School Resource Officer (SRO) Program
THIS AGREEMENT, made this v��� day of us� , 2001, by and between
NDEPE�IDENT SCHOOL DISTRICT NO. 625, hereinafter re�as "DistricY', and CITY
OF SAII�TT PAUL POLICE DEPARTMENT, hereinafter referred to as "City",
�VI"I�TESSETH:
WHEREAS, the Board of Education of Independent School District No. 62� has by virtue of
Board File No. 0��7�� , and the City Council, City of Saint Paul has by virtue of
Cotmcil Resolution No. , authorized an a;reement providing School
Resource Officer (SRO) services to the District;
Now, therefore, IT IS HEREBY AGREED, by and between the parties, as follows:
1. General. The District agrees to pay City for the total pro�ram costs incurred as specified
hereiu to permit the ass ��nment of School ResoLUCe Officers and Supervisor(s), all swom police
officers, for law enforcement and educational duties and services to be performed on behalf of
the District durin� the period of the fourth Saturday in August throu�h the second Friday in June
of each school year. The Scope of Services for this A;reement is as listed below.
2. Scope of Services. The SRO Program has two components:
a. Basic Services (Component A): The City will provide fifteen (15) SRO's for a period of 9.5
months who will be reassigned at the City's discretion for the remaining 2.5 months per year.
These personnel will be dedicated to the duties of their school assignments and DARE
instruction. These personnel will not be removed from the schools, except for police
emergencies.
b. COPS U�ziversnl Hiring Progrmn (Component B): The City will provide two (2) additional
SRO's for a period of 12 months whose positions will be funded from the COPS (Community
Oriented Policin� Services) Grant Program and matching revenue provided by the parties to this
A�reement. These personnei will be dedicated full-time to the duties of their school assi,anments
and will not be removed from the schools, except for police emergencies.
c. SRO's assi�ned under this pro�ram will operate primarily from the District's secondary
scliool sites but the SRO's will be assigned to provide DARE instruction at elementary schools
as coordinated with the Safe and Drug Free School Pro�ram, a St. Paul Public School Program.

3. Term of Agreement. This A�eement will cover the period July l, 2000 throu�h June
30, 2003, inclusive.
4. Condition of Employment. All services and duties performed by the assigned Officers
will be within the course of employment by the City. Officers, as City employees
assigned under the A�reement, �vill remain employees of the City and, therefore, ue
covered by the City's Workers Compensation Pro�ram, will be paid by the City, and aze
entifled to all benefits provided by their employer. Officers assigned under the
Agreement will be expected to abide by and are �ovemed by the rules and regulations of
the City.
5. Indemnification and Hold Harmless. Each party will indemnify and hold harmless the
other party for actions and representations made by its own employees, officials, a�ents
and representatives, which occur in the performance of the terms of this A;reement or
their other employment duties and the results thereof to the extent authorized by law and
shall not be responsible for the acts and/or omissions of the other party or that party's
employees, officials, agents or representatives and the results thereo£ The liability of the
parties shall be limited and governed by provision of the Minnesota Torts Claims Act,
Minnesota Statues Chapter 466, et esq., and other applicable law.
6. Performance. Both parties accept full responsibility far performance of the duties
outiined herein but neither the City nor the District shall be held responsible for non-
performance of its duties or responsibilities under this A�reement if the party's
performance was prevented by acts ar events beyond the party's reasonable control,
including but not limited to: severe weather and storxns, earthquake or other natural
occunences, strikes and other labor unrest, power failures, electrical power surges or
current fluctuations, nuclear or other civil or military emergencies, or acts of legislative,
judicial, executive, or administrative authorities. Additionally, each SRO will remain
imder the City's direction and control, and will be subject to police emergency recalls for
service and/or activation of any Tactical Alert throughout the city, if the need arises.
Emergency recall/tactical alert decisions are within the City's discretion and are not
subject to question ar liability under this Agreement.
Data Privacy. The City and District a�ree to abide by Minnesota Statues (Minnesota
Government Aata Practices Act) as well as any other applicable federal, state, and local
laws or ordinances.
8. Changes.
a. The City or District may request chan�es that would increase, decrease, or otherwise
modify the Scope of Services. Such chan�es and methods must be agreed to and authorized in
�critin� in advance by the District and City. Any alterations, amendments. deletions or waivers
of the provisions of this A�reement shall be valid only when reduced to writing and duly
executed by the parties.

