An Ordinance amending Chapter 60 of the
St. Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, � 462. 357 and
� 64.210 of the Legislative Code, Home Federal Savings and Loan
Association duly petitioned to rezone the East 1/2 of Lot 23,
except the west 10 feet thereof, and all of Lots 24, 25 and 26,
and the west 1/2 of Lot 27, Block 2, L. T. Laston's Subdivision
of Lot No. 8 of Kerwins Out Lots, located on the north side of
Hoyt between White Bear and Flandrau from R-3 (One-Family Resi-
dential) to P-1 (Vehicular Parking District) for the purpose of
constructing a parking lot, the petition having been certified
by the Department of Finance and Management Services on October 18,
1978 as having been consented to by at least 670 of the owners of
the area of the property to be rezoned, and further, having been
consented to by at least two-thirds of the owners of the property
situated within 100 feet of the total contiguous descriptions of
real estate held by the same owner or any party purchasing any
such contiguous property within one year preceding the date of
the petition; and
WHEREAS, The current planning committee on November 16, 1978
conducted a public hearing for the purpose of considering the re-
zoning petition, and, pursuant to Section 20. 03 of the Administra-
tive Code, submitted its recommendation to the Planning Commission
that the petition be granted; and
WHEREA5, The Planning Commission considered the rezoning
petition at its meeting held on November 17, 1978 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezonin etition was dul u d in the official

zoned; and
WHEREAS, A public hearing before the City Council, having been
conducted on December 21, 1978 where all interested persons were
heard, and the Council having considered all the facts and recom-
mendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 7,
as incorporated by reference in Section 60. 401 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the north side of Hoyt Avenue
between White Bear and Flandrau, being more particularly
described as the East 1/2 of Lot 23, except the west 10
feet thereof, and a11 of Lots 24, 25 and 26, and the
west 1/2 of Lot 27, Block 2, L. T. Laston's Subdivision
of Lot No. 8 of Kerwins Out Lots, be and the same is
hereby rezoned from R-3 (One-Family Residential) to
P-1 (Vehicular Parking District) .
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Madam:
This letter is written in reponse to the petition of Home Federal Savings and
Loan to rezone property located on the north side of Hoyt between White Bear
and Flandrau from R-3 (Single Family Residential ) to P-1 (Parking), for
the purpose of expanding the off-street parking lot for Home Federal Savings
and Loan at 1563 White Bear Avenue.
This matter was heard before the Current Planning and Zoning Committee on
November 18, 1978. There was one letter in support and one letter in opposition;
no one appeared at the hearing in opposition. Staff recommended approval of
the rezoning request and the Current Planning and Zoning Coamittee also recomnended
approval on a vote of 5 to 2 based on the findings that the site was previously
zoned Comnercial ; that the proposed use falls within the general intent of a
P-1 zone; that the P-1 specifies safeguards to adjoining residential use;
and that the paved parking area would not significantly contribute to run-off
problems associated with the general area.
The Committee further found that the south side of the parcel fronting on Hoyt
be considered a side yard and meet the R-3 side yard requirements. The Corr�nittee
approved the site plan as submitted indicating a side yard setback of 11 '-6".
On November 17, 1978 the Planning Commission approved the rezoning and the
submitted site plan, on a vote of 12 to 4 with 1 abstention.
The City Council has scheduled a public hearing on this matter for December
21 , 1978.

The applicant was present. There was no opposition present at the hearing.
Donna McNeally showed slides of the sub�ect site and reviewed the staff report with a
recommendation of aPproval for the rezoning request.
Mr. N.W. Graff, 4040 IDS Bldg. , Minneapolis. represented Home Federal Savings & Loan./
He said the purpose of the rezoning is to upgrade and expand parking for use by the
banking facility because parking has been inadequate and has lead to sane street use
on busy nights.
Mr. Dave Shea, 903 Farmers & Mechanics Bldg. , Minneapolis, an architect, presented a
revised site plan and described it to the Comnittee.
There being no further testimony, the public hearing was closed.
Gayle Summers asked if runoff had been taken into consideration by Public Works, and
Donna McNeally said it had.
A letter in opposition, from R.A. Melander, 1728 E. Hoyt Avenue, was read by Donna
McNeally, as well as a letter in support of the rezoning received from Ken Krahn of
1756 East Iowa.
Gayle Summers then moved to recortmend approval of the rezoning request. Her motion was
seconded by Mr. Fitzgibbon. The motion included a provision that the revised site plan
be presented and also removal made of one parking space.
Mr. Amey questioned the southern boundary of the property, asking if it were to be
considered a sideyard abutting a residential or front yard. A discussion followed
resulti�g in a determination that the yard fronting on Hoyt be considered a sideyard
rather than a front yard; therefore , the sldeyard r.equirement of 4 ft. would have to
be met.
The site plan was then given to Donna McNeally. The motion was amended to include the
11 '-6" sideyard setback. and passed on a 7 to 0 roll call vote.

The applicants' request was filed on a Consent Petition subscribed and sworn to before
a Notary Public on September 6, 19�8 and October 5, 1978, and declared sufficient by
the Finance Department on October 18, 1978 and received by the Planning Office on
October 26, 1978; 21 parcels were etigible; 14 were needed; 14 were obtained.
B. HISTORY: �
In November 1977, a short form petition to rezone from R-3 to B-3 was filed and withdrawa.

