WHEREAS, The Council of the City of Saint Paul adopted Section
308.34 of the Saint Paul Legislative Code dealing with dormant li-
quor licenses; and
WHEREAS, A hearing was scheduled before the Council of the City
of Saint Paul for 9:00 a.m. , March 28, 1979, to hear testimony rel-
evant to whether the off-sale intoxicating liquor license issued to
Uni-Dale Development Corporation should be renewed subject to the
aforementioned section of the Code; and
WHEREAS, It was agreed that the hearing would be continued until
April 4, 1979, to permit the licensee additional time to prepare for
an evidentiary hearing; and
WHEREAS, A letter dated March 28, 1979, from Terrence J. Garvey,
attorney for the License Inspector, was sent to Tom Steffens, attor-
ney for Uni-Dale Corporation, licensee, setting forth the factual
issues to be considered by the Council on April 4, 1979, and the
procedures followed by the Council in adversary hearings; and
WI�REAS, On April 4, 1979, evidence was introduced by the office
of the License Inspector supporting the proposition that the licen-
see, doing business as Ebony Liquors at 621 Selby Avenue, Saint Paul,
Minnesota, ceased full operation on or before January 31, 1978; and
WHEREAS, Opposing evidence was introduced by Mr. Steffens on
behalf of the licensee in support of the proposition that the li-
censee was in operation at 621 Selby Avenue on and after February
l, 1978; and

WHEREAS, The matter was continued to April 11, 1979, to give
licensee an opportunity to gather additional evidence in support of
its position; and
WHEREAS, Counsel for the License Inspector and counsel for the
licensee in their closing arguments took and argued contrary posi-
tions as to the proper interpretation of Section 308.34 of the
Saint Paul Legislative Code; and
WHEREAS, The Council determined that the proper interpretation
of Section 308.34 of the Code was that the licensed liquor business
must have been in operation on or after the date of the renewal of
the in-question license, February l, 1978; and
WHEREAS, The Council weighed the evidence, the credibility of
witnesses, their interest or lack of interest in the outcome of the
case, their demeanor, their frankness and sincerity; and
WHEREAS, The Council found that the licensed business was not
in operation on or after the license renewal date of February 1,
1978; now, therefore, be it
RESOLVED, By the Council of the City of Saint Paul, That the
"off-sale" intoxicating liquor license issued to Uni-Dale Develop-
ment Corporation shall not be renewed.

the Council has continued the hearing concerning the Ebony
(Uni-Dale) liquor license until next Wednesday, April 4, 1979.

Attached for your review is a copy of Section 308.34 of the St.

The License Inspector will present evidence that the licensed
business at 621 Selby Avenue, Ebony Liquors, ceased full operation

On or about September 22, 1976, plaintiff and defendant
entered into a written lease of liquor store premises at 621-625
Selby Avenue, St. Paul, Minnesota, commencing on June 1, 1976, and
expiring on August 31, 1977.

Defendant is holding over the premises after the termination
of the lease.
5.
Plaintiff did not provide defendant with 90 days' written
notice requiring defendant to move from the premises.
�CONCLUSIONS OF LAW:
1.
Plaintiff is entitled to judgment of restitution of the
premises known as 621-625 Selby Avenue, St. Paul, Minnesota.
2.
Defendant was and is not entitled to withhold rent by
reason of the state of repair of the premises. The funds on
deposit with the Clerk of Court are to be paid forthwith to
plaintiff.

The Clerk is not to issue a writ of restitution until
January 31, 1978.

MEMORANDUM
A tenant of commercial property purchased by a public agency
with community development block grant funds, under a lease with
a fixed termination date, is not entitled to require the public
ager�cy tU show� g�od �:ause for hi5 et�i�tio.z at the eil3 of the
. lease term.
Joy v. Daniels, 479 F. 2d 1236 (4th Cir. 1973) and McQueen v.
Druker, 317 F. Supp. 1122 (D. Mass. 1970) are distinguishable
as involving low-rent housing, not commercial property.
The municipal court has no jurisdiction, in an unlawful
deta�ner a�tiur., to iziquire� into the m�ti�2s w��icr. n►ay ha�e 'e 3
the Board of Commissioners of a Housing and Redevelopment Authority
to exercise its legal rights to evict a tenant of commercial
property. To permit such inquiry would convert a statutory
action at law for the summary restitution of real estate into a
certiorari action to review the actions of the Board, an action
which rightly lies in a court of general jurisdiction. Miller v. '

