AGREEMENT THIS AGREEMENT is made and entered into this day of , 1979, by and between the CITY OF SAINT PAUL, Minnesota, a municipal corporation, hereinafter referred to as "City" , and the MINNESOTA VIKINGS FOOTBALL CLUB, a Corporation, hereinafter referred to as "Vikings", for the leasing of Midway Stadium- a/k/a Saint Paul Municipal Stadium, hereinafter referred to as "Stadium", subject to the following terms and conditions: 1. That this agreement shall become effective on September 1, 1979, and shall terminate July 31, 1980. 2. That for the use of the Stadium, as set forth herein, the Vikings shall pay to the City the sum of Eight Thousand Dollars ($8,000.00) on or before September 30, 1979. 3. That during the term of this agreement, the Vikings shall have the full use and enjoyment of the playing field, locker rooms, coachs' room, showers, and adequate equipment storage at the Stadium. The City agrees to have stadium personnel cooperate in all ways to insure the maximum use of the aforementioned stadium facilities for the Vikings. The City and Vikings acknowledge the primary purpose of the Vikings ' use of the Stadium k�ill be as a practice and training area for its members and staff. 4. That the Vikings agree to provide, in any manner, twenty-four (24) hours' notice to the Stadium's management each time the Vikings wish to use the Stadium. Such notice will provide an adequate opportunity for the Stadium personnel to remove any obstacles to the Vikings' use of the Stadium. 5. That the Vikings agree to yield its use of the Stadium's facilities at such times as city high school teams are engaged in football games at the Stadium. ... ,,, •� , . 6. That the City shall be responsible for the restoration of the playing field of the Stadium to the condition of the same existing at the inception of the Vikings' use thereof. The cost of such restoration shall be borne by the City. 7. That the Yikings agree to indemnify, save and hold harmless the City from any and all claims of liability for injury, death, or property damage while making use of Stadium facilities or while Viking equipment is stored at the Stadium. The Vikings further agree to pay the City for any and all damage to Stadium facilities caused by the Vikings while making use of the Stadium under this agreement. " 8. That in order to carry out the preceding paragraph of this agreement, the Vikings agree to furnish to the City Attorney of the City, no later than September 1, 1979, evidence of public liability insurance, as well as Workmen's Compensation Insurance covering the period of this agreement. The City shall be named as co-insured on all insurance policies mentioned herein. 9. That the City agrees that upon the demand of the Vikings ' coach or management, the Stadium shall be closed to any and all members of the public whlle the Vikings are making use of its facilities, exclusive of regular Stadium person- nel .
