wHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHBREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, the Saint Paul Firefighters Local 21, represented
by Chris Cook, President, who has been designated as the
responsible person on the application, has applied for a variance
to allow live music at 176 Snelling Avenue North, on November 11,
2001 for a benefit to raise funds for the families of the New
York Police Officers and Firefighters who made the ultimate
sacrifice at the World Trade Center; and
WHEREAS, applicant is seeking a variance for the hours of
6:00 p.m. to midnight on November 11, 2001; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the live music at the benefit; and
WHEREAS', the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to the Saint Paul Firefighters Local 21,
subject to the following conditions:
1) The variance shall be for the hours of 6:00
p.m. to midnight on November 11, 2001.
2) All electronically powered equipment used in
conjunction with the event shall not exceed
100 dBA as measured at a location outside of
the tent that is opposite from the stage.

3 equipment who shall provide continuous•sound
4 level monitoring between 6:00 p.m. and
5�1 �� � 1 midnight on November 11, 2001 to ensure

10 shall be turned off no later than midnight on

Live Music Benefit
Attached is a sound level variance application from St. Paul Firefighters Union Loca121
for a benefit with amplified live music, to be held in an outdoor tent on the parking lot at
176 Snelling Avenue N. The benefit is to raise funds for the families of the New York
Police Officers and Firefighters lost at the World Trade Center. The variance is requested
from 6:00 p.m. to midnight on November 11, 2001.
Also attached is a copy of the Public Hearing Notice sent to property owners within 200
feet of 176 Snelling Avenue N.

Live Music Benefit
Attached is a sound level variance application from St. Paul Firefighters Union Loca121
for a benefit with amplified live music, to be held in an outdoor tent on the parking lot at
176 Snelling Avenue N. The benefit is to raise funds for the families of the New York
Police Officers and Firefighters lost at the World Trade Center. The variance is requested
from 6:00 p.m. to midnight on November 11, 2001.
Also attached is a copy of the Public Hearing Notice sent to property owners within 200
feet of 176 Snelling Avenue N.
