1 RESOLUTION RELATING TO RESTRICTIONS ON THE USE
2 AND SALE OF PHOSPHORUS LAWN FERTILIZERS
3 VJHEREAS, the City of Saint Paul sits at the headwaters ofthe navigable Mississippi River and, as the home
4 to five watershed districts, is the steward of significant fresh-water resources; and
5 WHEREAS, there is a well-documented relationship between the use of phosphorus lawn fertilizers and the
6 degradation of water quality; and
7 WF-IEREAS, the stormwater discharge permit issued to the City of Saint Paul by the Minnesota Pollution
8 Control Agency requires that the City implement a program to reduce the discharge of pollutants related to
9 the application of fertilizers; and
10 WHEREAS, owing to unique circumstances, regional soils haue an abundance of natural phosphorus; and
11 WHEREAS, leading fertilizer manufacturers and retailers have been slow to produce and mazket low
12 phosphorus lawn fertilizers to the public;
13 NOW, THEREFORE, BE IT RESOLVED that the Saint Paui City Council declares its commitment to the
14 reduction of phosphonxs use by encouraging the adoption of regulations restricting the use and sale of
15 phosphorus lawn fertilizers within the city and related watershed districts; and
16 BE IT FURTHER RESOLVED thatthe Saint Paul City Council supports State legislationrestrictin g the sale
17 of any lawn fertilizer, liquid or gxanular, that contains any amount of phosphorus or other compounds
18 containing phosphorus, such as phosphate, except that small quantities may be sold for use when a soil test
19 indicates that additionai phosphorus is needed to support healthy hxrf growth or during the first year when
20 a new area of turf or lawn is being established; and
21 BE IT FURTHER RESOLVED that such legislation should require that commercial displays of fertilizers
22 containing phosphorous must be clearly marked and the seller must provide the buyer with a copy of the
23 appropriate printed consumer information; and

1 BE IT FINALLY RESOLVED that the Saint Paul City Council does request and encourage the Minnesota
2 Legislature to consider and enact legislation to regulate and limit the sale and use of phosphorus lawn
3 fertilizers.
