An Ordinance amending Chapter 60 of the
St. Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, s� 462. 357 and s� 64.210
of the Legislative Code, People, Inc. duly petitioned to rezone the
westerly 263.23 feet of part oftthe southeast quarter of the north-
west quarter of the northeast quarter northerly of Ames Avenue, in
Section 27, Township 29, Ra�ge 22, located on the north side o� Ames
Avenue between Hazelwood and Kingsford, also known as 1599 Ames
Avenue, from R-3 to �2T-1 for the purpose of constructing and oper-
ating a community residential facility for 32 nonambulatory physically
and mentally handicapped children, the petition having been certified
by the Department of Finance and Management Services on January 16,
1979 as having been consented to by at least 67� of the owners of -
the area of the property to be rezoned; and further having been con-
sented to by at least two-thirds of the owners of the property
situated within 100 feet of the total contiguous descriptions of
real estate held by the same owner or any party purchasing any such
contiguous property within one year preceding the date of the
petition; and
WHEREAS, The current planning committee on February 15, 1979
conducted a public hearing for the purpose of considering the re-
zoning petition, and, pursuant to Section 20. 03 of the Administra-
tive Code, submitted its recommendation to the Planning Commission
that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on February 23, 1979 and recommended
that the City Council approve the petition; and

WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official
newspaper of the City on March 10, 1979 and notices were duly
mailed to each owner of affected property and property situated
wholly or partly within 350 feet of the property sought to be re-
zoned; and
WHEREAS, A public hearing before the City Council, having been
conducted on March 22, 1979 where all interested persons were heard,
and the Council having considered all the facts and recommendations
concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 15,
as incorporated by reference in Section 60. 401 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the north side of Ames
Avenue between Hazelwood and Kingsford, also known
as 1599 Ames Avenue, being more particularly de-
scribed as the westerly 263.23 feet of part of the
southeast quarter of the northwest quarter of the
northeast quarter northerly of Ames Avenue, in
Section 27, Township 29, Range 22, be and is
hereby rezoned from R-3 to RT-l.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Madam: Re: Zoning File No. 8398 - People, Inc.
This is written in response to the petition of People, Inc. to rezone property at 1599
Ames Avenue, located on the north side of Ames between Hazelwood and Kin sford, from
R-3 (Single Family Residential ) to RT-1 (Single & Two-Family Residential}�, for the purpose
of constructing and operating a community residential facility for 32 non-ambulatory,
physically and mentally handicapped children.
This matter was heard before the Current Planning & Zoning Committee of the Planning
Commission on February 15, 1979. There was one letter in support and two persons spoke
in support. There were three letters and a petition containing 55 signatures in
opposition. (The majority of those 55 signatures were property owners outside of the
350 ft. notification area. ) Major concerns expressed were increased vandalism, density
and traffic. After some discussion by the committee, the applicant agreed to revise his
original RM-1 request to RT-1 ; the RT-1 zoning would provide safeguards against any sub-
stantial increase in density as well as provide a buffer between the RM-1 zoned Roosevelt
Housing Project adjacent to the west and single family homes adjacent to the east. Staff
recommended approval of the rezoning request and the Curr.ent Planning & Zoning Committee
also recommended approval on a vote of 5 to 0, based on the findings that the RT-1 zoning
would provide density safeguards, that the proposed facility meets all of the special
condition use requirements for a community residential facility, that District 2 has only
one other community residential facility (The Greenbrier Home at 941 Birmingham) , and
with one exception all of the adjacent property owners within 100 ft. signed the consent
petition.
The committee also approved a Special Condition Use permit for People, Inc. contingent
upon successful rezoning of the property to RT-1 .
On February 23, 1979 the Planning Commission unanimously confirmed the recommendation
of the Current Planning & Zoning Committee for the rezoning, and for grantinq the Special
Condition Use permit contingent upon that rezoning.
The City Council has scheduled a public hearing for this matter on March 22, 1979.