b. It is understood and agreed that this entire Agreement supersedes any and all oral
agreements and negotiations between the parties relating to the subject matter herein.
c. If the School District �vishes to increase the number of officers, the City may honor such
a request at its sole discretion. The School District will fund the total pro�ram costs of the
additional officers, unless othenvise a�reed to in writin� by the parties.
9. Miscellaneous.
a. Any failure of a party to assert any right under this A�reement shall not constitute a
�vaiver or a termination of that right, this Agreement, or any provisions of this Agreement.
b. If a court or government agency with proper jurisdiction determines that any provision of
this A�reement is unlawful and rules such provision void, the balance of this Agreement shall
remain intact and in full force and effect.
c. This Agreement shall be interpreted and construed according to the laws of the State of .
Mimiesota. All litigation related to this Agreement shall be venued in the District Court of the
CoLmty of Ramsey, Second Judicial District, State of Minnesota.
d. The School District may conduct a study and analysis of their dnig prevention efforts and
the enforcement duties at the schools. The City shall have an active and participatory role in any
of these studies.
10. Payments and Billings.
a. In June of each year, the City will bill the District for reimbursement as outlined herein
for the costs of the SRO Program. All bills will be paid according to the terms of the Minnesota
Prompt Pay Law (35 days).
b. Each party agrees to fund one-half of the costs associated with the operation of the SRO
Program (Basic Services) based upon 9.5 months (19/24ths of the calendar year) of service. The
City agrees to pay the full cost of the remaining 2.5 months (5/24ths of the calendar year).
c. Each party agrees to fund one-half of the required match for the total costs associated
�vith the operation of the SRO Proa am (COPS Universal Hiring ProgYam) based upon 12
months (the fiill calendar year) of service.
d. For the School DistricYs budgeting purposes, in July of each year, the City will provide
an estimate of the costs of the SRO program for the upcoming school year. In all cases, actual
costs and not a budget estimate will form the basis for reimbursement billin�s to the School
District. If at any time during the period of this contract, the City estimates, or has reason to
believe, that flie final contract billing will exceed their original estimate by 10% or more, they
shall promptiy notify the District in writin�. The District or the City shall have the option of
suspendin� this program for the balance of that school year, btrt such suspension will not affect
the annual renewal of this contract, as specified herein.

11. Termination
a. In the event that the SRO program is eliminated for any reason, this agreement will
automatically terminate. At that point, services will be billed and paid for the time the program
�vas in effect and police personnel provided. A new agreement must be executed prior to the
resumprion of the SRO program.
b. If either party �vishes to terminate this agreement, it may do so by providing 60-day
written notice to the other party, unless otherwise provided herein. Termination may occur
according to a schedule mutually agreed upon in writing by both parties.

THIS AGREEMENT, made this v��� day of us� , 2001, by and between
NDEPE�IDENT SCHOOL DISTRICT NO. 625, hereinafter re�as "DistricY', and CITY
OF SAII�TT PAUL POLICE DEPARTMENT, hereinafter referred to as "City",
�VI"I�TESSETH:
WHEREAS, the Board of Education of Independent School District No. 62� has by virtue of
Board File No. 0��7�� , and the City Council, City of Saint Paul has by virtue of
Cotmcil Resolution No. , authorized an a;reement providing School
Resource Officer (SRO) services to the District;
Now, therefore, IT IS HEREBY AGREED, by and between the parties, as follows:
1. General. The District agrees to pay City for the total pro�ram costs incurred as specified
hereiu to permit the ass ��nment of School ResoLUCe Officers and Supervisor(s), all swom police
officers, for law enforcement and educational duties and services to be performed on behalf of
the District durin� the period of the fourth Saturday in August throu�h the second Friday in June
of each school year. The Scope of Services for this A;reement is as listed below.
2. Scope of Services. The SRO Program has two components:
a. Basic Services (Component A): The City will provide fifteen (15) SRO's for a period of 9.5
months who will be reassigned at the City's discretion for the remaining 2.5 months per year.
These personnel will be dedicated to the duties of their school assignments and DARE
instruction. These personnel will not be removed from the schools, except for police
emergencies.
b. COPS U�ziversnl Hiring Progrmn (Component B): The City will provide two (2) additional
SRO's for a period of 12 months whose positions will be funded from the COPS (Community
Oriented Policin� Services) Grant Program and matching revenue provided by the parties to this
A�reement. These personnei will be dedicated full-time to the duties of their school assi,anments
and will not be removed from the schools, except for police emergencies.
c. SRO's assi�ned under this pro�ram will operate primarily from the District's secondary
scliool sites but the SRO's will be assigned to provide DARE instruction at elementary schools
as coordinated with the Safe and Drug Free School Pro�ram, a St. Paul Public School Program.

