WHEREAS, the Council of the City of Saint Paul by Resolution
C.F. 241003 adopted November 19, 1968, did vacate that section of
public alley situated on premises located in the City of Saint Paul,
County of Ramsey, State of Minnesota legally described as follows:
All of the alley in Block 51, Dayton & Irvine's
Addition to Sa],nt Paul
and
WHEREAS, said vacation reserved to the City of Saint Paul and
other public instrumentalities, public utility easements contained
therein and thereon; and
WHEREAS, the Council has been requested to waive said easements
referenced above, and the affected City Departments� Northern States
Power Company and Northwestern Bell Telephone Company have filed
written certificates of intended non-use of certain reserved rights
and easements, which certificates are filed in the office of the
City Clerk and incorporated herein by reference; and
WHEREAS, the Public Works Department and the Water Department
of the City of Saint Paul, and Northwestern Bell Telephone Company
have consented to the waiver of all their retained easements in the
vacated streets as evidenced by the above referenced cert3,ficates=
and
WHEREAS, Northern States Power Company has consented to the
waiver of all its retained easements in portions of the vacated alley
as described in its certificate of non-use and again described as

to Saint Paul
NOW THEREFORE BE IT RESOLVED, that the Council of the City of
Saint Paul, pursuant to Section 228.06 of the Saint Paul Lagislative
Code, as amended does hereby waive, release and exti.nguish the
retained easements from portions of the vacated alley in Block 51
as specifically set forth in this resolution,
BE IT FURTHER RESOLVED, That the above mentioned waiver and
release of said easements are for the City of Saint Paul and those
persons for whom the City has reserved easements in said vacated
property for the installation,maintenance and operation of any
sewer, water, gas or electric main, pipe or conduit of public in-
strumentality.