The Corporation was ahle to iiefjt����a two year le,�se with the WiIrIAr Foundation for the use of their Facility at
666 Marshall Avenue. The state issued a temporary I�cense for that two year perio�i with the unde�standing that
every effort would be macie to secure a permanent facility anci an onc�oing program of care for the children.
The faciliry is licensed to accc�mmodate thirty c,hilclren between hirth �inri efghteen years olci. The existing age
range is 19 months to fffteen years old.The occupancy haS cons�sten;ly heen at capac+ty with a waiting list of 12 -
15 children.
All of the children are ��roiouncily or severely mentally retarded ancf have muftipte physicat disabifities.While there
are other community tacilities canng for the mentally retarded, the People's Child Care Residence is the only
community base�i facility programmed to meet the needs of chilciren who are extensively medical}y involved.
A recent survey conducted by Enright fr Associates, for People, Incorporated, has revealed the number of
instances vvhere the need for th�s type of care exists. As reported in the survey, "a totat of 63 children were within
Ramsey County, mcluding those children currently beiny servecl h�; Pfrople, Incorporated. In addition. School
Distnct 916, which is a service unit providing special education tor the suburban Ramsey County school districts,
identified an additional 15 c.hildren who probably will need a residential seniice with medical support.
Profiles have been receivet;from Todd County- 1,Anoka County-?_. S:. f_ouis County- 1,and Washington County-
1. Both Dakota County and Hennepin County have responded in �en�ra! ni�rnber idec�tification, 15-20 children in
Dakota County an�l up to 70 children in Hennepin County."
The children come from socio-economic backgrouncis of great diversi�y; thie;,arer,ts arc business peopte, farmers,
teachers, lawyers, sates people, homemakers, etc. The families are from the 7 counry metro area and outlying
coiinties; one ch�ld is from out of state.
The ma�ority of these children were born with developmental and neurolr�gical disabiht�es, aneJ profound mental
cJisabilities. All are non-ambulatory and experience a high ciegree of seizure activity. Because of the camplexity of
their cfis�ih�lities, all of the chiliiren require inteiisive medical c�re.
Three uf the children were healthy ,3nii normal at birth but suffered �ccidents wh�ch caused brain stem injuries.At
least 50`,'�, of the children are legally blind and many are hearing impaired. Except in the cases where there were
accidents, the causes ot the d�sabilities are unknown.
In most of the families there are no previous instances of retardation; most have normal sibiings. There is no
v�arning or explanation of when, or to whom, mental disabiiities of this nature will occur.
tt can hapE�en in any farnily. The nat�onal figures of retardation st:ite that 3 0 of the population is profoundly
mentally disabled.
The People's Child Care Residence is dedicated to providing total care—physica{, emotional, and social—and to
working closely with families and community agencies throughout the child's treatment.
The concern is not only with the child's disabilities, hut also �vith his!her rehabilitation potential. Individual
treatment goals are est�b(ished through a multi-disciplined team r_orzference for each child.The treatment plan is
develaped based on estimates of the child's conc:ition and grov�th clianges.The goaf is to aim toward the highest
ciegree of functioning possible.
Phys�cc�l and occupational therapists, a dietary consultant, and the medical team�vork together to fulfill treatment
ot��ect�ves. The children receive 24 hour nursing care. The Res��ience employs between 70-80 individuals;
ap��rorimately 50`,'�, of those employees reside in the local comrn�in�ty.
All program costs are covered by Federal, state, local, and private funds. Per diem costs are S54.95.
The �;rogram is firmly basecf on the philosophy that all human befnc��; cieserve every opportunity to live as full and
norm�; a life as pass�ble. I! is the responsibility of each one of us to see that they have that opportunity.

The meeting was chaired by Mr. James Bryan, the Chairman.
PEOPLE, INC. (#8406) : An application for Special Condition Use to operate a fac7lity
for non-ambulatory, mentally and physically handicapped children at 1599 Ames Avenue.
The applicant was present. There was opposition present at the hearing.
Ms. McNeally showed sTides of the subject site and reviewed her staff report, with a
recommendation of approval for the Special Condition Use request.
Inasmuch as the agenda contained a rezoning request f�r• People, Inc. (#8398) , after some
discussion among the members of the Committee, Mr. Segal ruled that both items could be
heard simultaneously, and Mr. Bryan announced this procedure to the audience. .
�P1r. Donald Bump, Executive Director of People, Inc. , whb lives at 1436 Ashland Avenue,
explained that People, Inc. is a Minnesota non-profit organization forrr�ed in 19b9
by a group of six churches, and that the operation has been continued by those churches.
He told of the children with medical problems bein� .hpused on Jackson Street and the
facility being closed in 1975 and 1976; at that tin,e the Department of Public Welfare
approached People, Inc. and asked them to try to continue the program for these children
to prevent their being institutionalized. Their temporary location at 666 Marshall has
served them well , Mr. Sump said, but it is under lease and does not fully meet requirements,
so there is a need to relocate. He said that in December of 1978 members of People, Inc.
�and parents of the children visited homes within a 100 foot perimeter �f their boundary
at 1599 Ames to secure the consent of these people on a consent petition, and they did
receive the required number of signatures. He told how parents and the board members
visited the community at large in January of this year leaving information with residents
regarding their program and information about the rezoning process, and inviting people
to visit their program at 666 Marshall . He answered questions regarding:
a) Why this particular parcel of land? There are needs within the program; the
children must s tay within the city limits of Saint Paul . The children need
to be close to medical resources and within the area of Ramsey County Hospital .
b) Space Needs: 1599 Ames meets the space needs and conforms with zoning
regulations.
c) The Project: People, Inc. wants to maintain a residential appearance. They
will not build a multi story building or anything to detract from the
, neighborhood. There will be offstreet parking. ?ransportation for the
children is provided the same as any other child in Saint Paul 's school
� district with buses morning and evening, and there is also a van.
The children are supervised at alt times, inside and outside.

d) Possible change of ownership: If ownership changes, the Special Condition
Use permit would again have to be considered through a public hearing. Mr.
Bump said People, Inc. is trying to rezone to residential so there will be
no possibility of commercial use coming in. He invited the neighborhood
to furnish a member to serve on the building committee, and said they would
like to have representatives from the community to serve on an advisory
committee and provide liaison with People, Inc.
Ms. McNeally noted a letter received from Roosevelt Homes Resident Council in support
of the rezoning. _
Mr. Glenn E. Clausen, 1659 Ames Avenue, presented a petition with 55 names in opposition,
but neither he nor anyone else would come forward to give reasons for the opposition.
Mr. Levy wanted to know why anyone would not be interested in seeing the facility
development.
Ms. McNeally then gave her findings for the rezoning application.
Mr. Bryan requested that someone testify as for reasons for signing the petition in
opposition, and Mr. Ted Swanson, 1157 Herbert Street, said the Greenbrier Home is
enough of that type of construction in the area.
P1r. Levy explained that the Greenbrier Home is for adult males and that this is a child
care facility for non-ambulatory children, and that Rule No. 34 says these children
must be supervised indivdivally. Mr. Levy said he could not see Mr. Swanson's concern
because the two facilities were not close enough to give a ghetto appearance.

