Paul Legislative Code , Section 54 . 1�, � perta n g to occupancy of units more than 50% below grade , and waiver of certain electrical re�uirements , as designated in Certificate o£ dccupancy letter of 1/6/79, because of economic considerations . Previous Hearing 3/13/79: Case continued to April meeting. APPEARANCE : Raymond P. Farrell PROCEEDINGS : Mr. �arrell said the four basement apartments were in use iri 1 w en he purchased the building. . He had expanded Apt . #4 in 296I, having obtained a building permit for the construction. In the recent : Certificate of Occupancy inspection, the city inspector had advised - that fire walls and door closers in the boiler room were required, and that a larger window, suitable for use as an emergency exit, was needed in one of the base'ment units . Mr. Farrell said he was willing to comnly � with these requirements and that he needed the income from the units to make operation of the building feasible . Alice Bijjani exnlained that the only question before the Board was whether or not to 'waive the re�uirement that prohibited occupancy of any ' unit more than S0� below grade . She said if the Board granted such a waiver, the Code �nforcement Division reauested there be a stipulation that all sleeping rooms in the below grade apartments be provided with an escape window in conformance with Uniform Building Code specifications . BOARD ACTION: Mr. Tieso moved that a waiver of St . Paul Legislative Code, Section 54 . 13, pe�taining to basement occunancies , be granted, on condition that all sleeping' rooms in four basement anartments be provided wi�h escape windows in conformance to Uniform Building Code requireme�ts in , any apartment where such means of egress is not already provided. PROPERTY APPELLANT ' 17- 79-H 1120 Burns Ave . Gary H. Market (3 units) SUBJECT: Request waiver of certain requirements of St . Paul Legislative Gode pertaini.ng �o bathroom location, and electrical and structural : repairs, as designated in letter of 3/1/79 from Code Enforcement Division, ' because of pract�cal difficulty and economic considerations . APPEAR.ANCE : Gary H. Market . PROCEEDIN GS : Mr. Market stated that his pronerty had one second floor � unit and two first floor units . The violations cited by the city applied primarily to the rear first floor apartment, where the bathroom facilities werelocated in the basement. The unit rented for $145 a month, and the present tenant had agreed to make several of the repairs listed in the . city' s letter i�a exchange for two months ' rent . Mr. Market said he could not find out what was wrong with the stairway support post listed as inadequate , and' the rear norch, found in violation because of broken window panes and a roof leak, was never intended to be part of the rental , � -3- 4/IQ/79 - Meeting No. I49 ', - ' unit, having alway5 served as a storage shed. That had been reroofed in recent years , and he felt if there was a leak, it was only because of : the unusually hard winter in which many other property owners had exper- ienced similar problems , in spite of sound roofs . However, the tenant " � who was to make thC repairs continuecl to complain to Mr. D�arket about ` various conditions , which resulted in some disagreement between them.-° After an unlawful detainer action, the tenant agreed to repair the kitchen ceiling light and the broken window panes on the rear porch . The only item on the city' s list that A�r. Market was appealing concerned the basement batliroom, ; and he asked that he be permitted to retain it for the exclusive use of the rear first floor apartment . He said he was willing to enclose it for privacy and install a mechanical. ventilator�.' He had in recent years installed a separate bathroom in the front first floor apartment, but there was no space available to do so in the rear unit . Mr. Market also said he had just sold the property and, as part of th� _ selling agreement, he had agreed to appeal for a waiver on the question of the basement bathroom. Alice Bijjani stated that there was a possible problem with zoning, that . three apartments might be illegal under the zoning code . She suggested this be checked be;fore the owner proceeded with the exnense of enclosing the basement bathroom. - On the basis of certain facts involving how long the three units had be.en in existence, as explained by Mr. Market, Ms . Bijjani said it was clear : that the property would be eligible for a legal non-conforming status designation under the zoning code .__, Such a status iaould need the aunroval of housing and building code officials and would depend on Mr. Market proving hardshin, but Ms . Bijjani said she did not anticipate any problem in getting approval . BOARD ACTION : Chairman �liozniak moved that a waiver be granted to permit : use o t e athroom facilities in the basement for the rear dwelling unit on the first floox, on condition that the bathroom be enclosed for privacy � and adequate ventilation be provided, and on furthex condition that all � remaining violations listed in the city's letter af 3/1/79 be corrected. . b4r.
