (1 & 2 Family) to RT-2 (Tawnhouse)
in order to construct a 4-plex on the north side of Jenks between 4Jestminster & Arkwright.
The applicant was present. There was no opposition present at the hearing.
t4r. Jung showed slides of the site and reviewed his staff report with a recommendation of
approval for the rezoning request.
P�1r. Levy asked if any information had been received by the district council on this matter
and P�1r. Jung said the district had been notified and he had telephoned to see if they had
an official position on the rezoning, but had been told "most l�ikely not".
� Mr. Jung explained that the house would be 50 ft. wide and the lot 75 ft. wide, so there
would be room to take care of the 3 to 4 ft. slope of the site. He presented a site plan
to the Committee and noted a letter in opposition received from Mrs. Hi1da C. Strand
of 398 Jenks St. He also noted receipt of a petition against the proposal with 11
signatures. �
Mr. Straughn advised that three single far:�ily houses could be built on three individual
lots or one duplex, because they are lots of record, if they meet conditions of the
Zoning Ordinance. He said two duplexes could not be built on this site.
t•1r. Pangal raised the question of spot zoning and asked P1r. Jung's opinion. htr. Jung said
the�re is no definition of spot zoning in th� ordinance and that in this case it wauld be
a matter of interpretation.
Mr. Straughn said the term spot zoning is usually used in cases when the court wants to
overturn something, and the court generally looks to 1 ) conformance with the Comprehensive
Plan (district plan) , 2) whether it is a small or large parcel , and 3} whether the -
zoning was done for the benefit of the community as a whole rather than for the benefit of
the individual developer.
Roger Jeska, the applicant, 1329 E. Co. Rd. C, said the letter of opposition from 398
Jenlcs Street was from an individual with a day care center.
There being no further public testimony, P1r. Bryan closed the public hearing.
In response to a question from P9s. Karns as to whether District 5 has a district plan, Mr.
�~ Pangal informed her that they did not.
P�r. Pangal then moved to recommend approval of the rezoning request based on the fact that
the deve]�opr��ent of these lots would benefit the neighborhood, because no one is going to
come in and build three single family homes on those lots. He said the rezoning would help
revitalize the neighborhood to some extent and also the district. He said his motion
took into effect the fact that District 5 had been notified and had not responded.

Ftr. Fitzgibbon said that he wondered how much harm was done in defining the decline or
revitalization of neighborhoods, with the present transitional character of neighborhoods.
Mr. Levy said that compared with the word "blighted", P4r. Fitzgibbons' comment was soft.
He did not think this could be called spot Zoning and the fact that the neighborhood is
transitional does not mean anything.
Mr. Straughn said the developer has a few problems: The parcels are less than 10,000 sq.
ft. and this should be brought to the Board of Zoning Appeals. The number of raoms should
be 8 instead of 10.
P1r. Pangal 's motion to recommend approval was seconded by htr. Levy and passed on a 5 to 0
roll call vote.

A. SUFFICIENCY: The applicant's request for rezoning was filed on a consent petition form
subscribed & sworn to before a notary public on 3-12-79, declared sufficient by the Finance
Dept. on 3-23-79, and received i�1 the Planning Office on 4-2-79. 30 parcels wer eligible;
20 signatures were needed and 21 were obtained.
B. PURPOSE: The petitioner requests rezoning of three adjacent lots from RT,1 (Twa Family-
Residential ) to RT-2 (Townhouse-Residential) in order to construct a 4-plex.
E. F�ONTAGE & AREA: The three interior lots have a combined frontage of 75 ft. , a depth of
about 125 ft. and a total area of about 9,375 sq. ft. Ldith, alley, the total site wou�d
be 10.,125 sq. ft. ��
D. SITE CONDITIONS: The three lots are vacant of development and plantings. Lot 37 is about
5 ft. above street grade and slopes downward to the west. There is part of a retaining
�wa11 in place in front of Lot 37. Alley access is provided along the rear and there is a
partial fence along the alley.
E. AP.EA CONDITIONS: The surr-ounding area is solidly built up with older, single and two family
structures. New single family dwellings have been bui,lt i,n the neighborhood to the west
and north. Nearest higher use areas are the RM-1 zone on the west side of Westminster
and the RM-2 zone about 200 ft. distance to the northeast on the same block. East Consoli-
dated Elementary School is situated about a half block east, on the east side of Arkwright.
Both Arkwright and Case Avenue, a block south, are moderately busy thoroughfares. I-35E
is two blocks west of the site.
F. FINDINGS:
1 . Applicant proposes to construct a split entry, wood framed 4-plex on the three lots
that would be 50' x 33' . Six off-street parking spaces would be provided off the.alley
in the rear.
2. This is currently the only vacant parcel in the neighborhood.
3. Applicant is limited to developing a duplex on the 75 ft. wide parcel which is somewhat
excessive. Single family development would not be economically justified.
4. While the request for rezoning could be construed as spot ioning, the transitional
character of this immediate neighborhood would appear to be suited for developing a
use such as proposed. Recent enlargements of nearby multiple family districts suggest
that such a development would be in keeping with this changing trend.
5. Applicant also owns the existi�g single family dwelling adjacent on the west.
6. The district plan ictentifi�s tr��is as a t�.ansit��r.a' res���nt��1 neighhorhoad.

7. The 1963 Comprehensive Land Use Plan shows this block to be basically 1 and 2 family
residential , but could include town or rowhouses with a maximum of 15 units/acre.