Mr. Swanson then explained his problems with the Ro.osevelt Homes Project and said his
concern is for the future and what might come into th� area as a result of the rezoning.
Ms. McNeally then noted three letters in opposition from property owners within 350 feet.
At this point, Ms. Summers brought up the question of changing the rezoning request to RT-1 .
Ms. McNeally said as far as she could determine there is nothing to prevent it from being
an RT-1 zoning which would permit the requested facility. She said if someone baught
the property as RT-1 , they would have to have duplexes or single family homes, �nd she
said it would be a safeguard for the property.
Mr. Bump said this was the first he had heard of a possible RT-1 zoning and that it would
suit the land use.
Ms. Pat Pfundstein, 1815 Wellesley, said she is a social worker for children and that
the children involved in the People, Inc. project are not people who have been hospitalized,
but are 2 to 14 in age and children with close contacts with their families. She said
she wished everyone in the room would think of the comfort of being able to be close to
his or her disabled child.
Mr. Segal said the committee should be looking at the potential land use and that RT-1
might be more consistent.
' Mr. Pangal moved to have a 10 minute recess during which time the applicant and committee
members could consult regarding the possibility of changing the request to RT-1 . His
motion was seconded and passed by unanimous voice vote.

Mr. Bump returned after the recess and said he understood that an RT-1 zoning would meet
all the needs of People, Inc. and they would be happy to support that request.
Mr. Segal then explained to those present that RT-1 allows only two family construction,
whereas under the original proposal there could have been multiple family. Therefore,
RT-1 would be more restrictive, and Mr. Segal explained that the reason for the original
RM-1 request was to be consistent with the adjacent zoning and continue it. Mr. Sega1
said the amended rezoning request would read R-3 to RT-l .
Mr. Bryan then closed the public hearing.
Ms. Summers moved to recommend approval of the rezoning from R-3 to. RT-1 based on Findings
1 thru 3 and 6 thru 10 of the staff report. Her motion was seconded by Ms. Karns and
passed on a 5 to 0 roll call vote.
Mr. Levy moved to recommend approval of the Special Condition Use based on Findings
l thru 5 of the staff report, contingent upon successful rezoning of the subject site �
to RT-1 . His motion was seconded by Ms. Summers and passed on a 5 to 0 roll call vote.

The City Council, at its regular meeting held on March 22, 1979,
voted to grant the petition of People, Inc. to rezone their
property at 1599 Ames Avenue from R-3 to RT-1 so as to permit the
use of the property for a community residential facility for 32
nonambulatory physically and mentally handicapped children, subject
to the condition that the owners of the property agree that any
change of use to another use which would require a special condition
use permit would first require the approval of the St. Paul City
Council in addition to the approvals of the Planning Commission or
other agencies. I have discussed this with Ernest Cutting, attorney
for People, Inc. and he has advised me that his clients will file
such a deed of negative easement containing this provision for City
Council approval of change of special condition use, and provide a
copy of this deed to the City Clerk and our office.
I have prepared the ordinance requested by the City Council which
would accomplish the rezoning approved by the City Council at its
March 22nd meeting. Please advise our office if you would require
that the deed of negative easement be filed prior to the adoption
of this ordinance and if so, I will contact Mr. Cutting and submit
thislrequest.

Dear Mr. Cutting:
The City Council at its meeting on March 22, 1979 voted to grant
the petition of People, Ine, to rezone their property at 1599 Ames
Avenue from R-3 to RT-1 for the purpose of permitting the operation
of a community residential facility for physically and mentally
handicapped children, subject to the understanding that People, Inc.
would file a restriction on their property which would prohibit the
use of the property for any other use permitted by the zoning code,
which use requires a special condition use permit unless the City
Council should approve the change in such use. It is my understand-
ing that your client is willing to file such a covenant that would
run with the land and be in favor of the adjacent property owners.
I have examined our office files to attempt to locate such a deed
of negative easement, and the only one I could find is very old
and a weak copy that you may wish to adapt for your purposes. 2
am enclosing a copy of this for your use.
I am now sending the proposed ordinance to the City Council for
their consideration and adoption. It is my understanding that you
will prepare such a deed of negative easement and after filing it
with the County Recorder, provide a copy of it to the City Clerk
and our office. I would appreciate having the opportunity to review
the draft of negative easement prior to its recording. If you have
any questions, please feel free to call me. I am enclosing for
your information a copy of the proposed ordinance.

This is written in response to the petition of People, Inc. to rezone property at 1599
Ames Avenue, located on the north side of Ames between Nazelwood and Kin sford, from
R-3 (Single Family Residential ) to RT-1 (Single & Two-Family Residential�, for the purpose
of constructing and operating a community residential facility for 32 non-ambulatory,
physically and mentally handicapped children.
This matter was heard before the Current Planning & Zoning Committee of the P)anning
Commission on February 15, 1979. There was one letter in support and two persons spoke
in support. 7here were three letters and a petition containing 55 signatures in
opposition. (The majority of those 55 signatures were property owners outside of the
350 ft. notification area. ) Major concerns expressed were increased vandalism, density
and traffic. . After some discussion by the committee, the applicant agreed to revise his
original RM-1 request to RT-1 ; the RT-1 zoning would provide safeguards against any sub-
stantial increase in density as well as provide a buffer between the RM-1 zoned Roosevelt
Nousing Project adjacent to the west and single family homes adjacent to the east. Staff
recommended approval of the rezoning request and the Current Planning & Zoning Committee
also recommended approval on a vote of 5 to 0, based on the findings that the RT-1 zoning
would provide density safeguards, that the proposed facility meets all of the special
condition use requirements for a community residential facility, �hat Distrfct 2 has only
one other community residential facility (The Greenbrier Nome at 941 Birmingham) , and
with one exception all of the adjacent property owners within l00 ft. signed the consent
petition.
The committee also approved a Special Condition Use permit for People, Inc. contingent
upon successful rezoning of the property to RT-1 .
On February 23, 1979 the Planning Commission unanimously confirmed the recommendation
of the Current Planning & Zoning Committee for the rezoning, and for granting the Special'
Condition Use permit contingent upon that rezoning.
The City Council has scheduled a public hearing for this matter on March 22, 1979.

