the HOUSING AN� RF;DEVELOPMENT AUTHORITY OF THE CITY OF SAINT PAUL,
MIVNESOTA, a M�nnesota public body corporate, hereinafter referred
to as "Grantor" , and CITY OF SAINT PAUL, a Minnesota municipal
corporation, h�reinafter referred to as the "City" ,

WITNESSET�I:
WHEREAS, �rantor owns in fee simple those parcels of land
situated in th� County of Ramsey, State of Minnesota, hereinafter
described; and�
WHEREAS, �he City desires a permanent easement for the purpose
of constructin� and maintaining a below ground storm sewer and tunnel
as a part of t e St. Anthony Fiill Storm Sewer Project; and
W�iEREAS, �he City represents that the requested easement will
be approximate�.y 140 feet below existing ground level, and that the
activity invol��ed in connection with the construction, maintenance
,
or repair of tl�e sewer and tunnsi will cause no disruption to the
ground surface�' or improvements of said parcels; and
WHEREAS, �he Grantor is willing to grant the requested easements

30. 0 feet City Datum, for the purpose of constructing and maintain-
ing a public s wer in, under, across and through those parts of the
following desc�ibed lands all in Ramsey County, Minnesota:
All that part f the South 81. 61 feet of Lot 29, Block 12 , Butterfield
Syndicate Addi�ion No. 1, lying within the following described line :
Beginning at a point, on the east line of said Lot 29 , a distance of
32 feet more o less north of the southeast corner; thence south along

along the south line of said Lot 29 , to the southwest corner; thence
north along th� west line of said Lot 29, a distance of 81. 61 feet;

It is in�ended that the foregoimg agreements shall be covenants
running with the easement hereby conveyed, and that said agreements
shall be bindi,ng to the fullest extent of law and equity for the
benefit and inlfavor of the Grantor, its successors and assigns,
against the Ci�ty, its successors and assigns. It is further intended
and agreed tha+t said agreements and covenants shall remain in effect
without limitation as to time. �
