� and because of practical difficulty.
` APPEARANCE : Richard H. Frey
� PROCEEDINGS: Mr. Frey provided some pictures of the interior and exterior
o t e t ir floor apartment . He� said it had existed for many years ,
although he had owned the building only since April, 1978. He said
there was no window in the kitchen, which violated light and ventilatian
reauirements , and the ceiling had some slanted areas and did not meet
= minimum standards for height . He stated that there were windpws on the
� North, East, and West sides of the apartment, which he felt gave good
cross ventilation for the ti,rhole unit .
- Alice Bij jani said the city was aware that the apartment existed at leas�
- since 1975 �ahen it was inspected for Certificate of Occup ancy. At that
' time a certificate was issued for four units , although the inspector
noted there were five, but she could only conjecture that the owner must
- have agreed to discontinue its use at that time.
Mr. Glassman asked what the code req,uired for ceiling height .
- Ms . Bijjani explained that that part of. the room which was over five feet
3, high was the part to be measured. Half of the room was required to have
: a height of 7 ft.
! �Ir. Tieso asked if an exhaust fan in the kitchen would suffice in lieu of
- a windoia.
Ms . Bijjani felt this would be a reasonable comnromise , but it sh�uld
- exhaust outside , t hat a filter-type would not do . She explained that an
- outside exhaust would compensate somewhat for lack of window ventilation .

She said that the bathroom required ventilation, too , but there was no
light reauirem�ent :
� In answer to an inquiry, Ms . Bijjani said the ceiling height had been
measured that morning by an inspector, who found that the higher areas of
� the ceiling measured from 6'� ft. to 6' 8" high, as opposed to the required
7 ft .
' Mr. Glassman stated that he thought ceiling height was related to the size
' of the occupants , that a short person would be quite comfartable in these
particular circumstances , whereas a person six feet tall or more would
� not want to rent a unit with these measurements .
BOARD ACTION: Mr. Glassman moved that a waiver of the ceiling height
requirement and the rec{uirement of a window in the kitchen be granted,
on condition that all remaining items listed in the Certificate of
Occupancy letter of 2/15/79 be brought into comnliance, and
that mechanical ventilation, according to code, be installed in the bath-
� room an d kitchen . Mr. Heider seconded. MOTIO:�T CARRIED AND SQ ORDERED.

The chairman stated that he had received a copy of a letter written
' on behalf of the Merriam Park Community Council by Betty McLaughlin
to Councilwoman Joanne Showalter, dated March 8, I979 . Chairman Wozniak
- noted several proposed revisions to Chapter 55 of the St. Paul Legis -
lative Code which Merriam Park Council requested be incarporated into
- the original ordinance setting up the Board of Appeals F� Review..
` After a brief discussion of the nroposed revisions , Cha�.rman Wozniak
MOVED that a letter be sent to the City Council requesting that the
Board be advised if or �ahen any changes in the ordinance were to be

apartment were placed lo��r enough and were of adec{uate size to serve as
: an emergency exit . She said that much of the unit was less than 500
below grade as well .

that tlie rental area windows were well above grade, which made for a
bright and cheerful unit . He said by his measurement �here were 62 sq. ft .
; of window area, which ec{ualled 11% of the 564 sq. ft. of livin g area,
: exclusive of halls , closets , and bathroom areas . He also showed a rough
sketch of the interior layout to illustrate several altern ate nassage�vays
' to reach the exits in case of a fire emergency.
• BOARD ACTION: Chairman Wozniak moved to grant a variance to permit occu-
- pancy of an apartment located in a basement more than 50% belo�a grade ,
an condition that any remaining items listed in the Certificate of

PROCEEDINGS: Mr. Heider asked if the windows in the sleeping room-'of
t�e b—asement unit were of adequate size to be used as an emergency exit
and whether the openings provided sufficient light and ventilation as
� required by code .
� Alice Bijjani expiained that the windows were large enough to be used �
_ as an exit, but provided only about 600 of the 16 sq . ft . required to
comply with light and ventilation reauirements .
: Mrs . Lowe said she felt the large window area in the adjoinin g living
and dining rooms more than made un for any deficiency in the bedroom.
� She said the tenant preferred the� bedroom light situation as it was ,
feeling that larger windows would make for less privacy.
� BOARD ACTION: Mr. Heider moved that a varian ce of light and ventilation
- requirements be granted to permit occupancy of the apartment more than
50% below grade . Mr. Tieso seconded.
A discussion ensued as to the value of sufficient light and ventilatian.
Ms . Bijjani explained that it was more important in a sleeping room,
: that sunlight was bacteriacidal, inhibiting the growth of molds and
bacteria, and that studies had been made iahich faund greater incidence
of illness in rooms that lacked proper light and ventilation .
Mr. Heider stated that he was auite willing to accept an amendment to
his motion which would rec{uire more ventilation. As no one offered
_ an amendment, the chairman put the motion to the Board.

Previous Hearing 2/13/79 : Continued to March meetin g because Certificate
of Occupancy inspection was scheduled in two weeks . �
, APPEARANCE : John 0. Larson, Darrell Carlson, co-owners
PROCEEDINGS : Mr. Larson stated that the city had con ducted a team
inspection recently and, in addition to the shar�d b athroom violations ,
others were found. Most of these had been corrected, and the remaining
items were in process of correction, except for the shared bathroom
� situation. Of the 12 units, two had private entranc�s and their own
private baths . Two of the remaining ten had private stools only, and
the other four units on each floor shared one bathroom containing al1

, required facilities .
Alice Bijjani stated that her office would like to see the buildin g
brought closer up to standard than it stood at present, especially in
; view of the owners' intention to sell the building.
. Mr. Larson said he was looking b asically at the first floor only in the
matter of addin g bathrooms , because it was a practical impossibility to
' add any on the second floor because of the building, canstruction . At
' a cost of about $800 per bathroom, it would be possible to add the
necessary facilities to provide each first floor anartment with its own
bathroom if the kitchen sinks in each unit could serve as hand sinks .
In other words , using closet space, he said they would put in t�ro stools
and four showers in addition to existing facilities on the first floor.
� Ms . Bijjani inquired as to the problem of ventilation in connection with
= use of closet space .
' Mr. Larson said that would be provided.
� Mr. Glassman remarked that this still left the szx second floor units
with ttiao shared bathrooms . He asked how many tenants were involved.
Mr. Larson said each unit had a single occupant, and he had no objection
to a restriction limiting rental of each unit to one person only.
� Mr. Glassman recalled that there was a suagestion made at the previous
. hearing that the second floor be converted to a rooming an d boarding
� house , which would allow for shared bathrooms if cooking facilities were
removed from the apartments . He said it would mean a little less income,
. but with the improvements in the first floor, more rent could be charged
for the units there, so t.he rental income in total should b alan ce out.
Mr. Larson said he hoped the sinks in the second floar units could remain
if there was a conversion to rooming house units .
- Ms . Bijjani said the Health Department would nrobably allow the sinks to
stay. It would be necessary to get a rooming and boarding house license
from the Health Department annually. This w ould mean that cooking
- facilities must be removed, but sinks alone were not prohibited.
BOARD ACTION: Mr. Tieso moved to grant a waiver of St . Paul Legislative
Code, Section 54 . 11, pertaining to requirement of hand sinks in bathroom
_ facilities, to permit occupancy of six first floor apartments, on con-
dition that each said apartment be provided with water closet and sho�aer
facilities within its walls, including proper ventilation as rec{uired by
: code ; and on further condition that the six second floor units be con-
- verted to rooming and boarding house accommodations in compliance iaith