The Cor;�oration was able to�netjqt��ti�.•a two year lease with the Wilder Foundation for the use of their facility at
666 Marshall Avenue. The state issiied a temporary I�cense for that two year period with the understanding that
every effort would be made to secure a permanen; facility and �n onc�oing program of care for the children.
The (ac�lity is licensed to accommodate thirty r,hildren between t>�rth �tnci eighteen years old_ The existing age
range is 19 months to fifteen years old.The occupancy has consistently heen at capacity with a waiting list af 12-
15 chilciren.
AU of the children are E�r�foundly or severely mentally ret�rdeci and h�ive multipte physica!disabi(ities.While there
are other community tacilities canny for the mentally retarded, the Peopfe's Child Care Residence is the only
community basPcf facility programmed to meet the needs of chilciren �vho are extensively medically involved.
A recent survey conducted by Ennyht b Associates, for People, Incorporated, has revealeci the number of
ins;anc,es where the ne.ed for th�s type of care exists. As reported in the survey. "a tota.t of 63 children were within
Ramsey County, inc�udiny those children currently beiny serveci hy People, Incorporated. In addition, Scho�t
District 916,which is a service unit providing spec�al education tor the suburban Ramsey Counry school districts.

Tt�e cMldren come from socio-economic backgrounds of great diversi'y; th�parents are business people,farmers,
teachers. lawyers, sales people, homemakers, etc. The families are from the 7 county metro area and outlying
counties: one chilci is from out o( state.
The nia�ority of these chitdren were born with developmental anci neuroloyical disabi!�ties, and profound mental
disab�lit�es. All are n�n-ambu�atory and experience a high degree of seizure activity. Because of the complexity of
their cfisabilities, aIl of tlie chi{�iren re�uire intensive medical carc.
Three of the children were healthy and normal at birth btrt suffered accidents which caused brain stem injuries. At
least 50°;, of the ch�lciren are legally blind and many are hearing inipaired. Except in the cases where there were
acc�dents, the causes of the d�sabilities are unkno�vn. '
In most of the fam�lies there are no previous instances of retardation; most have normal sibtings. There is no
�varning or explanat�on of when, or to whom, mental disabilities of this nature will occur.
I: can happen in any farnily. The national figures of retardation state that 3% of the populatiQn is profoundly
mentally disabled.
Ti�e People's Child Cara Residence is dedicated to providing tosal care—physical, emofional, and socia)—and to
vrorking closely w�th families and commun�ty agencies througtiout the chflci's treatment.
7he .concern is not only with the child's disab�lities, but afso �.^r�th his/her rehabilitat+on potential. Individual
treatment goals are established through a multi-disciplined team r.onference far each child.The treatment plan is
developed based on estimates of the child's conciition and grovr;h cl�anc�es.The goal is to aim toward the highest
dec�ree of functioning possible.
Ph�s�cal and occupational therapists, a dietary consutiant, and the medical team work together to fu(fill treaiment
objectives. The children receive 24 hour nursing care. The Res�dence employs between 70-80 individuals;
ap,�rox�mately 50';r, of those employees reside in the local comrriunity.
A!I pro�ram costs are covered by Federal, state, local, and pr�v�ate funds. Per diem costs are S54.95.
The E,rc;yram is firmly based on the philosophy that all human be�n��s deserve every•opportunity to live as full and

and Zoning Committee; Mr. Jerome Segal , Assistant City Attorney; Messrs. Roy and Amey of
the Division of Housing and Building Code Enforcement; Mmes. P�cPdeally and Fox of the
Planning Staff.

The meeting was chaired by Mr. James Bryan, the Chairman.
PEOPLE, INC. (#8406) : An application for Special Condition Use to operate a facility
for non-am ulatory, mentally and physically handicapped children at 1599 Ames Avenue.
The applicant was present. There was opposition present at the hearing.
Ms. McNeally showed slides of the subject site and reviewed her sta�Ff report, with a
recommendation of approval for the Special Condition Use request.
Inasmuch as the agenda contained a rezoning request f�r� People, Inc. (#�8398) , after some
discussion among the members of the Committee, Mr. Segal ruled that both items could be
heard simultaneously, and Mr. Bryan announced this procedure to the audience.
�h1r. Donald Bump, Executive Director of People, Inc. , who lives at 1436 Ashland Avenue,
explained that People, Inc. is a Minnesota non-profit organization forrr�ed in 1969
by a group of six churches, and that the operation has been continued by those churches.
He told of the children with medical problems bein� .hpused on Jackson Street and the
facility being closed in 1975 and 1976; at that tirr,e the Department of Public Welfare
approached People, Inc. and asked them to try to continue the program for these children
to �revent their being institutionalized. Their temporary location at 666 Marshall has
served them well , Mr. Bump said, but it is under lease and does not fully meet requirements,
so there is a need to relocate. He said that in December o�' 1978 members of People, Inc.
and parents of the children visited homes within a l00 foot perimeter �f their boundary
at 1599 Ames to secure the consent of these people on a consent petition, and they did
receive the required number of signatures. He told how parents and the board members
visited the corr�nunity at large in January of this year leaving information with residents
regarding their program and information about the rezoning process, and inviting people
to visit their program at 666 Marshall . He answered questions regarding:
a) Why this particular parcel of land? There are needs within the program; the
children must stay within the city limits of Saint Pau7 . The children need
to be close to medical resources and within the area of Ramsey County Hospital .
b) Space Needs: 1599 Ames meets the space needs and conforms with zoning
regulations.
c) The Project: People, Inc. wants to maintain a residential appearance. They
will not build a multi story building or anything to detract from the �
, neighborhood. There will be offstreet parking. Transportation for the
children is provided the same as any other child in Saint Paul 's schoal
district with buses morning and evening, and there is alsa a van.
The children are supervised at all times, inside and outside.

