That the petitioner's, their successors and assigns shall pay $ 00.00 as an administrative fee for 13 this vacation which is due and payabie within 60 days of t e effective date of this resolution. 14 15 2. 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 That a permanent utility easement shali be retained o, over, under and across the vacated area on behalf of the City of Saint Paul, Department of P blic Works to reserve the right of the City to accommodate storm water overflows from the re aining public alley within said Block 2, Hopkins Addition, dealing with overflows in vacated azea would be the responsibility of the petitioner, its successor and assigns. The existing storm and sanitary sewers i e alley will also require the retention of the above mentioned utility easement. No buildin would be permitted over these lines. To build over the vacated area will require said sewers be rerouted at the expense of the petitioner, their successors of assigns. Plans for any erouting sewers wili have to be approved by Public Works. The following restrictions shall�pply to the above-referenced easements: a. No buildings, structures, r trees are permitted within the easement area nor any temporary structure, material storage ixture, ar other objects that will prohibit normal drainage flow or access to utility facilities/for maintenance purposes: b. 7mprovements in r upon the easement area that do not prohibit the City from exercising its reserved rights ma e allowed by obtaining written pernussion from the Department of Public Works Sewer D' ision with the understanding that the restoration and costs of such improvements all be the sole responsibility of the petitioner, its successors and assigns, in the event the C' exercises its reserved easement rights. c. No c ange from the existing grade is pernutted within the easement azea without the written pe sion from the Department of Public Warks Sewer Division. d. Depending on the capacity of any proposed parking facility, the petitioners, their successors and assigns may be asked to participate in the funding of intersection signalization. oi-��y7 1 3. That a permanent utility easement shall be retained on, over, under and across the vacat area to protect the interest of District Energy of Saint Paul. Any relocation of District Ener acilities will be at the cost of the petitioners, its successor and assigns. Said relocation of istrict Energy facilities will be completed by Distsict Energy, its agents and its designated co actors. That the petitioners, their successors and assigns agree to indemnify, def d and save harmless the City of Saint Paul, its officers and employees from all suits, acuon or claims of any chazacter brought as a result of injuries or damages received or sustained by person, persons or property on account of this vacation or petitioners' use of this pr erty, including but not limited to, a claim brought because of any act of omission, negleci, or 'sconduct of said petitioners or because of any claims or liability azising from any violation any law or regulation made in accordance with the law, whether by the petitioners or an of their agents or employees. File# 2001-14 East 100' of alley in Blk. 2, �Iapkin's Add. in Block bounded by Kellogg - 4` - Wacouta - Wall Date: July 26, 2001 R ��EIV�D R �L EST � � ZOO� � rE GrvfSip� p1-Il�t'� The Departrnent of Public Works has completed a review of the above-referenced proposal and has the following comments, requirements and concerns: 1) This proposal would create a situation where possible storm water from the remaining portion of the public alley could overflow onto the private/vacated portion of the alley. Therefore, we woald prefer the entire alley were vacated and cross easements for access, etc, granted to all abutting property owners. Otherwise, we would at least need to retain a drainage easement through the ramp area to accommodate possible storm water overflows from the alley. Dealing with overflows would be the responsibility of the parking ramp owners, not the City. 2) The vacation would also have an impact on alley access for other property owners in this block who cunently use the alley. We would not be in favor of this vacation without the support of other property owners in this block. 3) There are existing storm and sanitary sewers in the alley which would require full width easements to be retained. No building would be pemutted over these sewer lines. These sewers would need to be rerouted in order to build over this portion of the alley. Depending on the parking ramp capacity, the project may be asked to participate in the funding of intersection sib alization. 5) It is against department policy to allow storm water retention in the public right-of-way such as the holding tank beneath the sidewalk as shown on their preliminary site plan. The petitioner should investigate the feasibility of constructing the tank on private property beneath the ramp.