3. Term of Agreement. This A�eement will cover the period July l, 2000 throu�h June
30, 2003, inclusive.
4. Condition of Employment. All services and duties performed by the assigned Officers
will be within the course of employment by the City. Officers, as City employees
assigned under the A�reement, �vill remain employees of the City and, therefore, ue
covered by the City's Workers Compensation Pro�ram, will be paid by the City, and aze
entifled to all benefits provided by their employer. Officers assigned under the
Agreement will be expected to abide by and are �ovemed by the rules and regulations of
the City.
5. Indemnification and Hold Harmless. Each party will indemnify and hold harmless the
other party for actions and representations made by its own employees, officials, a�ents
and representatives, which occur in the performance of the terms of this A;reement or
their other employment duties and the results thereof to the extent authorized by law and
shall not be responsible for the acts and/or omissions of the other party or that party's
employees, officials, agents or representatives and the results thereo£ The liability of the
parties shall be limited and governed by provision of the Minnesota Torts Claims Act,
Minnesota Statues Chapter 466, et esq., and other applicable law.
6. Performance. Both parties accept full responsibility far performance of the duties
outiined herein but neither the City nor the District shall be held responsible for non-
performance of its duties or responsibilities under this A�reement if the party's
performance was prevented by acts ar events beyond the party's reasonable control,
including but not limited to: severe weather and storxns, earthquake or other natural
occunences, strikes and other labor unrest, power failures, electrical power surges or
current fluctuations, nuclear or other civil or military emergencies, or acts of legislative,
judicial, executive, or administrative authorities. Additionally, each SRO will remain
imder the City's direction and control, and will be subject to police emergency recalls for
service and/or activation of any Tactical Alert throughout the city, if the need arises.
Emergency recall/tactical alert decisions are within the City's discretion and are not
subject to question ar liability under this Agreement.
Data Privacy. The City and District a�ree to abide by Minnesota Statues (Minnesota
Government Aata Practices Act) as well as any other applicable federal, state, and local
laws or ordinances.
8. Changes.
a. The City or District may request chan�es that would increase, decrease, or otherwise
modify the Scope of Services. Such chan�es and methods must be agreed to and authorized in
�critin� in advance by the District and City. Any alterations, amendments. deletions or waivers
of the provisions of this A�reement shall be valid only when reduced to writing and duly
executed by the parties.