d) Possible change of ownership: If ownership changes, the Special Condition
Use permit would again have to be considered through a public hearing. Mr.
Bump said People, Inc. is trying to rezone to residential so there will be
no possibility of commercial use com�ng in. He invited the neighborhood
to furnish a member to serve on the building committee, and said they would
like to have representatives from the community to serve on an advisory
committee and provide liaison with People, Inc. .
Ms. McNeally noted a letter received from Roosevelt Homes Resident Council in support
of the rezoning. _
Mr. Glenn E. Clausen, 1659 Ames Avenue, presented a petition with 55 names in opposition,
but neither he nor anyone else would come forward to give reasons for the opposition.
Mr. Levy wanted to know why anyone would not be interested in seeing the facility
development.
Ms. McNeally then gave her findings for the rezoning application.
Mr. Bryan requested that someone testify as for reasons for signing the petition in
opposition, and Mr. Ted Swanson, 1157 Herbert Street, said the Greenbrier Nome is
enough of that type of construction in the area.
D1r. Levy explained that the Greenbrier Home is for adult males and that this is a child
care facility for non-ambulatory children, and that Rule No. 34 says these children
must be supervised indivdivally. Mr. Levy said he could. not see P4r. Swanson's concern
because the two facilities were not close enough to give a ghetto appearance.

Mr. Swanson then explained his problems with the Ro,osevelt Homes Project and said his
concern is for the future and what might come into th� area as a result of the rezoning.
Ms. McNeally then noted three letters in opposition from property owners within 350 feet.
At this point, Ms. Surrnners brought up the question of changing the rezoning request to RT-�.
Ms. McNeally said as far as she could determine there is nothing to prevent it from being
an RT-1 zoning which would permit the requested facility. She said if someone bought
the property as RT-1 , they would have to have duplexes or single family homes, and she
said it would be a safeguard for the property.
Mr. Bump said this was the first he had heard of a possible RT-1 zoning and that it would
suit the land use.
Ms. Pat Pfundstein, 1815 Wellesley, said she is a social worker for children and that
the children involved in the People, Inc. project are not people who have been hospitalized,
but are 2 to 14 in age and children with close contacts with their families. She said
she wished everyone in the room would think of the comfort of being able to be close to
his or her disabled child.
Mr. Segal said the committee should be looking at the potential land use and that RT-1
might be more consistent.
' f�ir. Pangal moved to have a 10 minute recess during which time the applicant and committee
members could consu]t regarding the possibility of changing the request to RT-1 . His
motion was seconded and passed by unanimous voice vote.

Mr. Bump returned after the recess and said he understood that an RT-1 zoning would meet
all the needs of People, Inc. and they would be happy to support that request.
Mr. Segal then explained to those present that RT-1 allows only two family construction,
whereas under the original proposal there could have been multiple family. Therefare,
RT-1 would be more restrictive, and Mr. Segal explained that the reason for the original
RM-1 request was to be consistent with the adjacent ioning and continue it. Mr. Segal
said the amended rezoning request would read R-3 to RT-1 .
Mr. Bryan then closed the public hearing.
Ms. Summers moved to recommend approval of the rezoning from R-3 to RT-1 based on Findings
1 thru 3 and 6 thru 10 of the staff report. Her motion was seconded by Ms. Karns and
passed on a 5 to 0 roll call vote.
Mr. Levy moved to recommend approval of the Special Condition Use based on Findings
1 thru 5 of the staff report, contingent upon successful rezoning of the subject site
to RT-1 . His motion was seconded by Ms. Summers and passed on a 5 to 0 roll call vote.

