MINNESOTA � (c Committee: Date RESOLUTION AUTHORIZING SUBMISSION OF APPLICATION TO THE DEPARTMENT OF TRADB AND ECONOMIC DEVELOPMENT'S CONTAMINATION CLEAN-UP PROGRAM 1 WHEREAS, "Lowertown Bluffs" development is located in Dayton's Bluff District 4 neighborhood 2 to the south of Mounds Boulevard and Commercial Street, the developer, Mondo Management has 3 acquired over 75% of the property and plans to rehabilitate a 4-5 acre brown field into an urban 4 village with the buildings be mixed use and offering housing, commercial and office spaces; and 6 7 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 WHEREAS, approximately 90 housing units will be incorporated into the village with a wide range of prices that will fulfill multi-income needs with the one existing four story brick building being renovated to condos on the second, third and fourth floors, with commercial use on the first including a restaurant; and WHEREAS, this site is one of the lazger underutilized tracts of land in the City that has remained largely vacant and continues to deteriorate due to the conditions affecting the site; and WHEREAS, a Phase I Environmental Site Assessment, Phase II Environmental survey and Response Action Plan, if necessary, need to be completed on this property in order to complete the remaining development plan; and WHEREAS, the St. Paul Comprehensive Plan which was approved by the City Council and includes an approved Housing Plan directly identifies the need for to expand efforts to enhance the city's traditional neighborhood design and public spaces, meet new market demand and by encouraging production of 300-400 housing units a year; and WHEREAS, the CiTy of Saint Paul is a participant in the Livable Communities AcPs Housing Incentive Program as determined by the Metropolitan Council, and is therefore eligible to make application for funds under the DTED Contamination Investigation and RAP Development Crrant Program; and WHEREAS, Lowertown Bluffs has submitted a proposal to the HRA to develop this under utilized area consistent with the City's desires and goals pursuant to the City's Comprehensive Plan and vazious other plans approved by the City; and WI�REAS, Lowertown Bluffs' proposal is in need of financial assistance from DTED to undertake a Phase I and Phase II environmental investigation and if necessary develop a Response Action Plan for cleanup in order to move the development forward; and 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (HRA) approved by Resolurion 2001-10/24- to supportlsubmit an application under the Depariment of �,_ 1 , 0 0 Trade and Economic DevelopmenYs Contamination Investigation and RAP Development Cnant Program. BE IT RESOLVED BY that Ciry of Saint Paul, Minnesota hereby supports and approves submission to act as the legal sponsor for the project contained in the Contamination Investigation and RAI' Development Crrant Application be submitted on November 1, 2001 and that the Director of the Department of Planning and Economic Development of the CiTy of Saint Paul is hereby authorized to apply to the Departrnent of Trade and Economic Development for funding of this project. BE IT FURTHER RESOLVED that City of St. PaullHousing and Redevelopment Authority of the CiTy of Saint Paul has the legal authority to apply for financial assistance, and the institutional, managerial, and fmancial capability to ensure adequate project administration. BE IT FURTHER RESOLVED that the sources and amounts of the local match identified in the appiication are committed to the project identified. HRA Resolution 2001-10/24- . BE IT FURTHER RESOLVED that City of St. PauUHousing and Redevelopment Authority of the CiTy of Saint Paul has not violated any Federal, State or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice. BE IT FURTHER RESOLVED that upon approval of its application by the state, City of Saint PauUHousing and Redevelopment Authority of the City of Saint Paul, Minnesota may enter into an agreement with the State of Minnesota far the above-referenced project, and that Housing and Redevelopment Authority of the City of Saint Paul, Minnesota certified that it will comply with all applicable laws and regulation as stated in all contract agreements. NOW THEREFORE, BE IT RESOLVED that the Mayor and Clerk of the City of Saint Paul are hereby authorized to execute such agreements as are necessary to implement the project on behalf of the applicant.
