RESOLVED, that upon execution and delivery of a release
in full to the City of Saint Paul, the proper City Officers are
hereby authorized and directed to pay out of the Tort Liability
Fund 09070-51.1-424, to: Karen King and A. Keith Hanzel, her
attorney, the sum of $4,500.00 in fu7.l settlement of her claim
for damages sustained on or about April 23, 1977 as more particularly
set out in .a communication to the City Council on June 14, 1977.

RE: Claim against the City of St. Paul by Karen King
Claimant, Karen King, brought a lawsuit against the City of
Saint Paul and several police officers for damages which she
allegedl.y sustained following a high speed auto chase. The
cl.aimant was a passenger in a car being pursued by law enforce-
ment officers from several agencies when it went out of control
and landed upside down in a shallow lake near New Brighton,
Minnesota, The driver was not apprei�ended but the plaintiff
was taken from the car by St. Paul Police Officers. She claims
she was assaulted by them, falsely arrested and imprisoned because
she did not identify the driver. The defendants deny any
assault occurred and claim that plaintiff aided the driver by
serving as a lookout, giving him directions during the chase.
The jury found general damages against the officers totaling
$2, 500, punitive damages totaling $550 and general damages
against the City of 5t Paul for $3, 050.
The City of Saint Paul appealed the judgment to the Minnesota
Supreme Court alleging that the jury forms were improper and
there was no separate liability on the City as employer of the
individual police officers. The City of Saint Paul has entered
into a settlement with the claimant for the sum of $4, 500 and
the appeal has been withdrawn. This office approves the
settlement of this claim.