666 Marshall Avenue. The state issi�ed a temporary I�ce+ise for that ;wo year period with the understanding that �
every effort would be made to secure a permanent facility and an onc�oing program of care for the children.
The fac�lity is licensed to acco�nmodate thirty children between h�rth ��nci eighteen years old. The existin� age
range is 19 months to fifteen years old. The occupancy has cons�s:en,ly t,een at capacity with a waiting listnf 12 -
15 chilclren.
All of the children are {�rofoundly or severely mentally retarded anc; have rnultiple physical disabilities.While there
are other commun�ty fac�lities canny for the mentally retarded, the People"s Child Care Residence is the only
community based facility programmed to meet the needs of ct�il�iren who are extensively meciically involved.
A recent survey conducted by Ennyht & Associates, for Peo��le. Incorporated, has revealed the numher of
instances where the need for this type of care exis,s. As reported in the survey. "'a total of 63 children were v�lithin
Rarnsey County, includmg Ihose children currently beiny serveci hy Pcrople, Incor�orated. In addition. School
Oistrict 916,whic,h �s a service un�t providing special education for the suburban Ramsey County school distric:s,
identified an additional 15 children who probably wi{I need a residential service �vith medical support.
Profiles have been received from Todd County- 1,Anoha County-2. St. !_ouis Coimty - 1,and Washington County-
1 . Both Dakota County and Hennepin County have responded in yenera! n��mber ider.tification, 15-2�children in
Dakota County ancl up to 70 children in Hennepin County."'
The children come from socio-economic backgrounds of yrea; ci�vers�t��; the;,arents arc: business people,farmers,
teachers, lawyers, sales people, homemakers, etc. The families are from the 7 county metro area and outlying
counhes; one child is from out of state.
The ma�ority of these children were born with developmental ancl neuroloyical disabi�ities, ard profound mental
d�sabilities. AI{ are non-ambulatory and experience a high degree of sE:iz�ire activity. Because of the complexity of
;heir ciisat,ilities, all of the chilriren re<�uire intensive medic.al c:�re
Three oi the children were healthy anii normal at b�rtn but suffereci accidents whfch caused brain stem injuries.At
least 50?�, of the children are legally blind and many are hearin� impaireci. Except in the cases where there were
accidents, the causes of the d�sabil�Ues are unknown.
In most of the families there are no prev+ous instances of retardation; most have normal sibdings. There is no
v�am�ng or explanat�on of when, or to whom, mental disabi(ities of this nature will occur.
It can happen in any farn�ly. The nahonal fiyures of retardation state that 3% of the population is profound►y
mentally disabled.
The People's Child Care Residence is dedicated to providing total care—physical, emotional, and social—and to
wor6:ing closely with families and community agencies ihrouyhout the child's treatment.
The concern is not only with the chitd's disabilities, but also witfi hisiher rehabi�itation potential. Individual
treatment goals are established through a multi-disc�plined team cc�nferc;nce for each child.The treatment plan is
developed based on esiimates of the child's condition and growth clianc�es.The goal is to a+m toward the highest
degree of functioning possible.
Physical and occupahonal therapists, a dietary consultant, 2nd the medical team avork together to fulfill treatment
object�ves. The ch�ldren rece�ve 24 hour nursing care. The RE�s�c3ence employs between 70-80 individuats;
approx�mately 50°;; of those employees reside in the local Cornmunity.
All program cos;s are covered by �ederal, state, local, and private funds. Per ciiem costs are S54.95.

PEOPLE, INC. (#8406) : An application for Special Condition Use to operate a facility
for non-ambulatory, mentally and physically handicapped children at 1599 Ames Avenue.
The applicant was present. There was cpposition present at the hearing.
Ms. McNeally showed slide� of the subject site and reviewed her staff report, with a
recommendation of approval for the Special Condition Use request.
Inasmuch as the agenda contained a rezoning request f�r� People, Inc. (�8398), after some
discussion among the members of the Committee, Mr. Sega7 ruled that both items could be
heard simultaneously, and Mr. Bryan announced this procedure to the audience.
��1r. Donald Bump, Executive Director of People, Inc. , who� lives at 1436 Ashland Avenue,
explained that People, Inc. is a Minnesota non-profit organization forrr�ed in 1969 .
by a group of six churches, and that the operation has been continued by those churches.
He told of the children with medical problems beinc� .housed on Jackson Street and the
facility being closed in 1975 and 1976; at that tin.e the Department of Public Welfare
approached People, Inc. and asked them to try to continue the program for these children
to prevent their being instit�ationali7ed. Their temporary location at 666 Marshall has
served them well , Mr. Bump said, but it is under lease and does not fuliy meet requirements, .
so there is a need to relocate. He said that in December of 1978 members of People, Tnc.
and parents of the children visited homes within a 100 foot perimeter of their boundary .
at 1599 Ames to secure the consent of these people on a consent petition, and they did
receive the required number of signatures. He told how parents and the board members
visited the community at large in January of this year leaving information with residents
regarding their program and information about the rezoning process, and inviting people
to visit their program at 666 Marshall . He answered questions regarding:
a) Why this particular parcel of land? There are needs within the program; the
children must stay within the city limits of Saint Paul . The children need
to be close to medical resources and within the area of Ramsey County Hospital .
b) Space Needs: 1599 Ames meets the space needs and conforms with zoning
regulations.
c) The Project: People, Inc. wants to maintain a residential appearance. They
will not build a multi story building or anything to detract from the
neighborhood. There will be offstreet parking. Transportation for the
children is provided the same as any other child in SaTnt Paul 's school
district with buses morning and evening, and there is also a van.
The children are supervised at all times, inside and outside.

d) Possible change of ownership: If ownership changes, the Special Condition
Use permit would agair� have to be considered through a public hearing. Mr.
Bump said People, Inc. is trying to rezone to residential so there will be
no possibility of commercial use coming in. He invited the neighborhood
to furnish a member to serve on the building committee, and said they would
like to have representatives from the community to serve on an advisory
committee and provide liaison with People, Inc.
Ms. McNeally noted a letter received from Raosevelt Homes Resident Council in support
of the rezoning. _
Mr. Glenn E. Clausen, 1659 Ames Avenue, presented a petition with 55 names in opposition,
but neither he nor anyone else would come forward to give reasons for the opposition.
Mr. Levy wanted to know why anyone would not be interested in seeing the facility
development.
Ms. McNeally then gave her findings for the rezonir�g application.
Mr. Bryan requested that someone testify as for reasons for signing the petition in
opposition, and Mr. Ted Swanson, 1157 Herbert Street, said the Greenbrier Home is
enough of that type of construction in the area.
Mr. Levy explained tha� the Greenbrier Home is for adult males and that this is a child
care facility for non-ambulatory children, and that Rule No.� 34 says these children
must be supervised indivdivally. Mr. Levy said he could not see Mr. Swansort's concern
because the two facilities were not close enough to give a ghetto appearance.