Fritz v. Warthen, 298 Minn. 54, 213 N.W.2d 339 (1973) does
not permit a commercial tenant holding under a net-net lease to '
withhold rent to compel the landlord to make repairs.
� 42 C.F.R. �124 (c) provides that:
" (c) Notice. No person lawfully ►
occupying real property shall be required
to move from a dwelling or to move his
business or farm operation, without at
least 90 days ' written notice from the
State agency acquirirg the real property
or ordering its demolition: Provided,
That a shorter period of notice may be
given when the State agency determines,
with HUD concurrence, that a 90-day
period is impracticable. "
�'he lar�guage "requ�rzc� ta mo��e" refers rct to the l�g�lities
. of leases, but to the actual fact of being moved out. This
defendant was lulled by plaintiff into assuming that plaintiff
would consider extending its tenancy beyond the expiration of
the lease. The federal regulation requires that a tenant in
possession be given unequivocal notice, at least 90 days in
a�i°�'ar�cc; o+ t�e dat�: upor� w:�icr. he �s ex��r:ted t� m�ve out. The.�e
was no showing why plaintiff could not have given this notice.
The expiration clause in the lease is not the notice contemplated
by the regulation.
Rather than dismiss the case on grounds of lack of notice,
the court deems it more reasonable to provide a 90-day stay of
the issuance of its writ of restitution. This meets the require- �
ment of federal policy without also requiring the case to be

Attached is a letter from rir. Booker T. Parker, Executive Director, Help
_ Dzvelopr�ent Corporation, dated January 12, 1978, advising that Ebony Lia,uors
_ ���ill cease doing business at 621 Selby on or before January 31, 1978.
Ebony is in the process of liquidating its inventory with wholesalers and
. selling its personal property, and indicates that they may need the premises
: for temgorary storage of inventory and personalty awaiting pick up by
purchasers.

[dHEREAS, in order to further accomplish the purposes and objectives of the �
Redevelopment Plan, it is necessary and desirable to approve the method of offering
said Gorman and McClellan School Sites for sale for redevelopment .in accordance .
with the Redevelopment Plan and of selecting the Redeveloper; and .
WHEREAS, there has been presented to and considered at this meeting a set of
documents entitled ("Notice to Developer", "Development Controls - Gorman School Site
and rlcClellan School Site"), which documents provide for a public offering and state
the redevelopment objectives and requirements and provide for the developer selectiofl
criteria for said Gorman School Site and McClellan School Site. � '.
NOtJ THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Authority of the
City of Saint Paul, Minnesota, that a public offering for .sale of said Gorman School
Site and McClellan School Site in the North End Community Development Program District 6,
for redevelopment for uses in accordance with the Community Redevelopment Plan for
North End, adopted July 19, 1977, be made, and that the Redevelopment Objectives and
Requirements for said Gorman School Site and McClellan School Site, North End Community
Development Program District 6, are hereby approved.

D. APPROVAL OF STORAGE AGREEMENT--EBONY LIQUORS, DISTRICT 8
Ebony Liquor will cease doing business at 621 Se1by Avenue on January 30, 197 _
and requested that in the event of_ a problem in removing materials they
receive percnission to store materials there until the 6th of February,
Staff recommended approval. There was discussion regarding the liquor _.
license. Commissioner Butler moved approval of the staff reco:�miendation.
In addition, she suggested the� matter of the license be referred to the
City License Coc�¢nittee. Commissioner Tedesco left during this discussion.

� A tenant of commercial property purchased by a public agency
with community development block grant funds, under a lease with '
a fixed termination date, is not entitled to require the public

Joy v. Daniels, 479 F. 2d 1236 t4th Cir. 1973) and McQueen v.
. Druker, 317 F. Supp. 1122 (D. Mass. 1970) are distinguishable
as involving low-rent housing, not commercial property.
The municipal court has no jurisdiction, in an unlawful
detainer actiox�, to ir:�iuire in to �th.: illO'�iVES whicll cr�a� :�a�F le3
the Board of Commissioners of a Housing and Redevelopment Authority
to exercise its legal rights to evict a tenant of commercial
property. To permit such inquiry would convert a statutory
action at law for the summary restitution of real estate into a

not permit a comme=cial tenant holding under a net-net lease to �
withhold rent to compel the landlord to make repairs. �
42 C.F.R. �124 (c) provides that: �

The lanc�uage "req�sired to me�e" �efers i���t tc� th: lEgrilities
of leases, but to the actual fact of being moved out. This
defendant was lulled by plaintiff into assuming that plaintiff
would consider extending its tenancy beyond the expiration of
the lease. The federal regulation requires that a tenant in
possession be given unequivocal notice, at least 90 days in
�dvanc� of the c;:att u�un whi�h he is e�.pactzZ V� n�,e vst. �Yrere - �
was no showing why plaintiff could not have given this notice.
The expiration clause in the lease is not the notice contemplated
by the regulation.
Rather than dismiss the� case on grounds of lack of notice,
the court deems it more reasonable to provide a 90-day stay of . �
the issuance of its writ of restitution. This meets the require-
ment of federal policy without also requiring the case to be

Redevelopment Plan, it is necessary and desirable to approve the method of offering
said Gorman and McClellan School Sites for sale for redevelopment in accordance .

WHEREAS, there has been presented to and considered at this meeting a set of
documents entitled ("Notice to Developer", "Development Controls - Gorman School Site

Ebony� Liquor will cease doing business at 621 Selby Avenue on January 30, 197 _
and requested that in the event of a problem in removing materials they
receive permission to store materials there until the 6th of February.
Staff recommended approval. There was discussion regarding the liquor �
license. Commissioner Butler moved approval of the staff reconanendation.
In addition, she suggested the� matter of the license be referred to the
City License Committee. Commissioner Tedesco left during this discussion.