b. It is understood and agreed that this entire Agreement supersedes any and all oral
agreements and negotiations between the parties relating to the subject matter herein.
c. If the School District �vishes to increase the number of officers, the City may honor such
a request at its sole discretion. The School District will fund the total pro�ram costs of the
additional officers, unless othenvise a�reed to in writin� by the parties.
9. Miscellaneous.
a. Any failure of a party to assert any right under this A�reement shall not constitute a
�vaiver or a termination of that right, this Agreement, or any provisions of this Agreement.
b. If a court or government agency with proper jurisdiction determines that any provision of
this A�reement is unlawful and rules such provision void, the balance of this Agreement shall
remain intact and in full force and effect.
c. This Agreement shall be interpreted and construed according to the laws of the State of .
Mimiesota. All litigation related to this Agreement shall be venued in the District Court of the
CoLmty of Ramsey, Second Judicial District, State of Minnesota.
d. The School District may conduct a study and analysis of their dnig prevention efforts and
the enforcement duties at the schools. The City shall have an active and participatory role in any
of these studies.
10. Payments and Billings.
a. In June of each year, the City will bill the District for reimbursement as outlined herein
for the costs of the SRO Program. All bills will be paid according to the terms of the Minnesota
Prompt Pay Law (35 days).
b. Each party agrees to fund one-half of the costs associated with the operation of the SRO
Program (Basic Services) based upon 9.5 months (19/24ths of the calendar year) of service. The
City agrees to pay the full cost of the remaining 2.5 months (5/24ths of the calendar year).
c. Each party agrees to fund one-half of the required match for the total costs associated
�vith the operation of the SRO Proa am (COPS Universal Hiring ProgYam) based upon 12
months (the fiill calendar year) of service.
d. For the School DistricYs budgeting purposes, in July of each year, the City will provide
an estimate of the costs of the SRO program for the upcoming school year. In all cases, actual
costs and not a budget estimate will form the basis for reimbursement billin�s to the School
District. If at any time during the period of this contract, the City estimates, or has reason to
believe, that flie final contract billing will exceed their original estimate by 10% or more, they
shall promptiy notify the District in writin�. The District or the City shall have the option of
suspendin� this program for the balance of that school year, btrt such suspension will not affect
the annual renewal of this contract, as specified herein.

11. Termination
a. In the event that the SRO program is eliminated for any reason, this agreement will
automatically terminate. At that point, services will be billed and paid for the time the program
�vas in effect and police personnel provided. A new agreement must be executed prior to the
resumprion of the SRO program.
b. If either party �vishes to terminate this agreement, it may do so by providing 60-day
written notice to the other party, unless otherwise provided herein. Termination may occur
according to a schedule mutually agreed upon in writing by both parties.

a request at its sole discretion. The School District will fund the total pro�ram costs of the
additional officers, unless othenvise a�reed to in writin� by the parties.
9. Miscellaneous.
a. Any failure of a party to assert any right under this A�reement shall not constitute a
�vaiver or a termination of that right, this Agreement, or any provisions of this Agreement.
b. If a court or government agency with proper jurisdiction determines that any provision of
this A�reement is unlawful and rules such provision void, the balance of this Agreement shall
remain intact and in full force and effect.
c. This Agreement shall be interpreted and construed according to the laws of the State of .
Mimiesota. All litigation related to this Agreement shall be venued in the District Court of the
CoLmty of Ramsey, Second Judicial District, State of Minnesota.
d. The School District may conduct a study and analysis of their dnig prevention efforts and
the enforcement duties at the schools. The City shall have an active and participatory role in any
of these studies.
10. Payments and Billings.
a. In June of each year, the City will bill the District for reimbursement as outlined herein
for the costs of the SRO Program. All bills will be paid according to the terms of the Minnesota
Prompt Pay Law (35 days).
b. Each party agrees to fund one-half of the costs associated with the operation of the SRO
Program (Basic Services) based upon 9.5 months (19/24ths of the calendar year) of service. The
City agrees to pay the full cost of the remaining 2.5 months (5/24ths of the calendar year).
c. Each party agrees to fund one-half of the required match for the total costs associated
�vith the operation of the SRO Proa am (COPS Universal Hiring ProgYam) based upon 12
months (the fiill calendar year) of service.
d. For the School DistricYs budgeting purposes, in July of each year, the City will provide
an estimate of the costs of the SRO program for the upcoming school year. In all cases, actual
costs and not a budget estimate will form the basis for reimbursement billin�s to the School
District. If at any time during the period of this contract, the City estimates, or has reason to
believe, that flie final contract billing will exceed their original estimate by 10% or more, they
shall promptiy notify the District in writin�. The District or the City shall have the option of
suspendin� this program for the balance of that school year, btrt such suspension will not affect
the annual renewal of this contract, as specified herein.

11. Termination
a. In the event that the SRO program is eliminated for any reason, this agreement will
automatically terminate. At that point, services will be billed and paid for the time the program
�vas in effect and police personnel provided. A new agreement must be executed prior to the
resumprion of the SRO program.
b. If either party �vishes to terminate this agreement, it may do so by providing 60-day
written notice to the other party, unless otherwise provided herein. Termination may occur
according to a schedule mutually agreed upon in writing by both parties.