Mr. Swanson then explained his problems with the Ro.osevelt Homes Project and said-his
concern is for the future and what might come into th� area as a result of the rezoning.
Ms. McNeally �hen noted three letters in opposition from property owners within 350 feet.
At this point, Ms. Summers brought up the question of changing �he rezoning request to RT-1 .
Ms. McNeally said as far as she could determine there is nothing to prevent it from being
an RT-1 zoning which would permit the requested facility. She said if someone bought
the property as RT-1 , they would have to have duplexes or single family homes, and she
said it would be a safeguard for the property.
Mr. Bump said this was the first he had heard of a possible RT-1 zoning and that it would
suit the land use.
Ms. Pat Pfundstein, 1815 Wellesley, said she is a social worker for children and that �
the children involved in the People, Inc. project are not people who have been hospitalized,
but are 2 to 14 in age and children with close contacts with their families. S�e said
she wished everyone in the room would think of the comfort of being able to be close to
his or her disabled child.
Mr. Segal said the committee shou1d be looking at the potential land use and that RT-1
might be more consistent.
' Mr. Pangal moved to have a 10 minute recess during which time the applicant and committee
members could consult regarding the possibility of changing the request to RT-1 . His
motion was seconded and passed by unanimous voice vote.

Mr. Bump returned after the recess and said he understood that an RT-1 zoning would meet
all the needs of People, Inc. and they would be happy to support that request.
Mr. Segal then explained to those present that RT-1 allows only two family construction, .
whereas under the original proposal there could have been multiple family. Therefore,
RT-1 would be more restrictive, and Mr. Segal explained that the reason for the original
RM-1 request was to be consistent with the adjacent ioning and continue it. Mr. Segal
said the amended rezoning request would read R-3 to RT-1 .
Mr. Bryan then closed the public hearing.
Ms. Summers moved to recommend approval of the rezoning from R-3 to RT-1 based on Findings
1 thru 3 and 6 thru 10 of the staff report. Her motion was seconded by Ms. Karns and
passed on a 5 to 0 roll call vote.
Mr. Levy moved to recommend approval of the Special Condition Use based on Findings
1 thru 5 of the staff report, contingent upon successful rezoning of the subject site
to RT-1 . His motion was seconded by Ms. Summers and passed on a 5 to 0 roll call vote.

PURPOSE: To rezone 1599 Ames Ave. from R-3 to RT-1 for purposes of constructing
and maintaining a community residential facility for 32 non-ambulatory
children.
An informational meeting was held March 8, 1979 with the representatives of People,
Inc., the residents and District 2 Zoning Committee.
People, Inc., presented information on their operation, the background and need for
new faciZities, and that having inspected aoout a half dozen sites, concluded that
1599 Ames Ave. �eets their requirements. People, Inc. proposes to construct and
operate a 24-hour child care facility for 32 non-ambulatory children. The afternoon
shift is to consist of about 20 staff and volunteer people, with other shifts r•aving
a lesser amount of personnel.
Residents' representatives presented their position in opposition to rezoning, citing some
valid concerns which they feel may have an undesirable and detrimental effect on
their 'r.ealth, safety and well bein$.
As a �ene-ral procedure, the matter to be addressed would be the question of rezoning
from �-3 to RT-1, and whether or not it would be compatible with adjacent zoning. The
petition of People, Inc., before the Current Planning & Zoning Committee, presented
two petitions: one to rezone from R-3 to RT-1 (Zoning File No. 8398), and the other
a "Special Condition Use Permit" (Zoning File No. 8406). Due to these additional con-
ditio:.s, the character to rezone changes, and therefore requires additional and more
precise information in order to answer the concerns of the residents, the nei�hborhood
and the community in general.
Since People, Inc. intends to be a new entity in the District as apposed to a known,
establis:�ed one, and since most of the information was presented by Public Hearings
and by distribution of their own literature which was addressed primarily to their
trac� record as bein� a co�petent service organization, it offers very little infor-
�ation as to the proposed actual type of developraent to be accomplished in the final
analysis. Lacking sufficient information, it is impossible to determine whether or not
their intended developmental use would be compatible with the $oals and objectives set
forth in the General District Plan. The following are some of the basic concerns:
(1) No preliminary site development sketches were presented to indicate even general
in�ent of site layout.
(2) Additional off street parking requirement to accommodate staff and visitors.
Play�round across Ames has a high volume use durin� the recreational summer
season
(3) Use of iierbert Street & Geranium Avenue as access to property (residential streets)
(4) Possible flooding problems.
(5) Clarification of special use permit and its affect. Is it a community residen-
tial facility (Petition Request Zoning File No. 8406) as specified in
-- Sec. 60.316 (1) or a Residential Group Home as specified in Sec. 60.338.

