2 WHEREAS, the Saint Paul Heritage Preservation Commission (the "HPC"), on
3 September 6, 2001 denied a demolition permit application by Comerstone Group with Sherman
4 Rutzik & Assoc. to teaz down a building known as the Wells Fargo building (together with an
5 adjacent storage building) located on properry commonly know as 267-271 East Kellogg
6 Boulevard for the purpose of providing covered pazking for new condominium units to be
7 conshucted in the nearby J.J. Hill building. The said buildings are located within the Lowertown

Historic District; and
WHEREAS, pursuant to the provisions of Saint Paul Legislative Code § 73.06(h),
Cermack Rhoades Architects duly filed an appeal from the HPC decision with the Saint Paul City
Council and requested a pubiic hearing on the matter of the HPC's decision; and
WHEREAS, the matter was duly set for public hearing before the City Council on
October 3, 2001, at which time the matter was laid over untii October 24, 2001; and
WfIEREAS, the financing mechanisms for building covered parking for the J.J. Hill
building condominium project are not entirely finalized and may require action by the Housing
and Redevelopment Authority to do so and that under these extenuating circumstances, the
viability of the project is yet to be determined. Therefore, a demolition permit may not be
needed;and
WHEREAS, the financing mechanisms far building covered parking for the J.J. Hill
building condominium project should be resolved before the City Council acts upon the decision
of the HPC to deny the Comerstone Group with Sherman Rutzik & Assoc. application to
demolish the Wells Fargo building; NOW, THEREFORE,
BE IT RESOLVED, for the reasons noted above, that the matter of the appeal by
Cermak Rhoades Architects, of the HPC decision to deny a demolition permit for the structure at
267-271 East Kellogg Boulevard, is hereby extended for a sixty (60) day period from the date of
the adoption of this resolution; _.