C. PURPOSE:
The petitioner requests rezoning from R-3 (single family) to P-1 (parking) in order to
expand and upgrade parking lot for Home Federal Savings and Loan at 1563 White Bear Avenue.
D. FRONTAGE AND AREA:
The site has 140' frontage on Hoyt and is 130' deep for a total area of 18,200 square feet.
E. SITE CONDITIONS:
The site is level and vacant. Ad,jacent to the north are an apartment and an office
building; adjacent to the east is the Home Federal Saving and Loan and parking lot.
Abutting across Hoyt, and adjacent to the west, are single family houses. White Bear
Avenue is 1/2 block to the east. There is an alley which ends at the northeast corner
of the property.

G. FINDINGS:
1. The 1963 Compreh�nsive Land Use Plan identifies th�s site as residential with
adjacent comnercial use fronting on White Bear Avenue.
2. The site was pr viously zoned commercial. �
3. The 1976 Comner ial Land Use Stuc�y documented the area of Hoyt and White Bear as
deficient in of -street �arking.
4.- The pr_4posed use falls within the stated intent of P-1 (Vehicular Pariciny District)
which "is intended to permit the establishment of offstreet parking lots to be used
solely for offstreet parking of private passenger vehicfi�s as a use incidentai to
a principal use. The district will serve a use district which has tieen develo�e�
__with out adequate offstreet parking."
5. The P-1 is St. Paul`,'s most restrictive zoning district; parking is the only
permitted use.

6. Section 60.573 contains the required conditions intended to protect adjacent
residential use:
The P-1 must be accessory to a business in an adjoining zoning district.
The P-1 lot may only be used during business hours of operation; at
other times it must be inaccessible to pu6lic use.
No building may be erected on the P-1 , except an attendant's shelter.
A 4'6" obscuring fence is required between P-1 and residential use.
Lighting must be arranged to reflect light away from residential property.
P-1 must meet front yard setback requirements in adjoining residential
zones; a wall must be erected at tf�e setback line. A setback of 25' is
required in an R-3 zone.
7. The proposed use cteveloped under these standards should provide a buffer between
business and single family residential uses.
8. According to Public Works, the square footage of blacktop is insignificant in terms
of storm water run off, etc.
H. STAFF RECOMMENDATION:
Based on Findings 2-8, Staff recommends approval of the rezoning.

6. Section 60.573 contains the required conditinns intended to protect adjacent
residential use:
The P-1 must be accessory to a business in an adjoining zoning district.
The P-1 lot may only be used during business hours of operation; at
other times it must be inaccessible to pu6lic use.
No building may be erected on the P-1 , except an attendant' s shelter.
A 4'6" obscuring fence is required between P-1 and residential use.
Lighting must be arranged to reflect light away from residential property.
P-1 must meet front yard setback requirements in adjoining residential
zones; a wall must be erected at tf�e setback line. A setback of 25' is
required in an R-3 zone.
7. The proposed use developed under these standards should provide a buffer between
business and single family residential uses.
8. According to Public Works, the square footage of 6lacktop is insignificant in terms
of storm water run off, etc.
H. STAFF RECOMMENDATION:
Based on Findings 2-8, Staff recommends approval of the rezoning.

The Council of the City of St. Paul will hold a public hearing in the
Council Cha�bers of the City Hall and Court House (third floor) at
10:00 a.m. on December 21, 1978 on the:
Petition of Home Federal Savings and Loan Association to
REZONE property at 1563 North White Bear Avenue from R-3
to P-1. The property is located on the north side of East
Hoyt Anenue between Flandrau and White Bear Avenues, being
described as: the south 44 feet of Lots 28, 29, 30 and
the east 2 of Lot 27, also the east � of Lot 23, except the
west 10 feet, all of Lots 24, 25, 26 and the west � of Lot
27, Block 2, L. T. Lawton's Subdivision of Lot 8 of Kerwin's
Outlots.

, An Ordinance amending Chapter 60 of the
St. Paul Legislative Code pertaining to
' zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, $ 462. 357 and
s� 64.210 of the Legislative Code, Paul L. Gonia duly petitioned
to rezone the north 50 feet of Lots 12 through 15 , inclusive,
Block 2, Birmingham' s Park, located on the south side of Sims
Avenue between White Bear Avenue and Flandrau Street from R-4
(One-Family Residen�tial) to RT-1 (Two-Family Residential) for the
purpose of converting a single family dwelling into a duplex, the
petition having been certified by the Department_of Finance and
Management Services on October 25, 1978 as having been consented
to by at least 67� of the owners of the area of the property to
be rezoned, and further, having been consented to by at least
two-thirds of the owners of th'e property situated within 100 feet
of the total contiguous descriptions of real estate held by the
same owner or any party purchasing any such contiguous property
within one year preceding the date of the petition; and
WHEREAS, The current planning committee on November 16, 1978
conducted a public hearing for the purpose of considering the re-
zoning petition, and, pursuant to Section 20. 03 of the Administra-
tive Code, submitted its recommendation to the Planning Commission
that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on November 17, 1978 and recommended
that the City Council approve the petition; and

WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official
newspaper of the City on December 9, 1978 and notices were duly
mailed to each owner of affected property and property situated
wholly or partly within 350 feet of the property sought to be re-
zoned; and
WHEREAS, A public hearing before the City Council, having
been conducted on December 21, 1978 where all interested persons
were heard, and the Council having considered all the facts and
recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 15,
as incorporated by reference in Section 60. 401 of the Saint Paul
Legislative Code, as amended, is hereby further amended as
follows:
That property located on the south side of Sims
Avenue between White Bear Avenue and Flandrau
Street, being more particularly described as
the north 50 feet of Lots 12 through 15, inclusive,
Block 2 , Birmingham' s Park, be and is hereby re-
zoned from R-4 (One-Family Residential) to RT-1
(Two-Family Residential) .