The day they (the mothers of the children) came to me with the petition
� was in great stress and mental anguish. My 5 year old grandaughter,
Michele VanderVeer, (who had been sick for 1 week) lapsed into a coma.
I did not read the petition or take time to listen to what they had
to say. T was preparing to go to the hospital . I have a handicapped
child myself so I signed the petition.
I did not know that this would possibly mean new roads and sewers.
T did not know that they also operate drug and alcohlic treatment
centers. If funds are cut off and the place goes up for sale who-
ever buys the property would not have to have a home for mentally
physically handicapped children like I had signed for.

I was told that all they wanted was a walkway to the property from
the bus line for the people coming to the homes. Now it seems that
they will need another access to the property besides the one on Ames.
The people in the area live in fear of the Housing Project and
what would protect the children who will live in these homes. If
drugs are used in these homes that would make them a target.
We are also concerned that they might change to a drug-related facility
instead of a home for mentally retarded children. The neighborhood
does not need that sort of thing.

2. That we signed the petition for rezoning circulated by People's Inc.
3. When we signed the petition we were not fully informed to the complete
details of the proposed rezoning in the following respects:
When we signed the petition our understanding was that the children's
center was to be a one story building in the valley with enterance
from Ames Ave. and a capacity of no more than 32 children who are
crippled, retarded or are suffering serious bodily ailments, and
they never get out of the building alone.
Now from public meetings and study we have realized that this project
is a lot more then we were for at first.
We are not in favor of the proposal because of flooding and trouble
with sewers and possible construction of new roads which we will
have to pay for, also it will bring more traffic.
We have enough grief, mishap, loss and damage from the children who
live in the Roosevelt Housing Project which is one lot from our
property. We do not think that Peoples should be exposed to these
kinds of problems.
Construction of this nature spoils our view from our house and we
do not like the problems and losses it will bring.

This is written in response to the petition of People, Inc. to rezone property at 1599
Ames Avenue, located on the north side of Ames between Hazelwood and Kingsford, from
R-3 (Single Family Residential ) to RT-1 (Single & Two-Family Residential ) , for the purpose
of constructing and operating a community residential facility for 32 non-ambulatory,
physically and mentally handicapped children.
This matter was heard before the Current Planning & Zoning Committee of the Planning
Commission on February 15, 1979. There was one letter in support and two persons spoke
in support. There were three letters and a petition containing 55 signatures in
opposition. (The majority of those 55 signatures were.property owners outside of the
350 ft. notification area. ) Major concerns expressed u�iere increased vandalism, density
and traffic. . After some discussion by the committee, the applicant agreed to revise his
original RM-1 request to RT-1 ; the RT-1 zoning would provide safeguards against any sub-
stantial increase in density as well as provide a buffer between the RM-1 zoned Roosevelt
Housing Project adjacent to the west and single family homes adjacent to the east. Staff
recommended approval of the rezoning request and the Current Planning & Zoning Committee
also recommended apprnval on a vote of 5 to 0, based on the findings that the RT-1 zoning
would provide density safeguards, that the proposed facility meets all of the speciai
condition use requirements for a community residential facility, that District 2 has Qnly
one other community residential facility (The Greenbrier Home at 941 Birmingham) , and
with one exception all of the adjacent property owners within 100 ft. signed the consent
petition.
The committee also approved a Special Condition Use permit f�r People, Inc. contingent
upon successful rezoning of the property to RT-1 .
On February 23, 1979 the Planning Commission unanimously confirmed the recommendation
of the Current Planning & Zoning Committee for the rezoning, and for granting the Special'
Condition Use permit contingent upon that rezoning.
The City Council has scheduled a public hearing for this matter on March 22, 1979.

B. PUP.POSE: The applicant requests to rezone from P:-3 �Single Family -- Residential� to R��1-1
Lo:•� Density - Multiple Residential ) in order to construct and operate a facility for
non-ambulatory mentally and physically handicapped children.
C. FP.O��TAGE � AREA: This irregularly shaped site has 339.94' frontage on Ames Avenue and �
is approximately 155,000 sq, ft. in area, or 2.55 acres, .
D. SIT�/AREA CONDTTIQT�S: A single family house and triple garage occupy the wooded �vestern
portion of � is large site. The site slopes doti�n to Ames. The area is dominated by
Roosevelt Housing Project adjacent to the west and the Sackett Playground ab�tting across�
Ames to the south. Single family houses front on A.m�s to the east. ,

non-ambulatory, physically and mentally handicapped ch�ldren currently housEd at

2. The Comprehensive Land Use Plan �1963) designated this slte as one and twa fami.ly
(11 units per ac�e�, � � �
3. The site was previously zoned for one and tu��o fami.ly residential development.
4. An Rh1-1 zone adjoins the site to the west, eliminating classification as spot rezoning.
5. Teventy-six single family houses could be constructed on the site under R-3 zoning; 56
two bedroom units could be construc�ed w�ith the RM-7 zoning, However, given the
topography of the site, the num6er of units would probably be deereased. ,
6. The topography of the site �an easterly slope� and the size of the site would appear
to diminish any substantial negative impact on the single family houses adjacent to
the north and east, Sackett P7ay�round abuts the site to the south and Roosevelt
Project to the west.
7. District 2 has only one other Community Residential FaciIity, the Greenbrier Home,
at 941 Birmingham.
8. The site and proposed facilit,y meet the Special Condition Use requirements for
Community Residential �Facilities, (The applicant has applied for a special condition
use concurrent with, and contingent upon, successful rezoning),
9. The applicant has indicated that the nroposed barrier free facility wi11 be single
story and designed for compatibility arith adjacent single family use.
